This contract shall include the management and operation of two on-site cafeterias, site wide vending and the opportunity to compete for catering operations. The scope of this Statement of Work (SOW) does not impact Fire and Security systems; however, regular Security Escort will be required for various areas of the site until adequate Security Clearances can be obtained. This contract shall be established as Profit/Loss with no cost to B&W Pantex for Food Service operations. This contract shall be for a length of one year with the option for four one year extensions. 1.2 BACKGROUND B&W Pantex is under contract with the U.S. Department of Energy (DOE) to manage and operate the Pantex Plant. The Pantex Plant is a DOE/National Nuclear Security Administration facility located in Carson County, approximately 17 miles northeast of Amarillo, Texas. The Pantex Plant is the United States only nuclear weapons assembly and disassembly facility. The Pantex Plant has five primary operational missions: • Weapons Assembly • Weapons Disassembly • Evaluation of Weapons • High Explosive Research and Development • Interim Plutonium Pit Storage The plant is a secure site, and as such, various levels of security clearances are required for anyone working at the plant. No one from the general public is permitted on site without advance notification. There is a significant level of highly specialized training required of most of the employees due to the mission of the plant. In addition, a special fire department is maintained at the plant to further ensure safety. The majority of employees working at the Pantex Plant are contract employees and of those, the majorities are B&W Pantex employees. 1.3 LOCATIONS Location of work will be as follows: Cafeteria operations shall be in the 12-70 Main Cafeteria and 12-103 satellite Cafeteria. Vending operations shall take place in numerous buildings site-wide with proper approval. Catering operations shall take place in numerous buildings site-wide with proper approval. The locations of work are in: Cafeterias - Property Protected Area (PPA) Vending - Property Protected Area (PPA), Limited Area (LA), Protected Area (PA) and Material Access Area (MAA). Catering Operations - Property Protected Area (PPA) and Limited Area (LA) These locations are not in an area controlled for radiological purposes. NOTE: 12-70 Cafeteria The 12-70 cafeteria is a modified hollow open square servery design with various hot and cold attended and self-service stations around the perimeter of a rectangular shaped servery and a large self-service salad bar in the center. There are three cashier stations. Cashiers accept both cash and payroll deduction for payment of food in the cafeteria. Payroll deduction is a convenience for some employees who do not carry change simply because they have to pass through metal detectors coming and going to their work stations, or for other employees who simply appreciate the convenience of having a payroll deduction system. The kitchen and servery were both renovated in 1997, and contain a full complement of hot and cold food production and serving equipment. (Refer to Exhibit 2 - Food Service Equipment Lists) The 12-70 cafeteria dining room has approximately 310 seats. All equipment is owned by the US government with the exception of vendor provided equipment and leased equipment that includes several beverage dispensers in the servery including the vending machines. In addition to pump type condiment dispensers, salad dressings and condiments are all in portion control packages in this cafeteria. The POS (point of sale) cash register systems are Micros with integrated scales for by-the-ounce products and card scanners for the payroll deduct system. The 12-70 servery has the following stations: • Entrees/Grill • Deli • Salad Bar/Soup • Cold Beverages (bottled, carton, fountain) • Coffee • Desserts Chilled and Frozen • Grab and Go • Cashiers (3) The following is a representative sample of menu items that are currently offered in the 12-70 Cafeteria. The contractor will be expected to include an appropriate number of healthful food choices at each meal period, which are not of the microwaveable nature to insure a healthy aspect of the food product. BREAKFAST Scrambled Eggs Eggs to Order Pancakes Sausage, Bacon Fresh Baked Biscuits Hot and Cold Cereals Breakfast Breads Whole Fruit Yogurt LUNCH Cold Foods Self-serve Salad Bar Pre-packaged Salads Yogurt, Fresh Fruits Made-to-Order Deli Sandwiches Pre-packaged Sandwiches Assorted Cakes, Pies, Cookies, Puddings Hot Foods Soups (1 daily) Meat, Fish, or Poultry Entrees (2 daily) Pantexan Special (entrée, 2 vegetables, roll) Grilled Foods: Hamburgers, Hot Dogs, Chili Dogs, French Fries, Grilled Sandwiches Potato/Starch (1 to 2 daily) Vegetables (2 to 3 daily) The 12-103 cafeteria is much smaller than the 12-70 cafeteria and is a straight line designed cafeteria, meaning that customers must follow the same path through the servery, selecting their items from self-service and attended stations and then pass by the single POS cashier station. Most food served here is prepared in the 12-70 cafeteria and brought to the 12-103 cafeteria in insulated hot food mobile carts as well as cold food mobile carts. The foods are delivered in the Food service step van. In addition to pump type condiment dispensers, salad dressings and condiments are all in portion control packages in this cafeteria. There are approximately 162 seats in the dining room area. There is a double door domestic refrigerator and a freezer on one side of the dining room for employees who wish to store their lunches brought from home. The 12-103 servery has the following stations: • Entrees/Grill/Soup • Premade Sandwiches • Premade Salads • Cold Beverages (bottled, carton) • Coffee • Desserts Chilled and Frozen • Grab and Go • Cashier (1) The following is a representative sample of menu items that are currently offered in the 12-103 Cafeteria. The contractor will be expected to include an appropriate number of healthful food choices at each meal period, which are not of the microwaveable nature to insure a healthy aspect of the food product. BREAKFAST Scrambled Eggs Eggs to Order Pancakes Sausage, Bacon Fresh Baked Biscuits Hot and Cold Cereals Breakfast Breads Whole Fruit Yogurt LUNCH Cold Foods Pre-packaged Salads Yogurt, Fresh Fruits Pre-packaged Sandwiches Assorted Cakes, Pies, Cookies, Puddings Hot Foods Soups (1 daily) Meat, Fish, or Poultry Entrees (2 daily) Grilled Foods: Hamburgers, French Fries Potato/Starch (1 to 2 daily) Vegetables (1 to 2 daily) Beverages Regular and Decaffeinated Coffee, Tea, Iced Tea Juice Drinks, Soft Drinks, Bottled Beverages, Milk Patrons consult the menu board, enter the servery, pick up trays or take-out containers, and proceed to collect food items from the stations in the servery. Patrons tender payment at the cashiers' station and exit the servery, where they pick up flatware, napkins, and select desired condiments. Patrons currently dispose of their trash in refuse containers, deposit their reusable glassware, flatware and plates in the wash tubs and deposit their trays at the tray drop window, which will continue to be the standard procedure in this contract. Food service employees circulate within the dining room to maintain its cleanliness and orderliness. Method of Payment The method of payment in the cafeterias is cash and payroll deduction. Over 75% of the sales in the cafeterias are by employees using the payroll deduction system. Credit Card payment is an option that can be evaluated, however, will require addition software/hardware and service costs. Software/hardware will be furnished by B&W Pantex upon determination of need; however, all service fees to a credit card provider will be incurred by the Contractor and not B&W Pantex. Policies of B&W Pantex that Affect Food Service Employees are permitted 30 minutes for lunch from the time they leave their work area until they return. Most Pantex employees walk to the nearest cafeteria for lunch, or bring their lunch from home. It is essential that the cafeteria provide prompt and efficient service due to this time constraint. Government/company vehicles are not to be used for going to lunch. There is no free coffee service to employees. Coffee is available at the cafeterias. Individual departments may or may not have their own coffee machines. Food at desks is permitted; however, there are several work areas that prohibit food and beverages. 1.4 APPLICABLE DOCUMENTS Division 1 Specifications: Revised according to SOW Scope of Work - Section 01010 Quality - Section 01400 Safety and Health - Section 01500 Security - Section 01700 1.5 GOVERNMENT FURNISHED EQUIPMENT See complete list in Exhibit 2. The Contractor shall be responsible for the replacement of equipment when it is found that the contractor damaged the equipment outside of normal wear or through an accidental or deliberate act. The contractor shall be responsible for repair/replacement due to damage caused by abuse in regard to, but not limited to the act of dropping, throwing, kicking, blunt impact...etc, as determined through evaluation/investigation. The Contractor shall be responsible for furnishing all vending equipment to include, but not limited to drink vending machines and snack/food machines. The Contractor is allowed to open an agreement for vending equipment and service through a third party supplier with the Contractor absorbing any and all costs for the machines... 