Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation number VA-733-11-RQ-0001 is being issued as a Request for Quote. The solicitation document and incorporated provisions and clauses are those in effect through the Federal Acquisition Circular (FAC) 2005-26. NAICS Code is 541519. This Acquisition is unrestricted. The Department of Veterans Affairs, Florida Caribbean Consolidated Patient Account Center (FCCPAC) has a requirement to provide secure Internet-based access for insurance carrier eligibility and benefits verification, claims status inquiry, report capabilities, and other services as selected by the FCCPAC; and the ability to verify current home addresses of Veterans who have mailed returned to the FCCPAC and for access to credit reports to determine financial position during first party account reviews. Access to information shall be web-based with no additional hardware or software requirements. The Government will provide information to perform work in VISN 8 as work load dictates or needs arise as dictated by FCCPAC Management. a.The Contractor shall provide the necessary implementation (set-up) for Internet-based access to include issuance of individual access (log-on) codes for FCCPAC staff. b.The Contractor shall provide on-site group and individual training for FCCPAC staff at start-up. Additional training may be negotiated between contractor and the FCCPAC. c.The Contractor shall aggressively pursue secure Internet-based access with additional insurance carriers as requested by the FCCPAC. d.Contractor shall provide all labor, materials, transportation, and supervision necessary to provide these services. Unclear policies shall be discussed with the Mid-South Consolidated Patient Accounts Center for clarification. e.The contractor must specify a contact/liaison person, and alternate, and phone numbers for the duration of the work. f.Services provided shall have multiple options available and require minimal patient information to obtain eligibility responses. Services shall allow VA to search for eligibility on up to 20 patients at one time. Inquires shall be run by date of service to check for current and past periods of eligibility. g.The Contractor shall provide secure internet-based access to patient locator inquires utilizing either social security number or patient name and last known address. Address verification shall allow the user to search for current and previous address(es) by entering either the social security number or the name and last known address. Access to information shall be web-based with no additional hardware or software requirements. h.Eligibility results shall print directly from the screen and shall allow for copying and pasting of responses into other systems. i.National Payor List of insurance carriers shall be comprehensive and contain all major health insurance carriers located in Tennessee, Kentucky, West Virginia, Arkansas, Mississippi, Alabama, Georgia, South Carolina, North Carolina, Texas, Virginia, Indiana, Missouri, Oklahoma, Ohio, Illinois, Louisiana, Puerto Rico, Florida. j.Access to Medicare and Medcaid shall contain all major payors AdminaStar, Cahaba, First Coast, Mutual of Omaha, Palmetto, Riverbend, Scan Healthplan, Trispan, UGS. k.Access to Tricare l.Credit reporting and credit scoring shall contain comprehensive demographic information, credit, collection and public record data. m.Contractor shall provider telephone help desk service 24/7. n. Contractor shall be in full compliance with Health Insurance Portability and Accountability Act of 1996 (HIPPA) and shall be Claredi Certified. PERIOD OF PERFORMANCE The Performance period will to begin on or about 1 November 2010 through September 30, 2011, (1) Base Year with 4 Option Years, as follows: Option year one, period of performance will begin 1 October 2011 through 30 September 2012: Option year two, period of performance will begin 1 October 2012 through 30 September 2013: Option year three, period of performance will begin 1 October 2013 through 30 September 2014: Option year four, period of performance will begin 1 October 2014 through 30 September 2015. CONTRACT AWARD MEETING The contractor shall not commence performance on the tasks in this SOW until the CO has conducted a kick off meeting, or has advised the contractor that a kick off meeting is waived. GENERAL REQUIREMENTS 1. There is no guaranteed minimum or maximum amount of work. The dollar amount may be increased/decreased depending on the needs of the FCCPAC. Quantities expressed are estimates, only. 2. For every task, the contractor shall identify in writing all necessary subtasks (if any), associated costs by task, along with associated sub-milestone dates. The contractor's subtask structure shall be reflected in the technical proposal and detailed work plan. 3. All written deliverables shall be phrased in layperson language. Statistical and other technical terminology shall not be used without providing a glossary of terms. 