- Contracting Office Address: Department of Homeland Security, Federal Law Enforcement Training Center (FLETC), Biocontainment Procurement Branch, Procurement Division, TH378C, 1131 Chapel Crossing Road, Glynco, GA 31524 This sources sought/market survey is in two parts: (1) Identify potential offerors for a construction project and (2) Provide a PLA Questionnaire related to this potential project. Part 1: The Department of Homeland Security is attempting to identify potential offerors capable of providing Construction Management as constructor (CMc) for a project on the Transportation Security Laboratory facility at the William J. Hughes Technical Center, which is located near the Atlantic City International Airport, New Jersey. The anticipated project will require the contractor to furnish all labor, material, supervision and equipment required for construction and renovation for the Infrastructure Investment Program (IIP) at the Transportation Security Laboratory (TSL). The TSL is a Department of Homeland Security Federal Laboratory and is a part of the Science and Technology Directorate of the Department. The mission of the TSL is to serve as the leading federal laboratory for the applied research, development, integration, and validation of cutting edge science and technology solutions for the detection and mitigation of explosives and conventional weapons threats in order to secure the homeland. TSL performs life-cycle management of technology from conception to deployment, including applied research, development, prototyping, test and evaluation, certification, systems qualification tests, and laboratory assessment testing. TSL is internationally recognized for its role in the development of standards, protocols, and test articles for detection technology assessments. This project involves new construction, renovation and expansion. The existing facilities consist of 70,000 SF of facilities and 2,600 lbs of explosive storage. The proposed new IIP construction consists of 95,000 SF of new facilities and 13,900 lbs of explosive storage. The final campus will consist of a total of 165,000 SF of total facilities which will include: 50,000 SF office space, 93,000 SF lab space, 22,000 SF of storage space and 16,500 lbs of explosive storage. The contract will result in severable projects in order as follows: • IT&E Certification Lab Facility o Construct a new technical facility with integrated blast-resistant, cleanroom, decontamination and office/training facilities. • Test Article and Bulk Explosives Storage Areas o Construct new explosive storage areas including open cell bulk storage in magazines and covered "igloos" for prepared articles. • Renovate B319 for Trace Lab o Renovate existing warehouse facility to accommodate cleanroom laboratory capabilities, including interior finishes, laboratory cabinetry installation and specialized HVAC, electrical and plumbing installation. • Renovate Blast Laboratory cells o Selective demolition, renovation and modernization of existing technical blast-resistant laboratory areas and associated building services. • B-315 Addition for New DT&E Labs o Construction of new technical blast-resistant laboratory areas and integration with existing structure and building services. • Non-Hardened General Purpose Lab w/ Offices (NHGP) o New construction of multi-story facility containing technical laboratory, state-of-the-art warehouse facilities and administrative and office space. • Relocate B318 Lab Functions to NHGP and o Renovate B-318 back into Dedicated Storage Space The Government intends to utilize the Construction Manager as Constructor (CMc) delivery method for this procurement. Under this contract the CMc will function as a collaborative member of the project team and shall be an active participant in pre-construction by providing expertise during the design process, to include reviewing designs, preparing cost estimates, reconciling estimates with the A-E, controlling schedules, and performing constructability reviews. The CMc will be responsible for all construction under a single contract. The services requested of the CMc shall cover a wide range of design and construction activities which are often performed by both Construction Managers and general contractors. The CMc must maintain a team with the expertise and capability to manage and coordinate the timely and orderly development and construction of the proposed project. The CMC shall be required to assign, as needed, a team consisting of architectural, civil, structural, mechanical and electrical reviewers; cost estimators; CPM analysts; field engineers; field support staff; construction supervisors; construction superintendents; testing engineers/technicians; major subcontractors, and other disciplines. The CMc shall provide the Government with sound management advice regarding the approach to the project, how to achieve the best value in the work being accomplished, schedule control, alternative ideas, problem prevention, and budgeting. The CMc shall have a full understanding of the project, its contract documents, and the principles of Federal construction contracting and contract administration. Most importantly, the CMc shall have complete responsibility for construction of the facility. The CMc contract will also include the acquisition of an independent certified commissioning agent (CxA) subcontracted to the CMc contractor. The commissioning agent shall provide enhanced commissioning of whole building integrated systems as identified in the Operational Requirements and Basis of Design documents. The CMc and subcontracted CxA should have experience with the evaluation, installation and commissioning of high-performance buildings including sustainable, energy efficiency, renewable/recycled materials, energy modeling, renewable energy systems. At a pre-determined point in the design phase, likely at about 70%, a Guaranteed Maximum Price (GMP) will be negotiated and construction of the project will begin. The CMc will be contractually bound to pay for costs that exceed the GMP unless the Government changes the scope. The estimated construction cost is $51.5-million, to include the CMc's Preconstruction Phase Services, Construction Phase Services, and Commissioning Services. The anticipated procurement will be negotiated on a best value basis in accordance with FAR 15.101, based primarily on a trade-off between relevancy and quality of present/past performance, qualifications/experience of proposed key personnel, proposed key subcontractors, proposed commissioning agent, and price, with all evaluation factors other than price, when combined, considered significantly more important than price. The best overall value to the Government includes demonstrating a commitment to construction excellence, providing and maintaining a viable team organization and adherence to the budgetary and time parameters for this project. Offerors will be evaluated on relevant corporate experience, past performance on contracts of similar scope and magnitude where the offeror acted as prime contractor or CMc, Key Personnel, to include experience and qualification of proposed staff, and price. The price proposal will include pricing of the CMc's cost of Pre-construction Services and a total fee for Construction Phase Services, including profit, General Conditions, and other overhead costs. Interested firms should, as early as possible, but no later than close of business on September 24 2010, indicate interest in this acquisition by letter (no more than 2 typewritten pages), referencing the solicitation number with a brief summary of the firm's experience in relevant contracts in scope and magnitude (similar dollar value) where the offeror acted as a prime contractor or CMc, particularly in the construction of high hazard laboratories and explosive storage areas, or similar facilities. Responses should briefly address the firm's experiences in the performance of pre-construction and construction phase services under the CMc concept, including its experience in managing large construction projects requiring numerous subcontractors working simultaneously on different phases. The letter should clearly identify the business size, i.e., large business, small business, 8(a), HUBZone, VOSB, SDVOSB, WOSB, etc. Due to the estimated value of this project, the letter must also provide the offeror's bonding capacity (single project, aggregate limit, and bonding currently available). In response to the solicitation, offerors will be required to demonstrate their ability to perform projects of a similar scope and magnitude, perform quality work, complete projects on schedule, and at a reasonable price. Award of the resulting contract will not necessarily be made to the lowest priced offeror. It is the intent of the Government to negotiate and award a contract to a well qualified firm with extensive experience in performing projects of similar scope and magnitude. The Government anticipates significant subcontracting opportunities under this contract. It is anticipated that the solicitation will be available in October 2010, with proposals due during November 2010. The Government intends to use the results of this Sources-Sought Notice to determine acquisition strategy for this procurement, utilizing NAICS Code 236220, Size Standard $33.5M. This survey is regarding the potential use of a Project Labor Agreement with this project. PLA is defined as a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement described in 29 U.S.C. 158(f). Federal Acquisition Regulation (FAR) Policy: (a) Project Labor Agreement (PLA) is a tool that agencies may use to promote economy and efficiency in Federal procurement. Pursuant to Executive Order 13502, agencies are encouraged to consider requiring the use of project labor agreements in connection with large-scale construction projects.