1.6 GOVERNMENT FURNISHED PROPERTY Facilities - Two Cafeterias and Vending Storage Vehicles - Two delivery vehicles to include fuel and required maintenance, which will require each vehicle to be removed from service on occasion for preventative and repair maintenance. Electric Cart for vending operations 1.7 REQUESTS FOR INFORMATION A. The Contractor shall submit "Request for Information" through e-mail or letter to the Contract Administrator to request clarification or additional information concerning any B&W documents, including but not limited to any instance where work cannot be performed as described in the specifications. B. The Contractor should allow 7 calendar days for B&W to respond to an RFI. 1.8 GENERAL REQUIREMENTS A. COMMUNICATION All communication/correspondence between the Contractor and B&W Pantex shall be verbal followed-up by a written notification or by written notification only. B. CAFETERIA MANAGEMENT 1 The Contractor shall provide all necessary management, administration, operational personnel and logistical efforts to accomplish the requirements identified herein and ensure compliance with the contract, incidental parts, labor, supplies, equipment, and materials necessary to provide a complete and functional system that performs as specified. 2 The Contractor shall furnish Management Personnel with current certification through Serv Safe or an equivalent and be approved by B&W Pantex. 3 The Contractor will provide food service at Building 12-70 and Building 12-103 cafeterias Monday through Friday 4 The Contractor Manager and Assistant Manager will be furnished a pager by B&W Pantex. The pager shall be worn on the individuals person at all times while on the Pantex site. The pager is expected to be worn while off-site as well. 1.9 WORK SCHEDULE A. The Contractor shall serve a minimum of two meals per day (breakfast and lunch) in accordance with the normal work schedule. Food service is not normally provided during the following holidays observed by B&W Pantex or during Plant closings associated with holidays: • New Year's Day • Good Friday • Columbus Day • Memorial Day • Independence Day • Labor Day • Thanksgiving Day • Day After Thanksgiving • Christmas Day • Floating Holiday - Varies from year to year B. Hours of Operation - The cafeterias shall be open Monday through Friday under the following schedule: Operating Hours 12-70 CAFETERIA 12-103 CAFETERIA Breakfast 6:00 AM to 8:00 AM 6:15 AM to 8:00 AM Lunch 11:00 AM to 1:00 PM 11:00 AM to 12:30 PM 1.10 CATERING, REFRESHMENTS AND SPECIAL EVENTS. B&W Pantex and other on-site organizations host special events, meetings, award luncheons, receptions, etc., that require catering service. Such service varies from refreshments to complete breakfasts, and luncheons. The Contractor shall distribute a catering menu and provide catering service upon request by the host. Catering, refreshments, and special events may include the following: 1 Refreshments: Canned/bottled soft drinks, coffee, tea, punch, pastries, fruit trays, etc. These may be delivered by the Contractor or picked up by the host. 2 Working Meals: Sandwich or salad plates, boxed or sacked meals. These may be delivered by the Contractor or picked up by the host. 3 Receptions: These are set up, staffed, and served by the Contractor. The Contractor shall also clean the area after the event. 4 Catered Meals: Breakfast or lunch. 5 Special Events and Emergency Meals: Food service, on short notice, for special events and emergency situations as required. NOTE: Catering events will normally occur during normal working hours. These catering events will always occur on plant property. Catering may or may not require the Contractor to provide servers (e.g., waiters or waitresses). The Contractor shall not charge or accept gratuities for any catered event. 1.11 VENDING SERVICES A. The Contractor shall assume responsibility for all vending services at the Pantex Plant. B. The Contractor shall assume the responsibilities for vendor-owned equipment and will be responsible for maintaining the machines to include preventative and repair maintenance. Maintenance activities, which require site access of external vendor employees to the Pantex plant, shall be coordinated through the Subcontract Technical Representative (STR) at least 24 hours prior to the scheduled date/time of the vendor employee visit. C. The Contractor shall replace machines obsolete or no longer repairable. D. The Contractor shall make or have made all repairs to vending machines in ten (10) working days from notification/identification of a machine not operating properly. If repair is not possible within ten (10) working days, the Contractor shall communicate all issues to the STR and Contract Administrator and an agreement made upon a variance to this item. E. The Contractor shall arrange for Vendor owned machines to be moved within the Plant by the owner where possible. F. The Contractor shall notify the STR regarding machines needing to be moved within the Pantex Site for Craft assistance and/or Vendor access approval. G. The Contractor shall make notification to Vendors for the removal of machines from the Pantex site deemed no longer needed by the Contractor. H. The Contractor shall make arrangement/agreement with Vendors to maintain a supply of commonly failed machine components...IE, changers, bill validators...etc, for Vendor owned machines as approved by B&W Pantex. I. The Contractor shall maintain a supply of commonly failed machine components...IE, changers, bill validators, activity sensors (Eagle Eye) electronic components, motors...etc, for Contractor/Vendor owned machines as approved by B&W Pantex. J. The Contractor shall develop a stocking and tracking system approved by B&W Pantex to distinguish between failed and repaired components for Vendor and Contractor owned machines. K. The Contractor shall assure that all vending machines are unplugged from their electrical power outlet prior to exposing internal and/or external electrical components. L. The Contractor shall assure that all vending machines are plugged into a Ground Fault Circuit Interrupting (GFCI) device. Devices shall be furnished and installed on machines by the Vendor or furnished by B&W Pantex and installed by Contractor. M. The Contractor shall develop a specific process for making refunds to customers having lost money in vending machines acceptable to B&W Pantex. 1.12 APPLICABLE CODES, STANDARDS, LAWS (FEDERAL, STATE & LOCAL) The Contractor shall abide by all Federal, State and B&W Pantex requirements. If two or more applicable codes, standards, laws, regulations, B&W-supplied drawings, or B&W-supplied specifications establish differing requirements, the Contractor shall comply with the most stringent requirement. 1.13 MENU REQUIREMENTS A. The Contractor shall furnish high-quality, wholesome, nutritious, and palatable and tastefully prepared food and beverages to the patrons of the cafeteria (including employees, contractors, and visitors) and shall maintain a standard of service, quality and value equal to that in comparable facilities in the area which charge comparable prices. The Contractor shall offer a variety of foods so that well-balanced meals can be selected. The Contractor should observe the following parameters in regard to the menus developed: 1 Develop innovative menus which emphasize variety, nutrition, and quality, and take advantage of fresh foods and seasonal foods whenever possible; 2 Utilize creative food displays and merchandising techniques to ensure customer satisfaction; 3 Provide a health awareness program that includes and identifies foods that are low in calories, sodium, carbohydrates and saturated fats; and 4 Be responsive to changing meal trends, special requests by B&W Pantex staff and visitors, and patron prefer¬ences. B. The Contractor shall post daily menus and prices before the breakfast meal on the menu boards provided by B&W Pantex at the entrance to each servery. Descriptions of daily specials are to be merchandised at the in¬dividual servery stations by use of point-of-sale signs, small posters, or other attractive signs that are not flashy. Any such signs shall be removed at request of B&W Pantex. Additionally, the Contractor shall submit an electronic copy of the menu to be posted on the Intranet (Web Master) and Pulse every day/week. C. The Contractor shall obtain B&W Pantex approval on any and all changes to pricing, serving schedules, service offerings and menus. 