4. Where a written milestone deliverable is required in draft form, the VA will complete their review of the draft deliverable within _14__ calendar days from the date of receipt. The contractor shall have _14__ calendar days to deliver the final deliverable from date of receipt of the Government's comments. SPECIFIC MANDATORY TASKS AND ASSOCIATED DELIVERABLES Description of Tasks and Associated Deliverables: The contractor shall provide the specific deliverables described below within the performance period stated in Section A.4 of this SOW. Services shall follow guidelines to include public laws, agency rules, regulations, practices, and policies regarding a wide range of issues such as eligibility, enrollment, scheduling, billing, financial requirements, etc. The incumbent shall exercise judgment in selecting, interpreting and/or adapting guidelines to a specific problem, issue, or situation and thereby exercising independent discretion and initiative in determining appropriate course of action. Timeliness and accuracy of services directly affect veteran's quality of information and appropriateness of reimbursement for care provided. This work involves providing complex administrative support in one or more functions in the FCCPAC. The contractor shall be required to make numerous determinations based upon the examination of factual information and through understanding of regulatory requirements of the issue. Determining the most appropriate action may involve medical record documentation, eligibility requirements, demographic information, legal precedents and/or requirements, etc. Most of the duties involve processes that require innovative approaches for accomplishment and directly impact customer service. Task: The contractor shall provide a detailed work plan and briefing for the VA project team, which presents the contractor's plan for completing the task order. The contractor's plan shall be responsive with this SOW and describe, in further detail, the approach to be used for each aspect of the task order as defined in the technical proposal. Deliverable: The contractor employee(s) on duty under the terms of this agreement shall evaluate reports and determine appropriate account actions; whether to decrease account, release charge, prepare public voucher. Contractor employee(s) receives technical and administrative direction from the supervisor who assigns the work by establishing deadlines and providing resources to accomplish the tasks. Additional guidance and assistance will be provided on unusual or complex situations. Goals, objectives, and deadlines are established by the supervisor. The contractor plans, schedules and executes assignment, seeking guidance and assistance as needed. Work will be reviewed upon completion for technical accuracy, timelines and may occasionally be spot-checked. SCHEDULE FOR DELIVERABLES 1. Unless otherwise specified, the number of draft copies and the number of final copies shall be the same. 2. If for any reason any deliverable cannot be delivered within the scheduled time frame, the contractor is required to explain why in writing to the COTR, including a firm commitment of when the work shall be completed. This notice to the COTR shall cite the reasons for the delay, and the impact on the overall project. The COTR will forward the notice and reasons for the delay to the CO with comments. The CO will then review the facts and issue a response, in accordance with applicable regulations. CHANGES TO STATEMENT OF WORK Any changes to this SOW shall be authorized and approved only through written correspondence from the CO. A copy of each change will be kept in a project folder along with all other products of the project. Costs incurred by the contractor through the actions of parties other than the CO shall be borne by the contractor. REPORTING REQUIREMENTS 1. The contractor shall provide the Project Manager with monthly [frequency determined by project's duration] written progress reports (original plus _4__ copies). These are due to the Program Manager by the second workday following the end of each calendar month, throughout the project's duration. The Program Manager is required to provide monthly progress reports to the Contracting Officer's Technical Representative (COTR) by the fifth workday of the new calendar month. 2. The progress report shall cover all work completed during the preceding month and shall present the work to be accomplished during the subsequent month. This report shall also identify any problems that arose, along with a statement explaining how the problem was resolved. This report shall also identify any problems that have arisen but have not been completely resolved, with an explanation. INVOICE REQUIREMENTS AND ACCEPTANCE The contractor shall submit an original copy of all invoices to the Austin Financial Services Center with a copy sent by electronic mail to the assigned COTR on the Task Order. PAYMENT DUE DATE Payments under this contract will be due 30 days in arrears - after acceptance of services by the Government, in accordance with the terms of the task order. TRAVEL: N/A SECURITY REQUIREMENTS 1. GENERAL "All information and records provided to Contractor by VA, in whatever medium, as well as all information and documents, including drafts, emails, back-up copies, hand-written notes and copies that contain such information and records gathered or created by Contractor (collectively referred to as "VA information") in the performance of this contract, regardless of storage media, are the exclusive property of VA. Contractor does not retain any property interest in these materials, and will not use them for any purpose other than performance of this contract. "Upon completion or termination of the contract, Contractor shall either provide all copies of all VA information to VA