- Brand Name Justification The Federal Emergency Management Agency (FEMA) intends to award a sole source purchase order under FAR 6.302-1 "only responsible source and no other supplies or services will satisfy agency requirements." FEMA intends to award this Purchase Order to Cassidian Communications, Franklin, TN, 37067. The purchase order is for proprietary software maintenance and upgrades to the Emergency Notification System (ENS). The software, Communicator NXT, is part of a larger FEMA IT network that utilizes software developed and maintained by Cassidian. This purchase order will continue the annual maintenance and covers upgrades that are necessary. By continuing this annual agreement, FEMA will maintain the existing warranty coverage provided by Cassidian. Market research has demonstrated that no other software or firm can provide Communicator NXT software support by Cassidian. As stated earlier, the ENS utilizes operating systems that are proprietary to Cassidian. Installing and uploading another product from another could void the warranty with Cassidian and possibly create interoperability issues. At this time, FEMA does not have the resources to consider another system, rather, maintain the current emergency notification system. This purchase order will continue the current system and provide for continuous maintenance and system upgrades. Furthermore, selecting another system could create periods of downtime, which would impact emergency notification. Vendors must demonstrate that any substituted product would not cause any delay or downtime in service, and not void any existing warranty agreements with Cassidian.