4.1 CONTRACTOR-FURNISHED MATERIAL, SERVICES, AND PERSONNEL A. Contractor Responsibilities The Contractor shall be responsible for collecting all revenue and be accountable for all costs to operate and administer the food service operation. B. Contractor Supervision The Contractor shall provide a qualified/certified Manager/Supervisor or qualified/certified replacement acceptable to B&W Pantex, in the two cafeterias during all operating hours. Supervisory personnel should not normally perform storeroom, food preparation, attendant, or cashier duties, but be visible in the serving areas during meal periods, monitoring performance and taking corrective action, as needed. In addition, the Contractor shall provide a manager or supervisor to be on duty during catered events where catering personnel are required to be on site. Additional management staff such as an assistant manager(s) may be provided, as the Contractor deems necessary. C. Uniforms The Contractor shall provide standard uniforms to employees. Employees shall be neatly groomed and wear neat and clean uniforms when performing their work assignments at the facility. The term "uniform" is interpreted to include all apparel, visible badges, disposable gloves, hats, hairnets, etc. The Contractor must submit, at least thirty (30) days prior to start-up, samples of uniforms and other apparel of all service personnel for approval by B&W Pantex. D. Contractor Personnel NOTE: This SOW contains the terms PART TIME and FULL TIME personnel when referring to those individuals employed by the Contractor. At no time, should the Contractor or its employees confuse these terms as being associated with being employed by B&W Pantex. Within this SOW the term PART TIME may refer to, but not limited to an employee hired through a Temporary Employment Agency or a Non-Full Time employee employed by the Contractor and not considered as Full Time according to the Contractor's definition. A FULL TIME employee may refer to, but not limited to an Employee hired by the Contractor and works as a Full Time employee of the Contractor according to the Contractor's definition. No reference in this SOW implies that a PART or FULL TIME Employee is employed by B&W Pantex, but is employed by the Contractor 1 The Contractor shall provide trained personnel, satisfactory to B&W Pantex, in adequate numbers to provide the services required. The Contractor shall recruit, train, supervise, direct, discipline, and if necessary, discharge any and all personnel working under this contract. 2 The Contractor shall have employees available on call in cases of emergencies. A trained relief staff shall be available to substitute for the Contractor's regular personnel during their absence. 3 The various classes of service employees who will be employed in the performance of this contract must be paid at least the minimum monetary wage and shall be furnished fringe benefits under the provisions of the McNamara-O'Hara Service Contract Act. 4 The Contractor shall require all its employees to (i) utilize a designated entrance and exit door to the food service facilities and (ii) park motor vehicles in areas designated by B&W Pantex. The Contractor shall restrict its employees to assigned work areas only, and to be on the premises only during working hours, unless B&W Pantex designates otherwise. 5 All employees shall be citizens of the United States and shall be able to read, write, understand, and speak English. The minimum age for employees is 18 years of age. E. Contractor Personnel Training NOTE: Initial access badges will be authorized for a maximum of thirty (30) calendar days. Pantex site access will not be extended without the completion of 4.1,D,1 above and other requirements referenced in this SOW. The Contractor shall assure that all part and full time personnel attend and satisfactorily complete all required B&W Pantex training. 1 General Employee Radiation Training (GERT) shall be completed within ten (10) business days from first day on the Pantex site. 2 Initial General Employee Training (GET) shall be completed within ninety (90) days from first day on the Pantex site. 3 Both In-class and Computer Based Training (CBT) shall be completed during the contractor personnel birth month to maintain site access and qualifications. 4 The Contractor shall present the B&W Pantex supplied Serv Safe video series to each of his/her personnel within ninety (90) calendar days from their first day on the Pantex site. B&W Pantex may require that each employee complete a verbal or written examination following each of the video series sections or a combined series final examination. F. Contractor Personnel Employment Back-Ground Check and Security Clearance Documentation 1 The Contractor shall assure that all part and full time personnel obtain a Sub-Contractor Pre-Screen Packet from the Pantex Employment Office within five (5) business days from the first day on the Pantex site. 2 The Contractor shall assure that all part and full time personnel return their completed Sub-Contractor Pre-Screen Packet to the Pantex Employment Office within ten (10) business days from receiving the Pre-Screen Packet. NOTE: Initial access badges will be authorized for a maximum of thirty (30) calendar days. Pantex site access will not be extended without the completion of 4.1.F.1 and 4.1.F.2 above and other requirements referenced in this SOW.. 3 For access beyond the initial thirty (30) days, B&W Pantex will conduct Sub-Contractor Pre-Screens on all prospective employees of the Contractor. Continued access shall be contingent on results of the pre-screen. 4 DOE "Q" level security clearances will be required for the cafeteria manager, assistant manager and personnel assigned to vending services. 5 DOE "L" level security clearances will be required for all other personnel. NOTE: Continued site access and possibly employment will be contingent on results of the pre-screen. 6 The Contractor shall assure that temporary employment agencies providing temporary personnel to the Pantex Food Service Contractor, evaluate prospective temporary food service employees. Prospective employees should be evaluated for negative reports in the following areas: Criminal, References, Education and Credit, through pre-job interview and pre-employment background checks. 5.1 PURCHASING A. The Contractor shall purchase all food, beverages, and cleaning supplies for all food service facilities described herein. The Contractor should take advantage of all available trade, cash, and quantity discounts to be able to maintain the lowest possible prices in the food service operations. B. The Contractor shall select suppliers on a competitive basis to the maximum practicable extent consistent with the objectives of the contract. Food or supplies may be obtained from a facility operated by the Contractor or a parent corporation provided that such food and supplies comply with the requirements of this contract. C. The Contractor shall comply with the following minimum purchase specifications: All meats, meat products, poultry, poultry products, and fish must be Government inspected. Beef, lamb, and veal shall be USDA Grade Choice or better. Pork shall be U.S. No. 1 and Poultry shall be U.S. Government Grade A. Fresh fish and seafood shall be top grade; frozen fish and seafood shall be a nationally distributed brand, packed under continuous inspection of the USDA. Dairy products: • Eggs fresh USDA or state graded "A" • Butter USDA Grade "A" (92) score • Cheese USDA Grade "A" for all graded cheese • Milk and milk products USDA Grade "A" Fresh fruits and vegetables USDA fancy to USDA Number "1" shall be used for all graded fresh vegetables and fruit as a minimum specification. Dry stored items and canned goods shall be Grade "A" fancy. Frozen fruits and vegetables shall be USDA Grade "A". 5.2 MANAGEMENT MEETINGS A. Monthly Management Review The Contractor shall schedule a monthly management review with the B&W Pantex Subcontract Technical Representative (STR) and Contract Administrator to be conducted at the Pantex Plant. The review shall be conducted and scheduled by the Contractor, but no later than the fifteenth (15th) business day of each month. The Contractor shall provide the following for the meeting: 1 Written agenda; 2 Copies of appropriate financial and operating reports, including but not limited to the following: • Updated annual and monthly budgets reflecting performance to date for operations, cash flow, capital expenditures, and management reserves; • Monthly financial operating results, including income statements and balance sheets with month-to-date and cumulative figures; • Monthly financial operating results for vending broken down identifying total sales, total sales by machine and waste and loss by machine, • Copies of service orders; • Proposed capital expenditures; • Proposed changes in key personnel; and • Other matters as requested by B&W Pantex. 3 The Contractor shall prepare written minutes of each monthly management review and submit them to the B&W Pantex STR within five (5) business days of the meeting. 