Note: An Ombudsman has been appointed to hear concerns from offerors orpotential offerors during the proposal development phase of thisacquisition. The purpose of the Ombudman is not to diminish theauthority of the program director or contracting officer, but tocommunicate contractor concerns, issues, disagreements andrecommendations to the appropriate government personnel. When requested,the Ombudsman will maintain strict confidentiality as to the source ofthe concern. The Ombudsman does not participate in the evaluation ofproposals or in the source selection process. Based upon market research, the Government is not using the policiescontained in Part 12, Acquisition of Commercial Items, in itssolicitation for the described supplies or services. However, interestedpersons may identify to the contracting officer their interest andcapability to satisfy the Government's requirement with a commercialitem within 15 days of this notice. Note: While price will be a significant factor in the evaluation ofoffers, the final contract award decision may be based upon acombination of price and past performance factors as detailed in thesolicitation. Government's obligation under this contract is contingent upon theavailability of appropriated funds from which payment for contractpurposes can be made. No legal liability on the part of theGovernment for any payment may arise until funds are made available tothe Contracting Officer for this contract and until the Contractorreceives notice of such availability, to be confirmed in writing by theContracting Officer. Authority: 10 U.S.C. 2304(C)(1), Justification: Supplies (orServices) required are available from only one or a limited number ofresponsible source(s) and no other type of supplies or services willsatisfy agency requirements. The proposed contract action is forsupplies and services for which the Government intends to solicit andnegotiate with only one, or a limited number of sources under theauthority of FAR 6.302. Interested persons may identify their interestand capability to respond to the requirement or submit proposals. Thisnotice of intent is not a request for competitive proposals. ADetermination by the Government not to compete this proposed contractbased upon responses to this notice is solely within the discretion ofthe Government. Information received will normally be considered solelyfor the purpose of determining whether to conduct a competitiveprocurement. It is suggested that small business firms or othersinterested in subcontracting opportunities in connection with thedescribed procurement make contract with the firm(s) listed above. Specifications, plans or drawings relating to the procurement describedare incomplete or not available and cannot be furnished by theGovernment. Written response is required.
