Description
As required by Federal Acquisition Regulation 13.501, a sole source determination has been prepared to document the facts and rationale to support the determination that only one source is available to provide the agency's requirement. The supporting data has been prepared by the Bureau of Reclamation technical personnel. 1. Description of the services: The Bureau of Reclamation intends to award to Andritz Hydro Corp (formerly known as VA Tech Hydro), a purchase order for the Siemens PLC Software modifications at Yellowtail Powerplant. Each Generator at the Yellowtail power plant is outfitted with a PLC based digital governor control system that was originally designed, installed, and programmed in the 2001 to 2003 time frame by Andritz Hydro Corp via Contract No. 00CP600520. In support of an on-going project to upgrade the Wyoming and Montana area hydro facility Supervisory, Control, And Data Acquisition (SCADA) network, the Yellowtail Unit governor control software must be modified for purposes of power plant/generator optimization. The software modifications will support Western's Automatic Generation Control (AGC) function for their control area, provide plant generation control features at Yellowtail, and provide the Reclamation Operator in Casper with supervision over the controls in order to maintain water constraints and minimize operating costs at Yellowtail The software that was developed to control the governor response/performance under the original contract is the proprietary property of Andritz Hydro, formerly VA Tech Hydro. Based on their first hand experience developing the existing code and their proprietary rights to the written code, Andritz Hydro needs to be hired as a sole source contractor to design and implement software code changes necessary to support the SCADA network enhancement (Generator Optimization) at Yellowtail power plant. 2. Identify the proposed contractor (with address) and describe why they are the only source capable of providing the supply/service: Andritz Hydro Corp, 10735 David Taylor Drive, Suite 500 Charlotte, NC 28262. The software that was developed to control the governor response/performance under the original contract is the proprietary property of Andritz Hydro Corp. 3. Estimated cost: $67,500.00 4. Justification and Approval Statutory Authority: FAR part 6.302-1(a)(2)(ii)(B), "Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in --(B) Unacceptable delays in fulfilling the agency's requirements, only one responsible source and no other supplies or services will satisfy agency requirements." 5. Additional Information:The Government believes that only one responsible source can provide the scope of required services. This is not a request for competitive quotes. Any responses/inquiries received within 5 calendar days of the date of publication of this notice may be considered by the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement, if the need arises. Responses to this notice shall be mailed or faxed to: Bureau of Reclamation, GP-5000, Attn: Arlene Dawson, 316 N. 26th St., Billings MT 59107, Fax 406-247-7798. Email to adawson@usbr.gov. Responses should include the firm's DUN and Bradstreet number (DUNS) and Tax Identification Number (TIN). Firms shall identify themselves as either small business, or other than small business, in accordance with the size standard for (NAICS) Code 541511 which is $25.0 million. This notice may represent the only official notice of such a solicitation. A Justification for Other than Full and Open Competition has been prepared in support of this acquisition. This notice is not a request for competitive proposals. A determination by the Government not to compete this proposed action is solely within the discretion of the Government.
