Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; PROPOSALS ARE NOT BEING REQUESTED AND A WRITTEN SOLICITATION WILL NOT BE ISSUED. The versions of provisions and clauses incorporated herein are those in effect as of Federal Acquisition Circular (FAC) 2005-43 dated 8/02/10. The Export-Import Bank of the United States intends a sole source award for hardware maintenance services to Oracle Inc., dba Sun Microsystems. The applicable NAICS code is 334111-Computer Server Manufacturing, with a small business size standard of 1,000 employees. There are no set-asides identified for this procurement. The Export-Import (Ex-Im) Bank of the United States' Office of the Chief Information Officer has a requirement to purchase hardware maintenance services from Oracle, Inc, a sole source, via their Sun Microsystems server product line. Hardware maintenance is a functional requirement to sustain the server hardware as an integral component in the support for critical software applications that are essential to the performance of Ex-Im banks' mission. The Sun servers are a major link in the provision of services to the banks' constituencies. Maintenance of the Sun Servers is required to assure that critical applications required by the bank and its customers remains available on a continual basis. Maintenance services are vital to maintaining daily operational efficiency and effectiveness. Oracle dba Sun Microsystems, as the manufacturer, is the sole provider of hardware maintenance on its server products and is best positioned to provide such services. Acquisition of the services provides that the products will be maintained at their highest operational functionality, a primary factor in the assured availability of system support. This solicitation incorporates the FAR clauses 52.212-1 (Instructions to Offerors-Commercial Items (Jun 2008)); 52.212-3 (Offeror Representations and Certifications-Commercial Items (August 2009)); 52.212-4 (Contract Terms and Conditions-Commercial Items (Mar 2009)); 52.212-5 (Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items December 2009)); 52.217-8 (Option to Extend the Services)(Nov 1999); 52.217-9 (Option to Extend the Term of the Contract)(March 2009); and 52.237-3 (Continuity of Services)(January 1991) for commercial items and services.