3.1 OPERATING SUPPLIES A. B&W Pantex will provide the Contractor with an initial complement of small wares, china, glassware, and flatware. The Contractor agrees to purchase all necessary replacement small wares, china, glassware, and flatware to maintain a mutually agreed upon inventory level. Title to all such small wares, china, glassware, and flatware shall rest solely in B&W Pantex. B. The Contractor shall perform an annual inventory of all small wares, including the above, in a format approved by B&W Pantex. On the anniversary dates of this contract and the termination date of this contract, a joint inventory of all equipment and small wares shall be taken. Upon completion of each annual inventory, Contractor shall replenish all shortfalls, subject to review and approval by B&W Pantex will reimburse the Contractor for supplies...IE, paper goods, ONLY when the use of those supplies are solely required due to the failure of B&W Pantex owned equipment forcing the use of those supplies and at the discretion and verbal/written agreement of the STR and CA. C. B&W Pantex will reimburse the Contractor for supplies...IE, spoiled foods, frozen & refrigerated lost due to the failure of B&W Pantex equipment ONLY after evaluation to determine actual cause of spoilage and/or equipment failure. D. B&W Pantex will supply temporary equipment...IE, refrigerated trailer, steam generating boiler equipment, etc as a back-up for failed equipment or scheduled utilities outages impacting equipment. When B&W Pantex furnishes a refrigeration unit for temporary storage, B&W Pantex will not be responsible for loss of supplies due to failure of the temporary refrigeration unit or the placement of supplies in the unit by the Contractor. E. B&W Pantex will reimburse the Contractor for supplies used by B&W Pantex employees during periods of inclement weather causing closure of the Pantex site. B&W Pantex will furnish a list of supplies used to the Contractor following such incidents. 3.2 MAINTENANCE SERVICES MITIGATION ACTIONS A. The Contractor shall, upon observation/identification of an equipment or facility discrepancy, immediately notify the STR by phone and send a follow-up email notification regarding all identified discrepancies. B. The Contractor shall follow B&W Pantex protocol if the identification of an equipment or facility discrepancy can be immediately mitigated and shall take action to mitigate the discrepancy. C. The Contractor shall notify the B&W Pantex STR immediately in writing of any accident or safety hazard. Contractor shall also notify B&W Pantex in writing of whatever action the Contractor has taken to remedy any safety hazard. The Contractor and its employees, agents, or subcontractors agree to comply with and practice all state and county safety standards and regulations. The Contractor shall take all necessary and proper precautions to protect the safety of employees and other persons and to protect all property from any damages from whatever cause. D. The Contractor shall immediately stop the use of any and all equipment found with discrepancies that could cause damage to personnel, facilities or the environment and turn off, unplug or by other means assure that the equipment is in a de-energized state and labeled identifying "DO NOT USE" and immediately notify the STR. E. The Contractor shall perform daily inspection of cafeteria associated equipment to assure proper operation of each component and take action as necessary, F. The Contractor shall not make repairs to equipment or facilities. G. The Contractor shall notify a maintenance vendor in a timely manner regarding Vendor owned and operated equipment, dependent on the urgency of the repairs and shall coordinate such actions through the assistance of the assigned STR. 3.3 JANITORIAL/CLEANING SERVICES A. On a daily basis, the Contractor shall perform and be responsible for the washing and cleaning of, but not limited to, dishes, glass wares, plastic wares, tableware, trays, microwaves and all kitchen and services associated equipment and for the washing, cleaning, and arranging of tables and chairs in dining areas. Tables and chairs are to be placed in their normal location/position per B&W layout drawing. NOTE: When using electrical cord powered cleaning appliances, the Contractor should assure that any and all equipment unplugged during the cleaning process be plugged back in immediately upon the completion of the cleaning. Appliance for example - Vacuum cleaner B. On a daily basis the Contractor shall clean and sanitize the two restrooms located adjacent to the kitchen and used by the Contractor. The Contractor shall assure that all surfaces are cleaned and sanitized to include, but not limited to lavatory, urinals, toilets, walls, mirrors, wall panels, floor,...etc. C. On a daily basis the Contractor shall perform janitorial services to include, but not limited to the kitchen, cafeteria serving areas, kitchen and administrative offices. These services shall include but not limited to all carpeted areas, all tile area in the dining room, serving area and kitchen and storage areas. This action shall also include wiping down all door and surfaces as required by State of Texas requirements. The food service vehicle shall be cleaned daily. D. On a weekly basis, the Contractor shall perform tasks not accomplished on a daily basis to include but not limited to cleaning the surfaces on all kitchen/dining room associated doors, walls, equipment surfaces. All stainless steel surfaces shall be polished weekly or more frequently if necessary. E. On a monthly basis or more frequently if necessary, the Contractor shall perform the cleaning of all dining room window glass and ledges and door glass and frames. F. On a three (3) month basis, the Contractor shall clean the kitchen exhaust system's primary vents by running through the dishwasher or by using a pressure washer and capturing all waste grease in a kitchen floor drain. 3.4 MISCELLANIOUS SERVICES A. The Contractor shall abide by all applicable rules and requirements of B&W Pantex to assure the necessary actions are taken regarding the proper disposal of kitchen and dining room wastes. B. The Contractor shall deposit all waste cooking oil into B&W Pantex supplied controlled sanitary containers and assure that all outdoor collection containers are recovered and secured as necessary after each use. Cooking oil/grease shall not be poured directly or indirectly into, but not limited to, lavatories, sinks, floor drains...etc. C. The Contractor shall patrol and pick-up/clean-up all areas within ten (10) linear feet of the cafeteria buildings of waste, trash and debris created by the food service process, to include but not limited, cardboard, cups, trash,...etc. The Contractor shall assure all cardboard has been properly broken down and placed in a recycle container to be picked up by B&W Pantex. D. The Contractor shall furnish and safely store all cleaning supplies in appropriate containers. E. The Contractor shall maintain Material Safety Data Sheets on all cleaning chemicals. 3.5 WASTE MANAGEMENT The Contractor shall abide by all applicable rules and requirements of B&W Pantex to assure the necessary actions are taken regarding the disposal of kitchen and dining room wastes and empty containers. 3.6 ENERGY CONVERSATION The Contractor shall make every effort to conserve energy in all daily activity to include, but not limited to, turning off the dishwasher conveyor when not being used, running the garbage disposer only when needed, turning off lights when not needed, using water sparingly by not leaving water running constantly to rinse an item or to thaw a product. 3.7 RESPONSIBILITIES OF EACH PARTY A recap of the major responsibilities of each party is provided below. The Contractor shall, at all times, conduct its operations and maintain the Pantex Plant food¬ service facilities in a clean and sanitary manner in accordance with best practices and the highest industry standards, and shall comply with all federal, State of Texas, and municipal laws, codes, and regulations with respect to the cleanliness of the food preparation and service areas and the food service preparation equipment. The Contractor shall train all employees to follow a "clean as you go" policy. The food service facilities are sub¬ject to inspection by B&W Pantex or State of Texas authorized health department officials, fire department, and other agencies. B. Contractor shall, at its cost and expense, apply for, secure and maintain all permits and licenses applicable for the operation of the food service under this Contract. Contractor shall obtain B&W Pantex's prior written approval with respect to Contractor's application for any such permits and licenses. The parties shall cooperate with each other in such permit applications. C. The Contractor shall immediately notify B&W Pantex, in writing, of any notices of violations that are received during or in connection with inspections. A copy of any such report received by the Contractor shall be immediately sent to the B&W Pantex Technical Representative. The Contractor shall include action plans to correct conditions causing the violations. B&W Pantex shall have the option to be present at all inspections and shall be given prior notice thereof whenever possible. In the event the Contractor does not take immediate action fully satisfactory to B&W Pantex to cure all conditions causing said violations or potential violations, B&W Pantex retains the right to take all acts and actions which B&W Pantex believes to be reasonably necessary to promptly correct all conditions which caused said violations or potential violations with the Contractor absorbing all costs. D. The Contractor and any subcontractors shall give access to the authorized representatives of the Secretary of Labor for the purpose of inspecting or carrying out any of the Secre-tary's duties under the Occupational Safety and Health Act of 1980, as amended. The Contractor shall be responsible for any violation of it or any regulation issued hereunder and shall immediately remedy any conditions giving rise to such a violation. The Contractor shall give B&W Pantex prompt written notice of any such violation. E. The Contractor shall adhere to the following standards in the preparation, production, and service areas in addition to those set forth herein and on the attachments hereto. 