Description
The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with Thermo Electron North America LLC for an "Essential Support Plan" service and maintenance plan for its ThermoFisher Neptune MC Inductively Coupled Plasma-Mass Spectrometer (ICP-MS) instrument under other than full and open competition by the authority of FAR subpart 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements. This maintenance and service plan shall include: 1. Technical reviews using call history; 2. Unlimited on site service visits; 3. Priority on-site response within 72 hours; 4. Engineer labor and travel costs included in contract; 5. Factory-certified replacement parts; 6. Priority technical support response (within 1.5 hours); 7. Technical support coverage; 8. Coverage of Thermo supplied PCs; 9. One preventative maintenance visit per year; 10. Factory-certified field service engineers; 11. Software updates and notifications; 12. Automatic case logging; 13. Advanced troubleshooting. The overall complexity of the ThermoFisher Neptune MC Inductively Coupled Plasma-Mass Spectrometer (ICP-MS) instrument necessitates an extremely detailed and intricate knowledge of the system and its components in order to effectively service the instrument as well as maintain it at OEM specifications. As Thermo Electron North America LLC is the manufacturer and sole provider of service and maintenance plans for the ThermoFisher Neptune MC Inductively Coupled Plasma-Mass Spectrometer (ICP-MS) instrument system, we require that their factory trained and certified service engineers perform the maintenance and service tasks listed above. Thermo Electron North America LLC is also the only company with access to performance verified parts and engineering resources to maintain this instrument to its original operating specifications, as well as the only source of software updates and technical support for this instrument. Resources to meet these stated requirements can only be obtained by working with the original manufacturer of the equipment, as they do not license or provide access to other companies. Thermo Electron North America LLC is the only contractor who can provide the required "Essential Support Plan" service and maintenance plan for NIST's ThermoFisher Neptune MC Inductively Coupled Plasma-Mass Spectrometer (ICP-MS)instrument. The technology and parts are proprietary, and are not available to other companies. No other vendor is authorized to maintain or service these Thermo Electron instruments. Delivery shall be FOB Destination, Gaithersburg, MD, and be completed in accordance with the Contractor's commercial schedule. The North American Industry Classification System (NAICS) code for this acquisition is 334516, and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 12:00 p.m. (EST) on March 1, 2011. Inquiries will only be accepted via email to paula.wilkison@nist.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