or certify that it has destroyed all copies of all VA information as required by VA in a method specified by VA, at VA's option. The Contractor shall not retain any copies of VA information. Where immediate return or destruction of the information is not practicable, Contractor shall return or destroy the information within 30 days of completion or termination of the contract. All provisions of this contract concerning the security and protection of the VA information that is the subject of this contract will continue to apply to the VA information for as long as the Contractor retains it, regardless of whether the contract has been completed or terminated. "Prior to termination or completion of this contract, Contractor shall not destroy VA information received from VA or gathered or created by Contractor in the course of performing this contract without prior written approval by VA. "Contractor shall receive, gather, store, back up, maintain, use, disclose and dispose of VA information only in accordance with the terms of this contract and applicable federal and VA information confidentiality and security laws, regulations and policies. "The Contractor shall not make copies of VA information except as necessary to perform this agreement or to preserve electronic information stored on Contractor electronic storage media for restoration in case any electronic equipment or data used by the Contractor needs to be restored to an operating state. "Contractor shall provide access to VA information only to employees, subcontractors, and affiliates only: (1) to the extent necessary to perform the services specified in this Contract, (2) to perform necessary maintenance functions for electronic storage or transmission media necessary for performance of this contract, and (3) only to individuals who first satisfy the same conditions, requirements and restrictions that comparable VA employees must meet in order to have access to the same VA information. These restrictions include the same level of background investigations, where applicable. "Contractor shall store, transport or transmit VA information only in an encrypted form, using an encryption application that meets the requirements of FIPS 140-2, and is approved for use by VA. "Except for uses and disclosures of VA information authorized by this contract for performance of the contract, the Contractor may use and disclose VA information only in two other situations: (i) in response to an order of a court of competent jurisdiction, or (ii) with VA's prior written authorization. The Contractor shall refer all requests for, demands for production of, or inquiries about, VA information to VA for response. "If VA information subject to the contract includes information protected by 38 USC 7332, or 5705, include the following after the last sentence of the paragraph immediately above: Contractor shall not release information protected by either 38 USC 5705 or 7332 in response to a court order, and shall immediately refer such court orders to VA for response. "Prior to any disclosure pursuant to a court order, the Contractor shall promptly notify VA of the court order upon its receipt by the Contractor, provide VA with a copy by fax or email, whichever is faster, and notify by telephone the VA individual designated in advance to receive such notices. If the Contractor cannot notify VA before being compelled to produce the information under court order, the Contractor shall notify VA of the disclosure as soon as practical and provide a copy of the court order, including a description of the records provided pursuant to the court order, and to whom the Contractor provided the records under the court order. The notice will include the following information to the extent that the Contractor knows it, if it does not show on the face of the court order: the records disclosed pursuant to the order, to whom, where, when, and for what purpose, and any other information that the Contractor reasonably believes is relevant to the disclosure. If VA determines that it is appropriate to seek retrieval of information released pursuant to a court order before Contractor notified VA of the court order, Contractor shall assist VA in attempting to retrieve the VA information involved. "The Contractor shall inform VA by the most expeditious method available to Contractor of any incident of suspected or actual access to, or disclosure, disposition, alteration or destruction of, VA information not authorized under this Contract ("incident") within one hour of learning of the incident. An incident includes the transmission, storage or access of VA information by Contractor or subcontractor employees in violation of applicable VA confidentiality and security requirements. To the extent known by the Contractor, the Contractor's notice to VA will identify the information involved, the circumstances surrounding the incident (including to whom, how, when, and where the VA information was placed at risk or compromised), and any other information that the Contractor considers relevant. "Contractor shall simultaneously report the incident to the appropriate law enforcement entity (ies) of jurisdiction. The Contractor, its employees, and its subcontractors and their employees shall cooperate with VA and any law enforcement authority responsible for the investigation and prosecution of any possible criminal law violation(s) associated