1 Perform regular, daily and thorough cleaning of all kitchen and servery area walls, equipment, floors, and spot cleaning of dining area floors, on a continuous basis and following each meal period. Contractor will provide for the daily vacuuming and/or cleaning of dining room floors. 2 Keep public areas free of hazardous conditions. 3 Adhere to industry accepted sanitation regulations for recommended ware¬ washing temperatures and the use of chemical sanitizers. 4 Monitor the dining areas before and during service hours to maintain dining rooms in a clean and orderly fashion. All tables and chairs are to be aligned and cleaned at the completion of each meal period. Contractor shall continuously bus any remaining dishes, trays, and trash during operating hours. 5 Store all cleaning supplies in non food areas. 6 Store all chemicals in proper storage containers. Annually PART 2 PERORMANCE - SECTION 1200 3.9 SITE ACCESS Access to the site is typically available (Monday- Friday) (6:45am-5:30 pm for day shift) (4:00pm-12:30am for swing shift). Requests for access outside of normal working hours or during holidays will be evaluated based on benefit to Pantex. It is anticipated that the Cafeteria operational hours will be from 5:00am - 3:00pm, Monday through Friday. 3.10 WORK RELEASE Contractor shall not commence any operations, until receiving notification of contract award. 3.11 MANAGEMENT PLAN A. The Contractor shall develop, submit for approval, and implement a Management Plan (CMP). The CMP shall include the following: 1 Resumes of Key Personnel meeting the following requirements 2 Supervisor / Safety Representative 3 The Manager/Safety Representative shall have at least 3 years of experience supervising work of similar size and complexity and have at least 3 years experience as a Competent Person of similar operations. 4 The names and telephone numbers of the Contractor's points of contact including emergency and after-hour contacts. 5 Daily checks shall be performed to assure control activities are providing continued compliance with contract requirements, until completion of the particular feature of work. Final follow-up checks shall be conducted and all deficiencies corrected prior to closure of the contract. 3.12 COORDINATION A. The Contractor shall coordinate with the Subcontract Technical Representative (STR). B. Deliveries to Pantex Plant If materials or supplies are being delivered to the Contractor by a third party, the Contractor shall ensure the third party has the delivery invoice including the Contractor's name and the location of delivery or storage area. The Contractor shall notify the STR of planned deliveries by 2:00 PM a day in advance. The Contractor is responsible for offloading and accepting Contractor deliveries. Form PX-4837, Transfer of Material or Equipment will be used to document the exchange of equipment and material between B&W and the Contractor. The form must reflect the names of the B&W and Contractor Representatives issuing and receiving the equipment or material, the date of exchange and acknowledgment the equipment or material has been received in satisfactory condition. 3.13 PRE-AWARD MEETINGS The Contractor shall attend a Pre-Award Meeting prior to the start of work. PART 3 QUALITY ASSURANCE - SECTION 1400 3.14 QUALITY REQUIREMENTS - Per DOE O 414.1C A. The Contractor shall perform work as stipulated by the contract documents...with Safety and Quality in mind. B. To accomplish the tasks within this contract, the Contractor shall observe the following: 1 Employee trained and qualified personnel capable of performing the assigned work 2 Establish and implement processes to detect and prevent quality problems 3 Identify, control, and correct items, services, and processes that do not meet established requirements 4 Identify the causes of the problems, and include prevention of recurrence as a part of corrective action planning 5 Perform work consistent with technical standards, administrative controls, and hazard controls adopted to meet regulatory or contract requirements using approved instructions, procedures, etc. 6 Maintain items to prevent their damage, loss, or deterioration 7 Identify and control items to ensure their proper use 8 Specify, prepare, review, approve, and maintain operational and financial records 9 Inspect and test specified items, services, and processes using established acceptance and performance criteria PART 4 SAFETY AND HEALTH - SECTION 1500 3.15 GENERAL A. The Contractor shall establish a Worker Safety and Health Program in compliance with 29 CFR 1910. The Contractor's Worker Safety and Health Program must reduce or prevent occupational injuries, illnesses and accidental losses. B. The Contractor shall take all reasonable precautions in the performance of the work under this contract to protect the safety and health of employees and members of the public; to minimize danger of hazards to life and property; and to comply with specified safety and health regulations and requirements. C. If an operation has an unmitigated and/or unanalyzed potential to injure personnel or damage property, employees of the Contractor or subcontractor(s) shall stop work immediately and shall not allow work to resume until the situation has been corrected. D. It is the Contractor's responsibility to comply with specified regulations or requirements during the course of this Contract. E. Security 3934/3922 Medical (Physician) 3033 3.16 SAFETY AND HEALTH PROGRAM The Contractor's Safety and Health Program shall include the following elements which are to be developed using a graded approach. A. Activity Hazard Analyses B. Definition of processes for establishing and utilizing competent and qualified persons C. Hazard Communication Program 3.17 ACTIVITY HAZARD ANALYSES (AHA) A. The Contractor shall prepare an AHA "Contractor Activity Hazard Analysis/Safe Work Permit", (PX-4798) to address each definable feature of work and the associated hazards and mitigations. An AHA may be developed for each definable feature, or several features may be incorporated into a single AHA. B. Activity Hazard Analyses (AHA) will define the work activities to be executed, identify the equipment that will be needed to perform the activities, identify the associated hazards that could adversely affect health, safety, or environment: and define specific actions to eliminate or minimize the risks involved. The AHA shall address permit requirements, training requirements, engineering and administrative controls, and PPE requirements. C. The AHA is a living document throughout the duration of the Contract. The AHA will identify specific safety and health requirements for identified tasks. The AHA must be modified by the Contractor and approved by B&W Pantex should additional activities need to be performed or if additional equipment is required or if emergent hazards are identified. D. The Contractor shall require workers to acknowledge being informed of the hazards and protective measures associated with assigned work activities addressed in the AHA. E. Upon final approval by B&W, the "Contractor Activity Hazard Analysis/Safety Work Permit" will be returned to the Contractor. The approved AHA will allow the Contractor to commence operations for which an AHA has been approved. No activities will commence that are not identified in the AHA. 3.18 COMPETENT AND QUALIFIED PERSONS A. Qualifications of competent and of qualified persons NOTE: Per definition, the competent person shall have knowledge to conduct site inspections, identify safety deficiencies, initiate corrective actions, and enforce safety and health requirements for Contractor and tier contractor personnel. As a minimum, competent persons shall be designated for the work as specified in this SOW. B. The competent person/designee shall have at least 1 year experience and knowledge in regard to proper cafeteria operations. C. The names of competent and qualified persons shall be provided to B&W prior to execution of the activity they are designated for. D. In the event that the primary competent person is absent the Contractor shall provide the names and qualifications of the alternate competent person(s). 