- The U.S. Army Corps of Engineers, Kansas City District, is requesting information regarding potential sources of domestic construction materials as identified in the enclosed list. Pursuant to the Buy American Act as implemented in Federal Acquisition Regulation clause no. 52.225-9, Buy American ActConstruction Materials, a domestic construction material is defined as (1) an unmanufactured construction material mined or produced in the United States; or (2) a manufactured construction material if the cost of its components mined or produced in the United States exceed 50 percent of the cost of all components. The cost of components consists of acquisition cost, transportation and duty, if any. This means an item assembled (labor and packaging only) in the United States entirely from foreign made components, would not be considered domestic for purposes of the clause. There is an exception for commercial, off-the-shelf items as defined in FAR 12.505(a) allowing manufactured items to be considered domestic without being subject to the cost of components test where it is identified as a domestic product. Information is sought from manufacturers, distributors, trade and industry associations and other interested groups. Once the information is compiled, determinations of domestic non-availability may be made that will aid both the Government and construction prime contractors when bidding and completing military construction projects while complying with the provisions of the Buy American Act. THIS IS NOT A REQUEST FOR PROPOSAL. NO PURCHASE OR CONTRACT WILL RESULT DIRECTLY FROM THIS NOTICE. Vendors and interested parties are requested to submit their interest and responses regarding the list of materials/products below in accordance with the attached Response Form.
