Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION I. CONTRACTING ACTIVITY: 23rd Contracting Squadron 4380B Alabama Road Moody AFB, GA II. DESCRIPTION OF THE ACTION: A sole source contract will be awarded to the incumbent contractor, Advanced Concepts Enterprises, Inc. (ACEs), to continue unit support services in support of the 41st Rescue Squadron (RQS), 71st Rescue Squadron (RQS), and 347th Operations Support Squadron (OSS) operations for 3 months with the option to extend up to nine months. III. DESCRIPTION OF THE SUPPLIES/SERVICES: Under the contemplated contract, ACEs will provide unit support services to 41 RQS, 71 RQS, and 347 OSS in the form of Unit Deployment Managers and Schedulers (6 FTE). The total estimated value of the acquisition is, with a base performance period of 3 months and three 3-month options. IV. AUTHORITY 10 USC 2304(c)(1), as implemented by FAR 6.302-1 (FAR 6.303-2(a)(4)). V. APPLICABILITY OF AUTHORITY: The current contract, FA4830-06-C-6003, will expire on 31 Mar 2011. No further extensions are available. The justification for restricting competition is in accordance with Federal Acquisition Regulation FAR 6.302-1 (Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements). Award of a unit support contract is necessary to ensure continuing operations of 41 RQS, 71 RQS, and 347 OSS due to the increased operational tempo associated with upcoming mass deployments. VI. EFFORTS TO OBTAIN COMPETITION: The Government has determined that ACEs, the incumbent contractor, is the only vendor capable of fulfilling the requirement for the short term without incurring undo cost and high risk for both the Government and contractor., it is anticipated that a long-term contract to meet this requirement will be solicited competitively. VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE: The sole source contract will carry over pricing from the current contract. Those prices were determined to be Fair and Reasonable at time of initial contract award and annually upon exercise of contract option periods. Market conditions have not changed appreciably since current prices were implemented. ACEs has agreed that the bridge contract can be accomplished without an additional cost to the government. VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED: A special notice was posted on Federal Business Opportunities (FBO) on 2 Feb 2011 notifying contractors of the 23rd Contracting Squadron's intent to issue a sole source procurement to the incumbent contractor, ACEs, on 01 Apr 2011, for a contract to continue operations No contractors have submitted comments or concerns from the special notice. Although another contractor, C2 Technologies, holds a similar contract with competitive pricing for other units on Moody AFB, transitioning would nonetheless involve disproportionate effort by both the contractor and the Government for such a short time period and therefore does not make sound business sense. IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION: Awarding a sole source contract to the incumbent is necessary to maintain current operational levels. Without a contract in place, 41 RQS, 71 RQS, and 347 OSS mission readiness will be diminished leading into a period of mass deployments of unit personnel and equipment. Awarding a contract with this short of a performance period to a contractor other than the incumbent would incur unreasonable expenses to the new contractor for recruiting and mobilization of contract personnel. Since this contract is only for 3 months initially with the possibility of three 3-month options, contracting a new contractor to obligate personnel would place undue financial burden on that contactor Therefore, it is in the best interest of the Air Force to award a sole source short-term contract to the incumbent. X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION: Advanced Concepts Enterprises, Inc. 151 Mary Ester Blvd Suite 301 E Mary Ester, FL. 32569 XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED: This contract will be awarded as a sole source requirement and will serve as a bridge between the existing contract XII. CONTRACTING OFFICER'S CERTIFICATION: "I certify to the best of my knowledge and belief that the information contained in this justification is accurate and complete." This is evidenced by the contracting officer's signature on the Coordination and Approval Document. (FAR 6.303-2(a)(12)). XIII. TECHNICAL/REQUIREMENTS PERSONNEL'S CERTIFICATION: As evidence by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete (FAR 6.303-2(b)).