3.19 CONTRACTOR'S HAZARD COMMUNICATION PROGRAM A. The Contractor shall maintain a current copy of the Material Safety Data Sheet (MSDS) for all chemicals associated with the Contract. B. The Contractor shall coordinate the use of any hazardous chemicals with the B&W Safety Group and STR. C. The Contractor shall maintain exposure levels below established OSHA Permissible Exposure Levels (PEL) or American Conference of Governmental Industrial Hygienist Threshold Limit Value (TLV) in areas where NNSA, DOE, B&W Pantex, or contractor personnel may be present. The lower exposure level will be enforced. D. If personnel in occupied areas adjacent to the site could be exposed to hazardous chemicals, the Contractor shall request that B&W Pantex Plant relocate those employees. E. The Contractor shall not proceed with any operation that could expose their own employees or B&W personnel to hazardous chemicals without controls in place. Controls shall be approved by the Subcontractor Safety Group and the STR. F. The Hazard Communication Program for the Contractor and all subcontractors shall be maintained on the work site and shall be available upon request by B&W Pantex Plant personnel, Contractor and subcontractor employees, employee representatives and other personnel with a need to know. 3.20 INTEGRATED SAFETY MANAGEMENT A. ISM shall be utilized to establish and maintain a systematic approach to effectively incorporate safety and health requirements into all work performed. Protection of the public, the worker, and the environment shall be integrated into the Contract. Safety management activities shall include five core functions: Define Scope of Work Analyze Hazards Develop and Implement Hazard Controls Perform Work within Controls Provide Feedback and Continuous Improvement B. The Contractor shall incorporate these five core safety management functions during the course of this Contract. The Define, Analyze, Develop and Implement functions shall be addressed during the development of the AHA. Hazards Controls will be confirmed when the AHA is submitted by the Contractor and approved by B&W Pantex. The Performance functions shall be implemented once work commences. The Feedback and Continuous Improvement function will be implemented when unforeseen circumstances arise that could inhibit the Contractor's ability to perform a particular task. The Feedback and Continuous Improvement function may require a revision to the Contractor's Safety and Health Plan and/or to the Contractor's AHA. C. Under the ISM process, the Contractor will tailor the controls to the complexity of work and associated hazards. 3.21 COMMUNICATION OF SITE SAFETY REQUIREMENTS NOTE: When more than one Contractor employee is on site working under this contract the following Communication of Site Safety Requirements shall be required. A. The Contractor shall conduct a safety meeting weekly with all employees. B. The meeting is intended to be part of (and an enhancement to) the Contractor's normal work assignment process. C. The Competent Person normally leads the "safety meeting". D. Each "safety meeting" will be documented by recording the meeting topic and an attendance roster will be provided to the STR upon request. 3.22 PERSONAL PROTECTIVE EQUIPMENT (PPE) A. Foot protection is mandatory for all Contractor personnel working at the Pantex site where required. Foot protection shall meet the requirements as specified in ANSI Z41-1991. B. Slip resistant foot wear will be required for all Contractor personnel working at the Pantex site where wet surfaces are common. The Contractor shall assure that all personnel in the 12-70 and 12-103 cafeterias wear the appropriate foot wear. C. Eye protection is mandatory for all Contractor personnel working at the Pantex site where required. Eye protection must meet the requirements as specified in ANSI Z87-.1-1989. Additional eye/face protection may be required based upon the operations to be performed. The Contractor shall base all eye/face protection requirements on the provisions outlined in 29 CFR 1926.102. D. Contractor employees shall wear appropriate hearing protection based upon hearing protection requirements identified in 29 CFR 1910. E. Contractor employees shall wear hand protection while performing operations that could cause hazards to the hands from skin absorption of harmful substances, severe cuts or laceration, severe abrasions, punctures, chemical burns, thermal burns and harmful temperature extremes, or electrical shocks. The Contractor shall be responsible for evaluating the activities to be performed and shall specify the type of hand protection that will be used. F. Head protection shall be worn by all Contractor personnel dependent on job site need. Head protection must meet the requirements as specified in ANSI Z89.1-1-1969. "Cowboy Hardhats", metal hardhats, and bump hats are not permitted for use at the Pantex site. G. Respiratory protection shall be required if employees could be exposed to hazardous chemicals or substances that exceed allowable threshold limit values (ACGIH) or permissible exposure limits (OSHA). The most stringent ACGIH or OSHA shall be enforced while selecting respiratory protection. H. If respiratory protection is required, the Contractor shall submit a respiratory protection plan that complies with the provisions specified in 29 CFR 1910.134. In addition, any employee required to wear respiratory protection shall have a current annual physical or medical questionnaire, the respiratory protection to be used, documentation of a fit test, and documented evidence of respiratory protection training. All information shall be submitted to and approved by the B&W Pantex Subcontractor Safety Group and STR prior to performing an operation requiring respiratory protection. I. The Contractor shall include any operations requiring respiratory protection on the Contractor's AHA. The AHA shall address barricading requirements, ventilation requirements, and precautions required to prevent exposure to other site personnel. J. It will be the responsibility of the Contractor to assure that personnel are physically capable of wearing personal protective equipment. Physically capable may include fit tests, physicals and medical questionnaires. The Contractor shall provide documentation as required by the OSHA regulations to assure personnel are physically capable of wearing prescribed personal protective equipment. Actual medical documentation will be maintained by the contractor and may be audited by B&W Pantex. 3.23 SITE SAFETY AND HEALTH INSPECTIONS A. B&W personnel will inspect Contract sites on a periodic basis. Inspections will be based upon the requirements identified in the Division I Specifications, 29 CFR 1910, and 29 CFR 1926. B. All safety deficiencies noted by B&W will be documented and a copy of the documentation will be provided to the Contractor. The Contractor shall correct all deficiencies deemed to be detrimental to the safety and health of site workers. If the deficiencies cannot be corrected during the inspection, the operation involving the deficiencies will be terminated during the inspection. Deficiencies not corrected during the inspection, and not detrimental to the safety and health of site workers, will be placed in a tracking system until the deficiency has been corrected. C. The Contractor shall conduct daily safety and health inspections at the job site and promptly correct all deficiencies. Safety and health inspections performed by the Contractor shall be documented and shall be maintained at the job site. 3.24 SAFETY INCIDENTS A. If a safety incident occurs, the Contractor shall first take action to obtain aid for any injured employee and notify the B&W Pantex STR and if the STR cannot be reached contact the B&W Operations Center at extension 5000 and then preserve the incident scene. The Contractor will preserve the conditions and evidence at the incident scene until the investigation team arrives on site and the investigation is conducted. The Contractor may be required to cease all or some operations until: 1 A joint B&W and Contractor safety investigation has been completed. 2 A critique and Cause Analysis/Mistake Proofing (CA/MP) Meeting is completed. 3 A corrective action plan has been developed and approved. 4 Corrective actions have been implemented. 