- Sole Source Brand Name Justification Special Notice Solicitation No. RES-11-119 U.S. Nuclear Regulatory Commission (NRC) Division of Contracts Mail Stop TWB 01 B10M Washington, D.C. 20555 Classification Code: -- General purpose information technology equipment Contracting Office Address: U.S. Nuclear Regulatory Commission Office of Administration Division of Contracts 11545 Rockville Pike Rockville, MD 20852-2738 United States SUBJECT LINE: NOTICE IF INTENT TO NEGOTIATE SOLE SOURCE PURCHASE ORDER FOR ABAQUS FINITE ELEMENT CODES The U.S. Nuclear Regulatory Commission (NRC) intends to negotiate a sole source/non competitive/ purchase order under the authority of FAR 13.106-1(b) with Simulia Corporation to acquire twenty-five (25) analysis tokens; and five (5) CAE seats of Pre/Post software. The period of performance for this proposed acquisition is 12 months from date of award and acceptance. Based on NRC's market research it was concluded that ABAQUS software licenses are the only reasonably available software that meet NRC's current finite element analysis requirements, and are only available for purchase from its manufacturer, Simulia Corp. (see attached justification). However, any responsible sources that can demonstrate that they too, can provide the required software may respond to this notice to so indicate. This notice of intent is neither a request for quotes nor a solicitation of offers. A determination to compete this proposed procurement will be based on responses to this notice and is solely within the discretion of the Government. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. In doing so, interested sources must submit technical capabilities and any other information that demonstrates an ability to meet the NRC's needs. Detailed capabilities must be submitted to Wanda M Brown, Contract Specialist, at the U.S. Nuclear Regulatory Commission, Division of Contracts, TWB 01 B10M, Washington D.C. 20555 via mail no later than April 5, 2011.