with any incident. The Contractor also will cooperate with VA in any civil litigation to recover VA information, to obtain monetary or other compensation from a third party for damages arising from any incident, or to obtain injunctive relief against any third party arising from, or related to, the incident. "VA will provide the Contractor with the name, title, telephone number, fax number and email address of the VA official to whom the Contractor shall provide all notices required by this Contract. "VA has the right during normal business hours to inspect the Contractor's facility, information technology systems and storage and transmission equipment, and software utilized to perform the contract to ensure that the Contractor is providing for the security of VA data and computer systems in accordance with the terms of this Contract. "Contractor shall receive, gather, store, back up, maintain, use, disclose and dispose of VA information only in compliance with all applicable Federal information Processing Standards (FIPS) and Special Publications (SPs) issued by the National Institute of Standards and Technology (NIST) concerning VA information that is the subject of this contract. If NIST issues or updates an applicable FIPS or SP after execution of this contract, the parties agree to negotiate in good faith to implement the FIPS or SP in this contract. "A determination by VA that the Contractor has violated any of the information confidentiality and security provisions of this contract, including a violation of any applicable FIPS or SP, shall be a basis for VA to terminate the contract for cause. If anyone performing this contract, including employees of subcontractors, accesses VA computer systems or data in the performance of the contract, VA may monitor and record all such access activity. If VA monitoring reveals any information of suspected or potential criminal law violations, VA will refer the matter to the appropriate law enforcement authorities for investigation. "Contractor shall inform its employees and other individuals performing any part of this contract that VA may monitor their actions in accessing or attempting to access VA computer systems and the possible consequences to them for improper access, whether successful or not. The Contractor shall ensure that any subcontractors or others acting on behalf of or for the Contractor, in performing any part of this contract inform their employees, associates or others acting on their behalf, that VA may monitor their access activities. Execution of this contract and any subcontract or agreement constitutes consent to VA monitoring. "The Contractor shall ensure that all individuals who will access VA data or systems in performing the contract are appropriately trained in the applicable VA confidentiality and security requirements. Contractor shall do this by requiring and documenting that these individuals have completed the VA training for its employees. The Contractor shall provide documentation of required training to the COTR prior to the Contractor staff accessing VA records. "To the extent practicable, Contractor shall mitigate any harmful effect on individuals whose VA information was accessed or disclosed in an incident. "Contractor shall require subcontractors, agents, affiliates or others to whom Contractor provides access to VA information for the performance of this contract to agree to the same VA information confidentiality and security restrictions and conditions that apply to the Contractor before providing access. "The Contractor shall abide by Federal Acquisition Regulation (FAR) clauses 52.224-1 and 224.2. The VA records that are the subject of this contract is contained in VA Privacy Act system of records Program Evaluation Research Data Records #107VA008B. "FAR clauses 52.239-1 and 24.101-.104. "The Contractor shall utilize only employees, subcontractors or agents who are physically located within a jurisdiction subject to the laws of the United States. Contractor shallensure that it does not use or disclose Protected Health Information (PHI) received from Covered Entity in any way that will remove the PHI from such jurisdiction. Contractor shallensure that its employees, subcontractors and agents do not use or disclose PHI received from Covered Entity in any way that will remove the PHI from such jurisdiction. 2. CONTRACTOR PERSONNEL SECURITY REQUIREMENTS: All Contractor employees who require access to the Department of Veterans Affairs' computer systems or data shall be the subject of a background investigation and must receive a favorable adjudication from the VA Office of Security and Law Enforcement prior to contract performance. This requirement is applicable to subcontractor personnel requiring the same access. If Contractor staff shall require access to the detailed veteran data for the purpose of completing the tasks described in this statement of work, they must adhere to the following contractor personnel security requirements. "Position Sensitivity - The position sensitivity has been designated as Low Risk. "Background Investigation - The level of background investigation commensurate with the required level of access is Minimum Background Investigation. "Contractor Responsibilities: a)The Contractor shall prescreen all personnel requiring access to the computer systems to ensure they maintain a U.S. citizenship, and are able