- Sources Sought Notice No: W5J9JE-11- This sources sought announcement is for information and planning purposes only! This is NOT a solicitation for proposals, proposal abstracts, or quotations. The purpose of this notice is to obtain information regarding: (1) the availability and capability of qualified business sources; (2) whether they are a small businesses; HUBZone small businesses; service-disabled, veteran-owned small businesses; small businesses; veteran-owned small businesses; woman-owned small businesses; small disadvantaged businesses; or large business and (3) their size classification relative to the North American Industry Classification System (NAICS) code for the proposed acquisition. (4) Technical capability to satisfactorily perform the requirements at a high degree of satisfaction. (5) Your responses to the information requested will assist the Government in determining the appropriate acquisition method, including whether a set-aside is possible. The NAICS code for this project is 481211 AND 481212 The small business size standard is $5,000,000 per annum. Requirements: Major tasks required of the Contractor include the following: PERFOMANCE WORK STATEMENT (AED-N IN COUNTRY AIRLINE SERVICES) 13 Feb 2011 Version 1.1 1.0General 1.1It is the intention of the Government to add other contractors who demonstrate they are capable of providing the services described in this exiting Blanket Purchase Agreement (BPA). The purpose of this BPA is to secure air travel services for USACE military and civilian personnel. The Contractor shall perform all the functions and duties for this BPA, in accordance with the terms and conditions as outlined in the following sections. 2.0 Scope of Work The Contractor shall provide all the necessary tools, equipment, materials, labor, supervision and management to properly provide AED-N in Country Air Traffic Services to and from the locations stated within the attached schedule. Services must be available a minimum of two to three days per week. It is estimated that a minimum of 10 to a maximum of 100 AED-N passengers require flights per week; however, Contractors are not guaranteed a specific number of tasker under this BPA. The Contractor will act as an independent Contractor and not as an agent of the U.S. Government. It shall be the responsibility of the Contractor to ensure that all Contractor's personnel are capable of receiving the appropriate identification documents for access to required areas at their respective sites and appropriate security levels. 3.0Flight Reservations Only individuals identified as authorized callers may place calls for flight reservations against this BPA and only to the extent of the dollar limitation indicated. Work orders will be placed by e-mail, telephonically, or in person IAW authorized callers' individual authorizations as identified by the Contracting Officer. 4.0Period of Performance. Period of performance of this BPA shall be one year (23 Feb 2011 thru 25 Feb 2012). 5.0Confidentiality. Contractor shall maintain at all times the confidentiality of proprietary information pertaining to the Contractors, service providers, or Contractor firms with whom its employees come into contact during the course of their performance of work pertaining to this BPA or as the result of working in proximity to such information. All Contractor employees will be required to maintain the security and confidentiality of all information that directly or indirectly comes into their possession or attention on a strict operational need-to-know basis. 6.0Records. Contractor shall maintain and preserve all records and information, whether in electronic, audio, video, or paper format that is directly or indirectly generated during performance of its work on regard to this BPA in an orderly and readily accessible manner as per Section I DFARS 252.227-13 Right in Technical Data-Noncommercial Items (NOV 1995). 7.0Definitions: 7.1 Contractor: Contractor and its subcontractors at any tier 7.1.2 Contracting Officer's Representative (COR): An appointed assistant of the Contracting Officer authorized to administer the terms of this BPA. 7.1.3 AED Personnel: Referenced as "personnel" for which services are being rendered. 7.1.4 AED: Reference to the Afghanistan Engineer District headquartered in Kabul with offices throughout Afghanistan. 7.1.5 Scheduled Maintenance: Periodic prescribed inspections or servicing of aircraft or equipment, accomplished on a calendar, mileage, or flight-hour basis. 7.1.6 Unscheduled Maintenance: Maintenance that is not scheduled but is required to correct deficiencies and to restore the aircraft or equipment to a serviceable condition. 8.0Service to be Performed 8.1The Contractor shall provide safe, operable, clean fixed wing commercial aircraft and associated services for direct air service to and from the locations provided within this BPA. 8.1.1Point of Contact: The Contractor shall provide a point of contact within his/her company, fluent in English, to interface with the Contracting Officer or COR on issues concerning transport. Names, business address, phone numbers and hours of operation are the minimum information requirements. Contractor shall provide 24-hour contact number and e-mail address. 