3.25 OCCURRENCE REPORTS A. The Contractor shall report: Accidents or incidents that result in injury. Accidents or incidents that cause property damage. Near misses that could have resulted in injury or damage to property. Any release of a hazardous substance, regulated pollutant, fuel or oil. Conditions that could result in the degradation of personnel safety. Condition that could result in the degradation of security Any use or suspected use of illegal drugs or alcohol. Any unplanned contact with energized electrical circuits or other energy systems such as air, gas or steam. B. All occurrences shall be reported immediately to the STR and Operations Center 3.26 INJURIES AND MEDICAL EMERGENCIES A. The Contractor shall notify the B&W Pantex Plant Fire Department (477-3333) in the event of a medical emergency. Emergency Medical treatment is required when: An employee loses consciousness or has pain or numbness in any portion of the body. An employee suffers cuts or abrasions that may require suturing by a physician. An employee has a bone that may be fractured or dislocated. An employee suffers second or third degree burns, including electrical, thermal and chemical burns, to any portion of the body. An employee experiences any chest pain, difficulty in breathing or stomach pain. An employee suffers allergic reactions to food products or insect stings. An employee is bitten by a snake. B. The Contractor shall manage injuries and medical emergencies to prevent or reduce further injury to an ill or incapacitated employee until B&W Fire Department personnel arrive. The Contractor is required to maintain a first-aid kit at the job site that complies with the provisions addressed in 29 CFR 1926.50. C. The Contractor shall provide first-aid treatment at the Contract site. If first-aid treatment is rendered at the Contract site, the Contractor shall inform the B&W Pantex STR as to the injury and first-aid treatment. D. Ambulance service and transportation to a medical facility or emergency doctor is available from the B&W Pantex Plant Fire Department. This service is provided at no cost to the Contractor. State Certified Paramedics and Emergency Medical Technicians staff B&W Pantex Plant ambulances. E. Patients requiring medical attention may first be taken to the B&W Pantex Plant Occupational Medical Facility for stabilization prior to transportation to an emergency room or doctor. F. Ambulance service can be obtained by calling 477-3333 or by asking a Pantex employee to summon an ambulance. If the situation is not an emergency, the Contractor shall make arrangement for the injured employee to be transported to an offsite facility. 3.27 OCCUPATIONAL SAFETY OR HEALTH COMPLAINTS Contractor and subcontractor employees may notify B&W if they have an occupational safety or health complaint. B&W will investigate the complaint and will provide feedback to the employee. The employee's name will not be disclosed to the Contractor. 3.28 FLAMMABLE GAS OR FLAMMABLE AND COMBUSTIBLE LIQUID TRANSPORTING NOTE: There is no foreseen need to transport Flammable/Combustible Liquids within the scope of this contract, however, if the need arises adhere to the following requirements. Transportation of Hazard Division 2.1 Flammable Gas or Class 3 Flammable and Combustible Liquid on the Pantex Site, in quantities that are required to be placarded by 49 CFR 172.504 shall be coordinated 48-hours in advance with the B&W Divisional Logistics Coordinator. The Contractor shall provide the amount and/or capacity of the material to be transported, the name of the company transporting the material, the date and time of the delivery, the destination of the delivery, the driver's name (if no badge), the material type, the placarded status, and route. The B&W Divisional Logistics Coordinator will provide the Contractor an authorized time and entrance point for the delivery. B&W Pantex will escort such loads if entering a Limited Area (LA), Protected Area (PA), or Material Access Area (MAA). 3.29 ELECTRICAL A. EXTENSION CORDS All general use extension cords shall be of a 3-wire type rated for hard or extra hard use. (Reference the current edition of the National Electrical Code (NEC) for size and type of hard or extra-hard use extension cords.) The Contractor shall take necessary precautions to protect extension cords from vehicle or foot traffic. Extension cords shall not be suspended with bare wire. Extension cords routed through doorways or windows shall be protected by a rigid sleeve, conduit or similar device secured to prevent the sleeve being dislodged. Extension cords routed through metal structures shall be protected with a non-conductive barrier. Extension cords shall be protected from sharp edges. Extension cords shall be inspected prior to use for frays, cuts, and ground-prongs. All damaged extension cords shall be immediately removed from service. B. PORTABLE ELECTRIC DEVICES All portable electric devices, such as saws, drills, compres¬sors, etc., shall be equipped with 3-prong plugs or shall be double insulated. Electrically powered equipment shall be inspected prior to use. Damaged or defective equipment shall be immediately removed from service All 120 volt, single-phase, 15 and 20 ampere receptacle outlets on sites shall have Type "A" ground fault circuit interrupters (GFCI) for personnel protection. The "Assured Equipment Grounding Conductor Program" is not an acceptable alternative for the use of GFCI protective devices. Contractors utilizing permanent plant receptacles for power shall not rely on a permanently installed GFCI device for protection and must utilize a portable GFCI device. All electric appliances shall be inspected prior to use to assure each component is in good working order. Contractor shall assure all appliances are equipped with 3-prong plugs or shall be double insulated C. ELECTRICAL CLOSE PROXIMITY WORK NOTE There is no foreseen need for the Contractor to perform work within close proximity of energized or de-energized systems or components within the scope of this contract. The Contractor shall immediately contact the STR when the need is identified to work in close proximity to any energized/de-energized component. The Contractor shall allow the STR to make all determinations regarding the necessary actions to be taken regarding energized/de-energized energy producing components and systems. D. LOCKOUT/TAGOUT (LOTO) NOTE There is no foreseen need for the Contractor to perform work within close proximity of energized or de-energized system or component within the scope of this contract. The Contractor shall immediately contact the STR when the need is identified to work in close proximity to any energized/de-energized component. The Contractor shall allow the STR to make all determinations regarding the necessary actions to be taken regarding energized/de-energized energy producing components and systems. Observe the following requirements concerning ALL ENERGY PRODUCING COMPONENTS AND SYSTEMs LO/TO is required for all energy sources. The Contractor is responsible for coordinating LO/TO operations with the STR. B&W Pantex will accomplish the initial isolation of hazardous energy involving contractors. The B&W Lockout/Tagout Program will be the program of record and shall be included in the contractor's safety and health plan. Each Contractor employee receiving protection from a hazardous energy source via a LOTO shall individually install a LOTO at each isolation point. Personnel involved in any lockout/tagout procedure shall be trained in B&W Lockout/Tagout procedures. Contractor personnel are NOT AUTHORIZED to shutdown or start, open or close, energize or de-energize, any utility system (electrical, high pressure fire loop, domestic water, sewer, steam, natural gas, compressed air) for any reason other than that of imminent danger. 3.30 LADDERS If ladders are used on the Contract site, they shall conform to the provision of 29 CFR 1926 Subpart X. 3.31 PENETRATIONS NOTE: The Contractor SHALL NOT make any penetration of any type on the Pantex Site. 3.32 VEHICLES A. All Contractor personnel shall obey posted speed limit signs, stop signs, or applicable traffic signs whether in their personnel vehicle or a contractor-owned vehicle. Drivers shall reduce speeds as necessary for the safe operation of vehicles during inclement weather or poor road conditions. B. All personnel shall wear seat belts while operating or riding in a vehicle on the Pantex site. Seat belts are mandatory on the Pantex site. C. The number of passengers in a vehicle shall not exceed the number the vehicle was designated to transport. D. Riding in the back of a truck is prohibited. E. Getting on or off vehicles while they are in motion is prohibited. F. Vehicles shall stop and yield the right of way when meeting a vehicle displaying flashing lights. Drivers shall not proceed until the vehicle has passed their location. Passing these vehicles is prohibited. G. Equipment or vehicles that may have caused or been a contributing factor in an accident shall not be moved until released by B&W Pantex Plant. Equipment or vehicles may be moved to prevent further injury to an accident victim or to allow access to an accident victim. 