Description
The General Services Administration is planning a procurement for Cafeteria/Concession Services at the Social Security Administration, Metro West Facility. The cafeteria will be operated for the benefit of approximately 1900 employees who occupy the building located at 300 North Greene Street, Baltimore, Maryland, 21290. The contract shall be solicited as a 1-year base contract, with the possibility of four (4) 1-year options, for a potential contract period total of five (5) years. The Government will provide the space, lighting, heating and air-conditioning, major equipment and major equipment repairs. This will be a no-cost contract. Cafeteria/Concession Services are procured on a profit and loss (P & L) type basis. In addition, the operator is limited to a 10% profit and administrative expense. A wage determination from the Department of Labor will specify minimum wages to be paid to cafeteria employees. The selected contractor shall be responsible for remitting a 1-1/2% fee of gross sales to the government. On average, the current operator reports $540,000 in annual sales. NAICS Code: The applicable NAICS code is 722310, Food Service Contractors, and the small business size standard is $20.5 million. This procurement will be issued as Full and Open Competition. FAR 19 is not applicable to food service contracts. Food services are a non-appropriated activity. This is based on a prior opinion by Office of General Counsel that the set-aside requirement is not applicable because concession contracts do not involve the expenditure of appropriated funds. It is also based on Controller General decision B-253161, August 19, 1993.