8.1.2Insurance: Contractor shall obtain at Contractor's expense, and keep in effect t all times during the term of this contract, all insurances as required by applicable law and regulation, including the FAR (see specifically FAR 28.307-2). Since aircraft are used in connection with performing this BPA, the Contactor shall carry aircraft public and passenger liability insurance in amount required by the FAR. All Certificates of Insurance must contain an endorsement to the effect that any cancellation or material change in the coverage adversely affecting the Government's interest shall not be effective unless the insurer or the Contractor gives written notice of cancellation or change as required by the Contracting Officer (see FAR 28.302). In addition, the US Government, its officers, agrees and employees shall not be liable for any replacement or repair of aircraft lost, stolen, damaged, or destroyed. The Contractor shall be solely liable for any and all claims, demands, judgments, fines, losses, damages, expenses, personal injury, charges or costs of any kind or character which arise out of or are in any way connected to this BPA. 8.1.3Records: The Contractor shall maintain a record of billable tickets on a monthly basis and the Government will maintain a record of billable flights on a monthly basis. Upon request by the Government, the Contractor shall make sure records are available to properly designated BPA representatives for the purpose of reconciling between the Government's record of billable flights and the Contractor's record of billable flights. The purpose is to ensure the Government's billable flight records and the Contractor's billable flight records concur. Deviations must be resolved to the Contracting Officer. 8.1.4Safety: The Contractor shall maintain a Civil Aviation Authority (CAA) or U.S. Federal Aviation (FAA) certificated that complies with the United Nations International Civil Aviation Organization (ICAO) standards. 8.1.5Contractor is obligated to comply with generally accepted standards of airmanship, training, and maintenance practices and procedures. The cleanliness and orderliness of an aircraft (including the visible components and surfaces thereof) affect the ability to inspect an aircraft, and may be valid indicators of the overall maintenance level of an aircraft, and may have a direct effect on the security and confidence of passengers. Therefore, Contractor's failure to keep and maintain all such components and surfaces of the aircraft used in performance of this contract clean, orderly, and in good state of repair may be deemed a failure to comply with generally accepted standards of maintenance to the extent the failure goes beyond mere cosmetic or housekeeping deficiencies and relates in some manner to confidence in the safety, maintenance, or airworthiness of the aircraft. 9.0Nonuse Status: Should the Government determine that any of the following conditions exist; it may suspend or place in temporary nonuse status Contractor's further performance of air transportation services for AED. a.Contractor's failure to meet any of the obligations imposed to this performance work statement. b.Involvement of one of Contractor's aircraft in a serious or fatal accident, incident, or operational occurrence (regardless of whether or not such aircraft is being used in the performance of this contract). c.Any other condition that affects the safe operation of Contractor's flights hereunder 10.0Notice of Accidents: When a Contractor's aircraft is involved in any accident or incident, as described above, in support fulfilling this Government requirement, the Contractor shall notify the COR by the most expeditious means available, but in no event shall notification occur more than two (2) hours after said accident or incident. 11.0Invoices and Billing: Contractor shall provide bi-monthly itemized invoices to include at a minimum: a.BPA/Task Order Number b.Passenger name c.Itinerary d.Date of flight e.Cost of flight in USD f.Additional charges for cancellations, no-show's, and excess baggage if applicable. 12.0Flight Rates: Flight rates are subject to change. Contractor shall notify the Contracting Officer's Representative when rate changes become effective. 13.0Excess Baggage rates: Excess baggage rates are subject to change. Contractor shall notify the Contracting Officer's Representative when rate changes become effective. 14.0Cancellations. Bookings made by the Government may be subject to cancellation at any time by the Contractor due to weather, unscheduled maintenance, emerging security threats and/or other operational factors. In such cases, there will be no charge to the Government. All changes will be generated once the passenger has completed travel. If the passenger does not show up for the flight, without providing notice of cancellation at least 12 hours prior to departure time, then AED will be charged the full ticket cost. The contractor will notify the Government of any delays, cancellations, or maintenance issues within a minimum of four (4) hours of flight time. The Government reserves the right to cancel any flight or reservation 12 hours prior to the flight time without any cost to the Federal Government. 15.0Bookings Availability. Booking/ticketing agents must be available to the Government so that tickets may be purchased with as little as two (2) to twelve (12) hours notice. 16.0Additional Routes: Additional routes may be added on an as-needed basis throughout the life of this BPA. 17.0Submission of Quote: Contractor must include the following in their Quote packages: a.A minimum of one (1) of the below listed certifications: 1.Civil Aviation Authority (CAA) 2.US Federal Aviation Authority (FAA) 3.Commercial Air Review Board (CARB). The contractor shall either have Commercial Airlift Review Board (CARB) certification from the United States Transportation Command (USTRANSCOM) or achieve CARB certification within six (6) months after being awarded a Department of Defense (DoD) contract IAW DoD Instruction 4500.53.3. This effort is classified through the North American Industry Classification System NAICS under 481211, Non Scheduled Charter Passenger Air Transportation. b.Schedule of operation for booking/ticketing agents, and methods of contact c.Baggage limitations and weight restrictions d.Price schedule to include charges for cancellations and no shows e.Certificates of Insurance 18.0Surveillance: Surveillance of BPA performance is the method used by the Government to determine whether the Contractor is effectively and efficiently complying with all terms and conditions of this BPA. The following minimum surveillance methods shall be used. 18.1Evaluation Form: The Customer evaluation form will be used to validate customer satisfaction. 