- The National Institute of Environmental Health Sciences (NIEHS), Research Triangle Park, NC intends to negotiate on a sole source basis with BD Biosciences, San Jose, CA 95131 pursuant to 41 U.S.C.253(c)(1)--Only one responsible source and no other supplies or services will satisfy agency requirements. This procurement is maintenance and support for the period 1/24/2011 through 12/31/2011 on one (1) each of the following BD Bioscience equipment: 1) FACSAria II Special (No Lasers), Material #643695, S/N P69500122; 2) Laser Sapphire 488-50 Blue, Material #642339, S/N: No-Serial 5268; 3) Laser Cohr Cube 640-40 Red, Material # 642528, S/N: No-Serial-5269; and 4) Laser Compass 561-100 LT Grn, Material #643951, S/N: No-Serial-5270. Coverage includes the above system, computer workstation and labor, travel expenses, repair parts, 2 preventive maintenance inspections, software support and revisions, unlimited service visits, unlimited telephone support, and on-site service within 48 hours. Due to sensitivity of the system and all components, only BD Bioscience field service engineers are trained to repair and maintain the equipment as well as have access to factory authorized repair parts and access to the proprietary software and updates. This notice of intent is not a request for competitive proposals; however, all responses received within 6 days from the date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete this proposed contract action based upon responses to this notice is solely with the discretion of the Government. Information received will normally be considered for the purpose of determining whether to conduct a competitive procurement. If no affirmative responses are received within 6 days of this notice to determine whether a qualified source is more advantageous to the Government, the order will be issued to BD Biosciences. The NAICS Code/Size is 811219/$19.0 Million. This procurement is to be processed using FAR Part 13 Simplified Acquisition Procedures in conjunction with FAR Part 12 Commercial Item Acquisition of Commercial Items.
