Description
DEPARTMENT OF VETERANS AFFAIRS Justification Review Document For Other Than Full and Open Competition 1. Contracting Organization: VA Black Hills, Fort Meade, SD 2. Description of Action: A Firm Fixed-Price contract is contemplated for aesthetic improvements to Section A of Building 148. 3. Description of Commodities: The Work shall include, but shall not be limited to the following: Work includes removing flooring, abatement of ACM, installing new floor, painting and patching walls per the specifications. The work shall include all labor, materials, equipment and supervision necessary. 4. Statutory Authority: Sections 502 and 503 of Public Law (P.L.) 109-461, the Veterans Benefits, Health Care and Information Technology Act of 2006, currently implemented by Office of Acquisition and Logistics ™ Information Letter (IL) 049-07-8, the Veterans First Contracting Program. 5. Validity of Use of Statutory Authority: The contractor, Boulder Hill Construction LLC, is a Service Disabled Veteran Owned Small Business (SDVOSB) located in the Black Hills area and is a qualified and capable contractor available to perform the work identified in the Scope of Work. The amount of time remaining until the end of the fiscal year is justification to exercise the statutory authority. 6. Sources Solicited: No other Service Disabled Veteran Owned Businesses (SDVOSB) was solicited as the contractor selected is a SDVOSB and capable and available to perform the work. 7. Market Research Conducted: None was conducted for the reason stated above. 8. Other Facts Supporting the Use of Other Than Full and Open Competition: The nearness of the end of the fiscal year does not allow sufficient time to conduct a full 45 day solicitation. 10. Actions to remove Barriers to Competition: Sufficient time and availability of funds will allow us to conduct full and open competition. 11. Fair and Reasonable Price: A proposal was requested from the SDVOSB contractor and was determined to be fair and reasonable when compared to the government estimate. 12. Contracting Officer's Certification: Based upon the information provided herein, I believe the justification for awarding this project to Boulder Hill Construction LLC on a sole-source basis is accurate and complete to the best of my knowledge and recommend we proceed as such. /s/ Christopher J.
