- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION I. CONTRACTING ACTIVITY: 23rd Contracting Squadron 4380B Alabama Road Moody AFB, GA II. NATURE AND /OR DESCRIPTION OF THE ACTION BEING PROCESSED: A new firm-fixed price contract, FA4830-11-M-S002 will be awarded as a sole source contract to Advanced Concepts Enterprises, Inc. (ACEs). The new contract will serve as a bridge to continue unit support services in support of the 38th Rescue Squadron (RQS) operations for three (3) months with the option to extend up to nine (9) months. III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS: Under the contemplated contract, ACEs, a Service Disabled Veteran Owned Small Business concern, will provide unit support services to the 38 RQS in the form of a Mobility Deployment Manager, a Supply Manager, a Vehicle Manager and a Scheduler (4 FTE). The total estimated value of the acquisition is shown on the coordination and approval document with an estimated award date of 01 Apr 2011. IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION: 10 U.S.C. 2304(c)(5), as implemented by FAR 6.302-5. V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY): The previous contract, FA4830-05-C-5010, was in place for 5 years and 6 months, and expired on 31 Mar 2010. The current bridge contract, FA4830-10-M-S012, has been in place 10 months and will expire 31 Mar 2011. The justification for restricting competition is in accordance with Federal Acquisition Regulation FAR 6.302-5 (Authorized or Required by Statute). In accordance with FAR 19.1406(a)(1) (15 U.S.C. 657f), there is not a reasonable expectation of obtaining offers from two or more Service Disabled Veterans Owned Small Business (SDVOSB) concerns. The requirement is not currently being performed by an 8(a) participant. ACEs perform same/similar services for another squadron on Moody AFB, GA. and is considered a responsible contractor with respect to performance. Award of a unit support contract is necessary to ensure continuing operations of the 38 RQS due to the increased operational tempo associated with upcoming mass deployments. VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE: A special notice was posted on 2 Feb 2011 notifying contractors of the 23rd Contracting Squadron's intent to issue sole-source procurement to the incumbent contractor, C2 Technologies Inc. on 1 Apr 2011, for a contract to continue operations. C2 Technologies Inc. was subsequently removed from contract consideration due to the fact that they are no longer considered a small business. Although no other contractors have submitted comments or concerns from the special notice, during market research ACEs indicated interest in providing the service. The lack of responses from the special notice posting is a strong indication that no other offers will be received within such a short period (less than 30 days). One other provider recommended by the incumbent, indicated interest in providing requested service. However, after learning of the temporary nature (3-month base with option to extend three (3) times not to exceed 1 year) of requirement, determined requested services too costly and not in their best interest. The Government has determined that ACEs is the only vendor capable of fulfilling the requirement for the short term without incurring undo cost and high risk for both the Government and contractor. VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE: The cost associated with this contract will be negotiated in accordance with FAR 15 and compared to the current contract of similar positions held by ACEs. The current contract cost was determined to be fair and reasonable based on competition when it was originally solicited and reviewed annually upon exercise of contract option periods. Market conditions have not changed appreciably since the last option was exercised. VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED: As described in Section VI above, a special notice was posted on Federal Business Opportunities (FBO) on 2 Feb 2011 notifying contractors of the Government's intent to issue a sole-source procurement to the incumbent contractor, C2 Technologies Inc., on 01 Apr 2011, No contractors have submitted comments or concerns from the special notice. However, prior to the Special Notice during our market research, ACEs stated that they would be interested in the bridge contract since they have a contract providing same/similar services with another base unit. Based on the information in paragraph VI, the Government determined that a sole source contract to ACEs would be cost effective and pursuing other contractors at this time would cause a lapse creating an unavoidable delay in services. IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION: Awarding a sole source contract to ACEs is necessary to maintain current operational levels. Without a contract in place, 38 RQS mission readiness will be diminished leading into a period of mass deployment(s) of unit personnel and equipment. Awarding a contract with this short of a performance period to a contractor other than the incumbent or ACEs would incur unreasonable expenses to the new contractor for recruiting and mobilization of contract personnel. Since this contract is only for three (3) months initially with the possibility of three 3-month options, contracting a new contractor to obligate personnel would place undue financial burden on that contactor if the positions were to be in-sourced after a very short time. X. TECHNICAL/REQUIREMENTS PERSONNEL'S CERTIFICATION: As evidence by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete.
