Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-1, 41 U.S.C. 253 (c) (1) - ONLY ONE RESPONSIBLE SOURCE AND NO OTHER SUPPLIES OR SERVICES WILL SATISFY AGENCY REQUIREMENTS. CONTRACTOR: APPLIED BIOSYSTEMS 1. Agency and Contracting Activity Identification: VISN 10 Cleveland Contracting Activity, 10000 Brecksville Rd., Cleveland, OH, 44141, as requested by the Research department, will enter a purchase order that requires justification for other than full and open competition. 2. Nature of Acquisition Being Approved: Contractor shall provide all necessary labor, management, supervision, technical skills, quality control, materials, tools, transportation, equipment, and performance of work necessary for "technical writing service submissions." All work shall be performed in strict accordance with the terms, conditions, and specifications, contained or referred to in the statement of work. 3. Description of Requirement: The Research department requires a Big Dye Terminator. 4. Statutory Authority Permitting Other Than Full and Open Competition: The service being procured under the authority of 41 U.S.C. 253 (c) (1), FAR Part 6.302-1 (a) (2). 5. The Nature of the Acquisition Requires Use of the Authority Cited: This contract is being procured on a sole source basis. The item was ordered and shipped from Applied Biosystems originally, and arrived in Brecksville as an equipment order. The order required the item to be frozen, but after the item arrived in the Brecksville warehouse, the ice melted and the shipment was ruined. 6. A Description of Efforts Made to Ensure That Offers From as Many Potential Sources As Practicable and Whether a Notice Will Be Publicized: The Contracting Officer competed this procurement originally. This order is to replace the item included in purchase order 541-D02055. 7. Anticipated Cost: The anticipated cost is fair and reasonable based on the past order. The cost is $8,170.00. 8. Results of Market Survey: See Item 6 above. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: An email from Jay Musson dated 9/28/2010. 10. Any Other Interested Sources? None. 11. A Statement of the Actions, if any, the Agency May Take To Remove of Overcome Any Barriers to Competition Before Any Subsequent Acquisition is Required: See item 5. 12.
