Description
DEPARTMENT OF VETERANS AFFAIRS NETWORK 22 CONTRACTING ACTIVITY JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-5, 41 U.S.C. 253 (c) (2) 1. Agency and Contracting Activity Identification: The Network 22 Contracting Activity, 5901 E. 7th Street, Long Beach, California, as requested by the VA Long Beach Healthcare System (VALBHS), will enter into a supply contract that requires justification for other than full and open competition. 2. Nature of Acquisition Being Approved: Sole source contractor shall provide Getinge medical equipment to the VALBHS for Supply Processing and Distribution (SPD) under the terms and conditions of a supply contract. 3. Description of Requirement: VASNHS is requesting a sole source supply contract for medical equipment from TrillaMed, LLC. Pursuant to 38 U.S.C. § 8127(c) and the provisions of Department of Veterans Affairs Office of Acquisition and Material Management (OA&MM) Public Law 108-183, Veterans Benefits Act of 2003The period of performance is September 13, 2010 through September 30, 2010. The estimated for cost for is $371,582.74. 4. Statutory Authority Permitting Other Than Full and Open Competition: The service is being procured under the authority of 41 U.S.C. 253 FAR Part 6.302-5 Authorized by Statute. 5. The Nature of the Acquisition Requires Use of the Authority Cited: TrillaMed, LLC is an authorized distributer of Getinge USA and is uniquely qualified based upon the following: (a)They are a responsible contractor based on their performance with previous contracts awarded to medical facilities in VISN 22 and the contracting officer does not expect that two or more service-disabled veteran owned small business owners will submit offers for the contract (b)The Getinge Steam Sterilizers are optimized for the Operating Room/ Central Sterile Processing applications. The steam sterilizer is need for infection control for the SPD department. SPD process specimens which employee's runs the risk of contracting incurable diseases. The sterilizer is an equipment unit that can process a large amount of surgical equipment without exposure bacteria to employees. The machine can quickly load and sterilize equipment within two hours. The quick turn-around time is needed due to emergent surgeries for the Veterans. There is no other equipment on the market that sterilizes equipment within two hours. Furthermore, any delay in sterilization will delay surgery would have a negative impact on the health and welfare of the veteran beneficiaries and could lead to death. 6. A Description of Efforts Made to Ensure That Offers From as Many Potential Sources As Practicable and Whether a Notice Will Be Publicized. See item Number 5 above. A notice will be transmitted to the GPE (FedBizOpps) from September 11, 2010 through September 15, 2010. 7. Anticipated Cost: The anticipated cost should be fair and reasonable to the government based on the using service estimate and past prices paid for similar supplies. VA Long Beach has procured similar equipment. There is no fluctuation in prices as this is the flat equipment rate. 8. Results of Market Survey: Market research information was obtained through the GSA website TrillaMed, LLC is currently on the Federal Supply Schedule (FSS), but the equipment requested is not listed on their contract. See Item Number 5 above. DEPARTMENT OF VETERANS AFFAIRS NETWORK 22 LOGISTICS OFFICE JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-5, 41 U.S.C. 253 (c) (2) 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: None. See Item Number 6 above. 10. Any Other Interested Sources? There are no other sources that expressed in writing an interest in the service. See Item Number 6. 11. A Statement of the Actions, if any, the Agency May Take To Remove of Overcome Any Barriers to Competition Before Any Subsequent Acquisition is required: The anticipated life of the Government Equipment is estimated to be twenty (20) years. The Government plans to maintain this equipment for the next twenty years to maximize usage of the supplies. In order to overcome barriers to competition, the Government shall research other surgical equipment before the procurement of new equipment. Since the medical equipment is proprietary, overcoming the barriers for competition cannot be realized at this time. 12.
