Description
This is a SOURCES SOUGHT NOTICE to identify the availability of businesses capable of providing environmental management services for the Transportation Security Administration (TSA) field offices nationwide. Services include compliance management, collection, storage, packaging, transportation and disposal of hazardous materials voluntarily abandoned at airport security checkpoints and other TSA facilities, including other hazardous waste generated by the TSA. The contractor must be able to provide all services to all airport locations throughout the Continental United States, Hawaii, Alaska, Guam, US Virgin Islands and US Territories. All companies capable of fulfilling this requirement as described below may respond. This notice is for market research purposes only and does not constitute a Request for Quote or Request for Proposal; and, it is not considered to be a commitment by the Government nor will the Government pay for information solicited; no basis for claim against the Government shall arise as a result from a response to this Sources Sought or Government use of any information provided. At this time no solicitation exists; therefore, DO NOT REQUEST A COPY OF THE SOLICITATION. The Government reserves the right to consider any arrangement as deemed appropriate for this procurement, including the ultimate acquisition approach. Background Prior to passage of the Aviation and Transportation Security Act (ATSA), Pub.L. 107 71, the air carriers were responsible for the screening of commercial air carrier passengers. They were also responsible for the collection and disposition of all prohibited items, including hazardous materials. With the passage of ATSA, TSA became responsible for passenger screening. 49 U.S.C. §44901(a). As a result, TSA determined that it would accept prohibited items abandoned by passengers at security checkpoints. Having accepted the property, TSA is legally liable for the disposition of abandoned or forfeited personal property. Hazardous materials, if not otherwise donated per 41 CFR 101-42.304, must be disposed of in accordance with Federal and state laws and regulations. 42 U.S.C. §6901 et seq. In 2006, TSA issued the National Hazardous Materials Management and Disposal Contract to assist with the management, disposition and disposal of the prohibited hazardous material items abandoned by passengers at security checkpoints. Liquids, Gels, and Aerosols (LGA) were added to the prohibited list in August 2006 while lighters were removed from the prohibited list in August 2007. As a result, the type and amount of hazardous items abandoned by passengers at security checkpoints have changed and increased in quantity since April 2005. The approximate poundage of hazardous materials disposed of on an annual basis is 2 million pounds. Scope The contract will specifically provide management services, administrative and program support, regulatory support, Treatment, Storage and Disposal Facilities (TSDF) audits, documentation and record keeping. The Contractor shall provide an automated reporting system that allows TSA web access, on a near real-time basis, "Cradle to Grave" tracking of all hazardous materials. This reporting system shall be housed on the Contractor's system but be available via remote access to all necessary TSA employees. Access control to the system will be limited to those Contractor employees performing on the contract and those TSA employees designated by the agency as having a need for access to the information. Capabilities Package All interested vendors should submit a package outlining their capabilities as relevant to the performance of this requirement. The package should not exceed 6 pages (including the cover page) and should address the following: 1.) Describe your firm's capability to successfully collect, store, package, transport and dispose of Class 1, 2, 3, 4, 6, 7, 8, and 9 hazardous materials voluntarily abandoned at airport security checkpoints and other TSA facilities nationwide, consistent with all applicable state and federal laws and regulations. 2.) Describe you firm's experience with the performance of environmental audits of Treatment Storage and Disposal facilities (TSDF). 3.) Describe your firm's capability and experience in hosting and maintaining a TSA accredited and certified web-based recordkeeping, reporting, and querying database. 4.) Describe your firm's ability to provide training services to facilities nationwide, including US territories; to include qualified training staff/facilitators and training materials. 5.) Describe your firm's understanding and ability to indemnify and hold harmless the Transportation Security Administration, the Department of Homeland Security, the United States of America and any component of the aforesaid governmental entities, together with the officers and employees thereof, from all civil and administrative liabilities related to the acquisition, possession, maintenance, treatment, and disposition, including transferring of the waste to others for their use, of hazardous and other waste. 6.) Describe your firm's ability to provide regulatory support in areas including: obtaining and maintaining necessary licenses, permits, and documentation to ensure compliance with all applicable Federal, state and local laws, codes and regulations in connection with the management of hazardous materials.
