Description The National Cancer Institute (NCI), Center for Cancer Research (CCR) plans to procure on a sole source basis the services of Carl Zeiss Microimaging, Inc., One Zeiss Drive, Thornwood, NY, 10594 to provide a service agreement/maintenance service for seventeen (17) Government owned Confocal Microscopes. 1. LSM 700 Scanning Newton w one scope SRI 2601000226 This acquisition will be processed under FAR Part 12 - Acquisition for Commercial Items and will be made pursuant to the authority in FAR 13.106-1(b)(2) and 13.501-(a)(1) using simplified acquisition procedures for commercial acquisitions. Only one award will be made as a result of this solicitation. This will be awarded as a firm fixed price type contract. Period of Performance: Performance shall be for twelve (12) months from date of award. The CCR Confocal Core Facilities have a need for a service contract to maintain their equipment used for confocal analysis of a wide range of biological specimens. The CCR core facilities, need to provide over 500 users with "state-of-the-art" confocal imaging for a wide range of applications. CCR currently has seventeen Zeiss Confocal systems that need to be placed under a service agreement. Contractor shall perform one (1) preventive maintenance inspection on each piece of equipment during the contract period. Service shall be performed by technically qualified factory trained personnel. Service shall consist of a thorough cleaning, calibration, adjusting, inspection, lubrication and testing of all equipment in accordance with the manufacturer's latest established service procedures. All equipment shall be operationally tested through at least one (1) complete operating cycle at the end of the preventive maintenance inspection assure optimum and efficient performance. Emergency repair services shall be provided on an unlimited basis during the term of this contract. Emergency service shall be provided between 9 am and 5 pm Monday thru Friday excluding Federal Holidays. Outside of services hour's service will be provided by phone. Upon receipt of notice that any part of the equipment is not functioning properly the Contractor shall furnish within seventy-two (72) hours a qualified factory-trained service representative to inspect the equipment and perform all repairs and adjustments necessary to restore the equipment to normal and efficient operating condition. Emergency service calls shall not replace the necessity for scheduled Preventive Maintenance Inspections. These Zeiss confocal instruments were designed and manufactured by the firm Carl Zeiss, Inc. They require professional maintenance including scheduled service visits and periodic part replacement. Carl Zeiss is the only reliable firm that is capable of repairing and maintaining these state-of -the art Zeiss confocal models and especially the Meta detector and the NLO. The internal components and mechanisms of this instrument are proprietary and Carl Zeiss Inc is the only known source capable of fulfilling the service contract on these instruments. Zeiss service engineers have the highest qualification for repairing the Zeiss confocal microscopes. They are specially trained in Germany on the latest models of the instrument. Zeiss does not offer such training opportunities to outside companies. Carl Zeiss holds multiple patents on this instrument and it is a sole source of most of the replacement parts. The parts of the confocal instrument require special handling and this handling needs approval of Carl Zeiss to get the warranty replacements. The CCR is constantly upgrading the confocal systems with newest versions of the software and hardware and these upgrades can only be obtained from the manufacturer. Due to the reasons cited, Carl Zeiss, Inc. is the only known unique source to provide the service to these seventeen Confocal Microscopes. This is not a solicitation for competitive quotations. However, if any interested party believes they can meet the above requirement, they may submit a statement of capabilities. All information furnished must be in writing and must contain sufficient detail to allow the NCI to determine if it can meet the above unique specifications described herein. An original and one copy of the capability statement must be received in the NCI Office of Acquisitions on or before 11:00 AM EST on September 30, 2010. No electronic capability statements will be accepted (i.e. email or fax), an original and one copy must be sent to the NCI Office of Acquisitions at the address stated above. All questions must be in writing and can be faxed (301) 402-4513 or emailed to Terry Galloway, Contract Specialist at terry.galloway@nih.gov. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. In order to receive an award, contractors must have valid registration and certification in the Central Contractor Registration (CCR) www.ccr.gov and the Online Representations and Certifications Applications (ORCA), http://orca.bpn.gov.