3.33 FIRE SAFETY A. Reporting Fires All fires, including fires extinguished by the Contractor, must be reported immediately to the Pantex Plant Fire Department by using one of the following methods: Activating a fire alarm manual pull station, using a telephone to call extension 3333, or requesting Security Police Officers to make notification by radio. All Contractor employees shall be familiar with the nearest location of fire alarm manual pull stations or telephones to prevent delays in reporting a fire. B. Emergency Exits and Means of Egress Emergency exits and passageways in existing or partially occupied new facilities will be kept clear at all times. The Contractor shall maintain a clear path at least 44 inches wide to these exists. No materials or equipment will be stored, stacked or parked in a manner preventing access to an emergency exit or egress route. C. Smoking Areas Smoking is prohibited in all existing buildings and structures except in designated and approved locations. D. Storage of Flammable and Combustible Liquids The Contractor shall use NFPA 30 "Flammable and Combustible Liquid Code" as guidance for handling, storing and dispensing flammable and combustible liquids. Class II combustible liquids having a flash point at or above 100°F and below 140°F will be handled and stored as a flammable liquid. This class includes: diesel fuel, kerosene, some types of parts and equipment cleaners, and various paint thinners. Flammable or Class II Combustible liquids in quantities of 5 gallons or less will be transported and stored in safety containers approved by a nationally recognized testing laboratory. The safety container must be equipped with a spring closing lid and internal spark arrestor. Spring operated lids must function as designed. Spark arrestor screens must be in place and in good condition. Containers must be properly identified and labeled. E. Storage and Handling of Combustible and Flammable Gases Storage and handling of combustible and flammable gases shall be in accordance with NFPA 54, National Fuel Gas Code and NFPA 58, Liquefied Petroleum Gas Code. F. Blocking Exits If the nature of the work requires blocking an exit, the Contractor shall ensure acceptable alternate exits are available and obtain concurrence from the Fire Prevention Officer and the STR. Emergency exits shall be returned to service as soon as possible after completion of work. 3.34 POWDER ACTUATED TOOLS NOTE: The Contractor SHALL NOT use POWDER ACTUATED TOOLS of any type on the Pantex Site. 3.35 INCLEMENT WEATHER A. The Contractor will be informed when lightning warnings are issued at the Pantex Site. When lightning warnings are issued, a representative of the Contractor shall determine if it is necessary to leave the work location until the warnings have been canceled. Termination of work when lightning warnings are issued is not mandatory. Lightning Personnel Safety Conditions will be issued when lightning strikes are detected within a 10-mile radius of the Pantex site. When Lightning Personnel Safety Conditions are issued, the Contractor shall terminate all exterior operations. The Contractor shall direct all site personnel to seek shelter inside company vehicles or buildings. B. When high winds, ice, or other hazardous condition are present, Personnel Safety Conditions will be announced by the B&W Pantex Plant Operations Center. When Personnel Safety Conditions are issued, a representative of the Contractor shall determine if it is necessary to leave the work location until the warnings have been canceled. If conditions become severe, B&W Pantex Plant may direct the Contractors to cease work until Personnel Safety Conditions are canceled. C. If tornado warnings are issued, the Contractor shall seek the best available shelter. If the Contractor is under a Security Escort, the Contractor shall follow the direction of the Security Police Officer (SPO). If the Contractor is not under a Security Escort, and a harden structure is not accessible, the Contractor shall seek shelter in ditches, depressions, or culverts. 3.36 ACCOUNTABILITY AND EMERGENCY PREPAREDNESS At anytime that B&W Pantex announces an accountability drill or alert, the Contractor shall provide a roster to the Logistics Coordinator. The roster shall identify the names of all Contractor employees, including sub-tiers that are present for work at Pantex at the time of the drill or alert. The roster shall be provided no later than 10 minutes after the beginning of the drill or alert. It is also allowable for the Contractor to contact the STR by phone with the necessary information or via computer access if the Contractor has computer access. 3.37 EQUIPMENT AND TOOLS Tools and equipment brought onto the site shall be used only for the purpose for which they are designed. Tools and equipment shall be inspected, and determined (or certified, such as lifting slings) to be adequate for the use intended. Routine inspections shall be conducted by the Contractor to ensure needed repairs and maintenance is completed. Defective or otherwise unsafe equipment shall be immediately removed from the service and segregated or disabled to prevent inadvertent use. PART 5 SECURITY - SECTION 1700 The Contractor will attend a Security briefing prior to starting work on the contract. 3.38 IDENTIFICATION BADGES A. The Contractor is responsible for the control and accountability of all badges requested by and issued to its employees. B. The STR will submit all Access documentation for each employee. C. The Contractor shall present and confirm accuracy of all necessary Access data to the STR. D. Each contractor employee shall present a current valid driver's license or official photo identification for access to the Pantex site. E. An identification badge will be issued. F. Badges shall be worn conspicuously on the upper portion of the body while at Pantex Plant. G. The badge may be removed if the employee is performing an operation that does not allow the badge to be worn safely. H. Visitor badges will be returned to Access Control in building 16-12, prior to leaving the site daily. I. Upon completion or termination of work, employees shall surrender their badge to Access Control. J. Upon request, badges may be held in Access Control until the expiration date if the Contractor expects additional work. K. If a badge is not returned, the Contractor shall notify Access Control and the STR and continue actions to retrieve the badge. 3.39 LOST OR FORGOTTEN BADGES A. If a Contractor employee loses his badge, he will report the loss to his supervisor or foreman. B. The Contractor or Supervisor will notify Access Control Office in Building 16 12. C. The employee shall report to Access Control to obtain a replacement badge. D. Employees shall retrieve forgotten badges. Replacement badges will not be issued for forgotten badges. 3.40 PROHIBITED ARTICLES A. Any article that may jeopardize the safety or security of the Pantex Plant or workforce, or compromise National Security Interests is prohibited. B. It is the Contractor's responsibility to ensure his employees do not bring prohibited articles onto Pantex Plant. C. Prohibited articles include alcoholic beverages and articles capable of causing injury or damage to personnel or property. Articles in this category include, but not limited to: Firearms and ammunition Explosives and explosive devices Knives and bladed instruments with a blade length exceeding five and one-half inches Clubs, blackjacks, nightsticks Bows, crossbows, compound bows and the arrows Other articles as determined by the Security Force D. Security area controlled articles include privately owned articles that are non-threatening and allowed to be brought into the Property Protection Area but not into a government building. Articles in this category include, but are not limited to: Cameras Recording devices (optical, video, audio, or data) Copying and reproduction devices Matches or lighters Cellular telephones Pocket computers and calculators with data transfer capabilities Personal digital assistants (palm pilots) Chemical dispensing devices designed for personal protection (pepper spray, mace) Satellite Radios and MP-3 players On Star and GPS Systems E. Illegal articles include any item that is prohibited by local, state, or federal law, such as illegal drugs and associated paraphernalia. Possession of illegal articles requires involvement with the appropriate law enforcement agency. F. Portable amateur ham radio, citizen band (CB) radio, business band commercial radio, mobile telephone or cellular telephone equipment shall be removed from vehicles before entering Pantex Plant, only if the vehicle is to enter into the Limited Area (LA), which should not occur within this contract. G. A PX-2432, Transportation of Computer Equipment, is required for all computer equipment and storage media on plant site. H. All prohibited articles will be confiscated. The first offense may involve a warning or dismissal from the site. An offense involving illegal drugs shall result in the violator being detained and turned over to the Carson County Sheriff's Office. The second offense shall result in removal of the badge, removal from the site, and denial of future site access. 3.41 SITE ACCESS A. Upon arriving at a Pantex Plant entrance, contractor employees shall stop and present their identification badge to the Security Police Officer (SPO) for examination and a comparison check. B. All vehicles, toolboxes, lunch kits, personnel, etc., are subject to search while at Pantex Plant. C. Access Points: PPA-Property Protection Area a. Building 16-19, 0700-1430 Monday-Friday b. Station 709 (East Gate), 0700-1600 Monday -Friday, 3.42 SITE SECURITY A. Vehicles, equipment, materials, debris, etc., will be parked or placed in a manner to maintain a "clear zone" of 20 feet from any facility (building, ramp, tower, etc.). B. Vehicles, equipment, materials and debris will be parked or placed in a manner to maintain a "clear zone" of 20 feet from any temporary or permanent security fence. C. Materials shall not be stacked in a manner that will hamper Security or Emergency response.
