Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1.Identification of the Agency and the Contracting Activity: Department of Veterans Affairs, Great Lakes Acquisition Center 5000 W National Avenue Bldg 5, Milwaukee WI 53295 2.Nature and/or description of the action being approved: Justification and approval for other than full and open competition for a contractor that has a specialization in General construction. This requirement was set aside 100% for Service-Disabled, Veteran-Owned Small Businesses (SDVOSB). Building 2 Roof at the Clement J. Zablocki VA Medical Center in Milwaukee, Wisconsin needs immediate and urgent repair to preserve watertight integrity. The project has been selected to be completed by Progressive Construction, LLC. The Government estimates the price to be $499,000. 3.A description of supplies/services required: Work includes: 1.Conduct a full site review of the building 2 roof leaks to verify if other areas have structural water damage 2.Provide support for roof framing in fully or partially collapsed areas that matches the adjacent roof construction and profile. 3.Provide support for areas of the roof structure currently in distress but not yet experiencing full or partial collapse. 4.Abatement of any hazardous materials required to be removed affected by all work. 5.Design/production of as-built drawings. 6.Design and installation of electrical, mechanical and fire protection systems affected by all work. 7.Patch exterior walls where damage occurred or occurs due to collapsed roof, removal of debris, shoring or reconstruction. 4.Statutory authority permitting other than full and open competition: Information Letter 049-07-08, Public Law 109-461 (38 U.S.C. 8127) and FAR 6.302-5, Authorized or Required by Statute 5.Facilities Unique Qualifications: None 6.Efforts made to ensure that offers are solicited from as many potential sources as is practicable: Not Applicable. 7.Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable: The award price of the contract is $499,000 and will exceed the simplified acquisition threshold (as defined in section 4 of the Office of federal procurement Policy Act (41U.S.C. 403) but will not exceed $5,000,000, and in the estimation of the contracting officer, the contract award was made at a fair and reasonable price that offers the best value to the United States. 8.Market survey conducted: The concern, Progressive Construction Services, LLC is a Service Disabled Veteran Owned Small Business registered in the Vendor Information Pages (VIP) database, available at www.VetBiz.gov. A review of Progressive Construction Services, LLC's capability/profile information revealed that they have the experience, expertise and bonding level to perform the scope of work outlined in this project. Progressive Construction Services, LLC is determined to be a responsible source with respect to performance of such contract opportunity. Additionally, it is believed the Government will save a significant amount of money by utilizing Progressive Construction Services, LLC for this project. 9.Other facts: None 10.Other sources expressing an interest: Other contractors showing interest did not appear to have a firm understanding on the requirements of the project. 11.Actions to remove or overcome any barriers to competition: Not Applicable at this time 12.Certification: I certify that this justification is accurate and complete to the best of my knowledge. //S// Rich Hedman Contract Specialist, VA GLAC 03/15/2010