18.2 Customer complaint. Customer complaints may be used as a basis for identifying non-compliance with performance objectives. 18.3 Random Monitoring and periodic inspections. 19.0Performance Reviews and Evaluations 19.1The COR will conduct semi-annual performance reviews and annual evaluations with the Contractor based on information obtained, at a minimum, through the surveillance methods identified above. 19.1.1The COR will note standard performance objectives deficiencies and all customer complaints documented during the specified period of time. The COR will thoroughly document all deficiencies, identify source of information, and reference the applicable PWS performance standard or contract requirement for which the deficiency applies. 19.1.2The COR will generate performance a\reports using the customer evaluation report. This report will identify the level to which the performance standard for critical objectives was achieved based on cumulative total of all activity for the period of performance. 19.1.3Analysis of performance review results: at the end of each performance evaluation period, the Contracting Officer (KO) will evaluate all surveillance data to determine those critical performance standards that do not meet the standards as stated in the PWS. The KO will prepare a Contract Discrepancy Report (CDR) and issue it to the Contractor. The CDR will make reference to the performance objective and standard and state how the PWS was not met. The Contractor will be required to respond to the KO generated CDR within five (5) working days. The Contractor's response shall be in writing and explain why the performance deviated from the PWS, how the performance will be returned to acceptable levels, and how a recurrence of the problem will be prevented in the future. The KO may issue, at any time deemed necessary, a CDR for recurring failure to meet other BPA performance objectives and requirements. The Contractor shall respond in accordance with requirements identified herein. A copy of the CDR will be provided to the KO within five (5) working days after the end of the evaluation period. 20.0Weapons and Body Armor Weapons shall be allowed. They may be unloaded, cleared and inspected by the crew before boarding. Small arms may be hand-carried on board. No pyrotechnics, explosive devices, flammable, or other hazardous materials may be brought on board, including AT-4s, grenades and similar items. 21.0 Identification Identification will be required from the person or persons that are booked on the flight. Each passenger should be prepared to provide a valid photo identification issued by their respective country/organization before boarding the aircraft. Photo identifications will be inspected by the Contractor's agent. 22.0Check-In Each passenger should be prepared to board the aircraft 60 minutes prior to scheduled departure. 23.0Capacity. Aircraft must be capable of carrying a minimum of 10 passengers and their associated baggage/body armor (100 kg total) to support new deployers and people returning home. The Contractor shall provide flights that are capable of flying during day light hours, night time, and reasonable Instrument Meteorological Conditions (IMC). 24.0Aircraft to be used The contractor shall have in their inventory to be available for use a combination of fixed wing and rotary aircrafts that can transport at minimum ten (10) passengers at a time with associated baggage. 25.0Areas of Operations Travel from Kabul International Airport to all the following airports/Forward Operating Bases twice per week: a.Asadabad b.Bamyan (FOB Kiwi) c.Camp Thunder d.Feyzabad e.Finley Shields f.Gardez (Goode Army Airfield) g.Ghazni h.Jalalabad i.Kalagush j.Kandahar Airfield (Kilo ramp) k.Kunduz l.Logar (FOB Shank) m.Meymaneh n.Mazar-e-Sharif o.Morales Frazier p.Salerno q.Sharana r.Shindand s.Wardak 25.1Flights to Bagram and return to Kabul International Airport are required twice a day, morning and afternoon. 25.2AirCraft to be used Aircraft Type Operator AOC Reference MI8 Rotary Burendavia AK-0374-08 MI8 Rotary PanH No. 69 FIXED WING Balmoral Cat 135 No. F04731 ZS ROTARY Balmoral Cat 127 No. F04719 FIXED WING Balmoral Cat 121 No. F04718 Anticipated Period of Performance: The anticipated period of performance is 23 Feb 2011 thru 25 Feb 2012. Capability Statement/Information Sought: Interested qualified business organizations should submit a capability statement for this requirement, not to exceed 60 single-sided pages (including all attachments, past experience, performance on prior/current identical requirements, resumes, charts, etc.), presented in single-space and using a 12-point font size minimum, that clearly details the ability to perform the aspects of the notice described above. The capability statement should be separated into the following sections; (1) Maintenance schedule, (2) Inspection method, (3) Past Experience, (4) Performance (5) Rough Order of Magnitude Costs broken out by individual tickets.
