- This notice updates the prospectus issued by the National Park Service on February 9, 2010. Modification No. 10: (1) amends the effective date of the Draft Contract; (2) increases the possessory interest compensation due the existing Concessioner; and (3) decreases the minimum franchise fee under the terms of the Draft Contract in light of this increase. The possessory interest compensation has been increased to include the PI value ($51,814) of four cabins not initially included in this figure and to effectuate an equitable increase to the agreed upon total possessory interest value of $11.5 million (initially established in 2005). BUSINESS OPPORTUNITY, SUMMARY PAGE 2 Proposed Minimum Franchise Fee: replace three percent (3%) of annual gross receipts with one and a half percent (1.5%) of annual gross receipts. BUSINESS OPPORTUNITY, SUMMARY PAGE 2 Term of Draft Contract: replace Fifteen years starting January 1, 2011 with Fifteen years, starting on or about January 1, 2012. BUSINESS OPPORTUNITY, SUMMARY PAGE 2 Estimated Required Initial Investment: replace Possessory Interest $ 11,448,186 with Possessory Interest $12,362,500. BUSINESS OPPORTUNITY, PAGE 23 Replace the following text: Value of Possessory Interest "The Service and the existing Concessioner have agreed that the value of the existing Concessioner's possessory interest is $11,448,186 as of the date that the possessory interest may be transferred to the successor concessioner. Offerors are referred to Amendment 4 to the existing Contract. The next Concessioner is required to compensate the existing Concessioner this sum of money for its possessory interest. Please note that the $11,448,186 does not include the four units scheduled for removal."
