Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This solicitation RFP, VA-245-11-RP-0036 is issued as a request for proposal (RFP). This document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-46. No telephone responses will be accepted. Only written responses received directly from the requester are acceptable. The North American Industry Classification System (NAICS) number is 611430 and the business size standard is $7,000,000.00. This procurement is a 100% Set Aside for Veteran Owned Small Business. Contractor to provide Title 38 Supervisory Management Training to designated staff from VA Martinsburg, WV as follows. Item 1: January 3, 2011 and concluding January 5, 2011 at 12:00 Noon, 1 Job at $ __________. Item 2: February 7, 2011 and concluding, February 9, 2011, 1 Job at $_________. Training days will begin at 8:15 AM and conclude at 4:00 PM, except the final day of each session which will conclude at 12 NOON. The training shall provide case law, and comparison case study outcomes to similar situations in the workplace. Other topics of training to be provided are suitability in the pre and post performance based interview, measuring and critiquing job performance to include the performance improvement period under Chapter 43, absenteeism, and mission impact, reasonable accommodation, light duty management, medical disqualification, and correcting misconduct. Training will also include managing computer misuse, management rights with labor organizations, intoxication in the workplace, appropriate use of the last chance agreements, and handling threatening behavior. Additional training needed will be Merit System Protection Board (MSPB) and Federal Circuit rulings, and discussion about the Office of Special counsel and Equal Employment Opportunity commissions (EEOC's) posture with case law. Other specific training will be 1 day to include the History of the Title 38 System; Professional Standards Boards; Appointments to include Fee Basis, Without Compensation and Non-citizens; Executive Career Field (ECF) and the Proficiency Rating System; the Counseling Conference, and the Summary Probationary Reviews; Failure to maintain Licensure; Light Duty; Reduction-in-force; handling misconduct to include professional conduct and competence; grievance and rights to the VA's Disciplinary Appeals Board; Cyber-Security as it relates to patient, employee, and organizational data; how leadership positively impacts Advanced Clinic Access; and understanding Management Rights with Labor Organizations to include 38 U.S.C. 7422 exclusions from bargaining. Since Title 38 Leaders often supervise both Title 5 and Hybrid Title 38, an overview of those personnel systems will be covered in this training. Following FAR/VAAR Clauses apply 52.212-4, Contract Terms and Conditions-Commercial Items, 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items and in accordance with FAR 12.603 (c) (2)(xii) (b)(2), (b)(9), (b)(19), (b)(20), (b)(21), (b)(24), (b)(25), (b)(26), (b)(39). Offerors must comply with all instructions contained in provision 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition. The following additional provisions and clauses apply: 52.212-2, Evaluation-Commercial Item. The Government will award a contract based on response to requirements listed ABOVE and shall be submitted on COMPANY letterhead and shall address all requirements listed in a separate technical proposal. Evaluation may be made with or without discussions with the offer(s). Technical proposal must describe management and specified training experience as pertained to VA Title 38. Past performance shall be of similar size and scope relative to work required. Offeror must submit a minimum of three (3) references from the Department of Veterans Affairs to include a point of contact name and phone number. Proposal evaluation will be rated with technical experience more important than past performance and when combined are more important than price. 52.212-3, Offeror Representations and Certifications-Commercial Items, a completed copy of this provision shall be submitted with the offer unless ORCA registered which must be noted in quotation. Attention: Contractors must be registered in Central Contractor Registration (CCR http://www.ccr.gov) prior to award, failure to register will result in non-responsiveness of offer. FAR 52.252-2, Clauses Incorporated by References (Feb 1998). This contract incorporates one or more clauses by reference, with the same force and effect as if they were given in full text.
