Reference Number: NHLBI-CSB-(AR)-2011-116-CRS Title: System De-Installation and Re-Installation of CM120 Transmission Electron Microscopes THIS IS A SOLE/SINGLE SOURCE, NON-COMPETITIVE NOTICE. This notice of intent is not a request for competitive proposals. This sole / single source, non-competitive notice is prepared in accordance with FAR Parts 5 & 13. This notice of intent is not a request for competitive proposals. Far Part 6 - Competition Requirements, is not applicable to contracts awarded using simplified acquisition procedures of FAR Part 13, not expected to exceed the simplified acquisition threshold. This announcement constitutes the only notice; proposals are not being requested and a written solicitation will not be issued. The resultant acquisition will be conducted in accordance with FAR Part 13, simplified acquisition procedures and the resultant purchase order will include all applicable provisions and clauses in effect through the Federal Acquisition Circular 2005-48 (effective January 31, 2011). The total estimated amount of this contract is NOT expected to exceed the simplified acquisition threshold of $150,000.00. The North American Classification System (NAICS) code applicable to this requirement is 334516 and the associated small business size standard is 500 Employees. THE NATIONAL INSTITUTES OF HEALTH (NIH), National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA) on behalf of the National Institute of Arthritis and Musculoskeletal and Skin Diseases (NIAMS), intends to negotiate and award a purchase order on a sole source non competitive basis, to FEI Company, 5350 NE Dawson Creek Drive, Hillsboro, OR 97124, for the de-installation and re-installation of the CM200 Transmission Electron Microscopes into a new room. The sole source determination is based upon the fact that there is FEI Company proprietary technology involved in both the hardware and software that controls the CM120 Transmission Electron Microscope. The procedure for the relocation, including; disassembly, reassembly, alignment and specification testing, can only be done by FEI Company. FEI Company (formerly Philips Electron Optics), the original manufacturer of the microscope, has maintained the instrument since its procurement. FEI Company is the only supplier qualified to service this advanced and intricate instrument to the standards of operation essential for sustaining the performance of NIAMS electron microscopy experiments at the state-of-the-art. FEI Company's service engineers are the only engineers that receive factory training on how to maintain and repair these instruments, and therefore, are the only ones that have the necessary knowledge to perform this work. Furthermore, the microscope being moved is currently under a maintenance contract with FEI Company, and using a third party, even if another qualified company existed, would infringe on the agreement currently in place. Interested parties may identify their interest and capability to respond to the requirement or submit a response. This notice of intent is not a request for competitive proposals. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