to read, write, speak and understand the English language. b)The Contractor shall submit the required forms (SF 86 or SF 85P, SF 85P-S, FD 258, Contractor Fingerprint Chart, VA Form 0710, Authority for Release of Information Form, and Optional Forms 306 and 612) to the VA Office of Security and Law Enforcement within 30 days of receipt. c)The Contractor, when notified of an unfavorable determination by the Government, shall withdraw the employee from consideration from working under the contract. d)Failure to comply with the contractor personnel security requirements may result in termination of the contract for default. e)The Contractor shall notify the COTR in advance of any Contractor staff that will require access to the Department of Veterans Affairs' computer systems or data in order for the COTR to request the background investigation. The notification shall include the following: full name of the individual, justification for the request which includes the task number, the date of birth, place of birth, email address, social security number, and occupation. In addition, the Contractor shall provide the COTR with its point of contact's email address, business address, and phone number. "Government Responsibilities: a)The VA Office of Security and Law Enforcement will provide the necessary forms to the contractor, or to the contractor's employees, after receiving a list of names and addresses. b)Upon receipt, the VA Office of Security and Law Enforcement will review completed forms for accuracy, and forward the forms to the office of Personnel Management (OPM) to conduct background investigations. c)The VA Office of Security and Law Enforcement will notify the CO, and contractor, of adjudication results received from OMB. d)Upon being notified about a favorable determination, the CO may issue a notice to proceed to the contractor. The provision at 52.212-1, Instructions to Offerors -- Commercial, applies to this acquisition. The following addenda are made to this provision. All quotes must be submitted electronically only, and no fax, mail or hand delivered quotes will be accepted. Submit quote via email to Lerlita.Garcia@va.gov. The provision at 52.212.2, Evaluation - Commercial Items, applies to this acquisition. (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: TECHNICAL PAST PERFORMANCE PRICE Technical and past performances, when combined, are significantly more important than price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. Conformance to the Statement of Work. The technical proposal shall demonstrate the ability to provide the services as required. As part of the technical proposal the following must be included to be considered for award: Technical - Technical capability is defined as an Offeror's proposed solution(s) and demonstrated ability to perform the type of work described by this SOW. Understanding and Compliance with requirements 1.Company experience and demonstrated ability: Number of years providing Internet Based services for administrative and financial performance of healthcare business activities. Include information regarding capabilities and experience of company personnel. Provide supporting documentation of your company's ability to provide services that optimize business processes with large health care organizations. a. Payor List of Insurance Companies, Medicare, Medicaid, Tricare, Credit Reporting, and address Verification: Provide a complete list, including name and location of insurance companies that are accessible through the offered services. Also provide complete list of Medicare, Medicaid, Credit Reporting and Credit Scoring agencies. b.Security and Privacy Policies: Provide written security and HIPAA policies. Provide documentation that demonstrates your company is in full compliance with HIPAA. Past Performance - Past performance evaluation will consider reliability of past performance information, source of information, and the relevance of information. Provide data on the level of experience in specific contracts of this type. Provide information on performance in these contracts, particularly as it relates to the Offeror's overall abilities. 1.Evidence that the organization has current capabilities; and for assuring performance of this requirement. 2.The Offeror shall identify three (3) contracts/task orders with the Federal Government and/or commercial customers that demonstrate recent and relevant past performance. Recent is defined as within the last three years. Relevant is defined as work similar in complexity and magnitude of the work described in this Statement of Work. Any contracts with other VA Hospital should also be identified. Include the following information: 1Project title 2Description of the project 3Contract number 4Contract amount 5Government Agency/Organization and Point of Contact Price - The firm fixed price shall be based on the rates contained in your proposal. Since award will be based on initial responses, you are encouraged to offer your most advantageous pricing in the initial response. Contractors are required to complete the attached schedule of services. In those instances where as a result of technical evaluation, proposals are judged to be essentially equal, then price shall become the determining factor. The Offeror that submits the most favorable initial quote to the Government may be awarded the contract with or without discussion.
