- The Department of Veterans Affairs National Energy Business Center Justification and Approval For SDVOSB Sole-Source Upon the basis of the following justification, a sole-source procurement to a SDVOSB for the proposed contractual action is hereby approved based on the contracting officer's market research. 1.Identification of Agency and Contracting Activity The Department of Veterans Affairs, National Energy Business Center, 4141 Rockside Rd., Seven Hills, Ohio, 44131. 2.Nature/Description of Action This activity proposes to issue an RFP to Ironclad Services, Inc, an SDVOSB, for the installation of one (1) E85 fueling station located at the Togus VAMC, West Campus, 1 VA Center, Augusta, ME 04330. 3.Description of Supplies/Services This is a "Turn-Key" project for an above ground, double-walled E85 Fueling Station. The capacity of the E85 Fueling Station is a follows: Togus VA Medical Center - 2,500 gallons. The fueling station tank shall be double-walled, gallon capacity by location as listed above and ballistic proof. The skid shall be anchored to the new concrete foundation. The concrete foundation design shall be prepared and stamped by a structural engineer licensed in the appropriate state. A Programmable Logic Control (PLC) panel will control the fuel system. The fuel tank, pumps, pumps, dispensers and related equipment shall be skid mounted and provided as a turn-key system. The contractor shall provide an integrally constructed and fabricated, tested and certified system prior to delivery to the VA site. The tank shall contain a product decal specific to the site. Where required, containment structures shall be constructed of steel-reinforced concrete. Provide on-demand, monitoring and reporting of actual fuel consumption, vehicle ID, odometer reading, date of fueling and gallons dispensed. Date of fuel transport shall be included. Contractor shall provide a card reader/fuel management system capable of authorizing and recording both fuel and fuel transactions using the Wright Express (WEX) and General Services Administration (GSA) Smart fuel cards processing system. The controller shall be compatible with the GSA controller to assist in the reimbursement for the E85 fuel. The system shall be connected to one or more remote billing services by telephone modem for a high speed line, for the purpose of remotely authorizing, recording, and billing transactions by fuel networks (such as Voyager). The Contractor shall be responsible for setting up the remote billing accounts coordinated by the Contracting Officers Technical Representative (COTR). 4.Statutory Authority Permitting Other Than Full and Open Competition ( )41 U.S.C. 253 (c) (1)Only One Responsible Source ( )41 U.S.C. 253 (c) (2)Unusual and Compelling Urgency ( )41 U.S.C. 253 (c) (3)Industrial, Mobilization, Engineering, Developmental, orResearch Capability or Expert Services ( )41 U.S.C. 253 (c) (4)International Agreement (X)41 U.S.C. 253 (c) (5)Authorized or Required by Statute - PL 109-461 ( )41 U.S.C. 253 (c) (6)National Security ( )41 U.S.C. 253 (c) (7)Public Interest 5.Demonstration of Contractor's Unique Qualifications Ironclad Service, Inc. is registered and verified in the VIP Database (www.vetbiz.gov), as well as CCR, and has the applicable NAICS code (237120). 6.Publicized Requirements This J&A shall be posted within 14 days after an award is made. 7.Determination of a Fair and Reasonable Cost The determination of a fair and reasonable cost will be accomplished through the comparison of proposed price with the government estimate. 8.Market Survey VA-NEBC has developed a significant geographical database of qualified and competent SDVOSB companies based on previous projects. Ironclad Services, Inc. was contacted to see if they had prior experience with E85 fueling stations. Ironclad Services, Inc. referenced projects similar in size and scope. 9.Other N/A 10.Actions taken to remove barriers to competition N/A Certification The information contained in this justification for other than full and open competition is certified accurate and complete to the best of my knowledge and belief.
