- JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1.Contracting Activity: Department of Veterans Affairs Office of Acquisition and Logistics Technology Acquisition Center 260 Industrial Way West Eatontown, NJ 07724 2.Description of Action: The proposed action is for a three (3) year Firm-Fixed-Price contract for support services to assist in the development of various security/information technology policies issued by Department of Veterans Affairs (VA) Office of Cyber Security (OCS) for all of VA. 3.Description of Supplies or Services: OCS has a requirement for support services in developing, documenting, and authoring directives and handbooks designed to satisfy the operational, technical, and management information security required by VA. The contractor shall support OCS in its understanding of VA information security requirements, including any challenges surrounding their implementation and end-user interpretation. The support services will also include participation in workgroups to better understand policy requirements, revisions to directives, handbook and guidance templates, and support in the creation of two (2) to three (3) handbooks per year. In addition, the contractor shall assist in mitigating end-user problems arising from policy implementation by providing OCS with applicable policy references to specific security questions from the field. Additionally, the aforementioned support services will ensure that OCS directives and handbooks are current, accurate, and compliant with relevant information security policy. The total estimated price of the proposed action is $2,429,780.70. 4.Authority Cited: The statutory authority permitting other than full and open competition for this acquisition is 38 U.S.C. 8127(c), Veterans First Contracting Program. Contracts awarded using this authority shall be supported by written justifications as required by Federal Acquisition Regulation (FAR) 6.302-5 - Authorized or required by statute. 5.Reason for Authority Cited: The proposed source for this action is EmeSec Incorporated (EmeSec), 1818 Liberty Street, Suite 500, Reston, VA 20190, a service-disabled veteran-owned small business (SDVOSB). EmeSec has experience developing system security requirements and evaluating security controls in accordance with the Federal Information Systems Management Act of 2002, Office of Management and Budget guidelines, and Health Insurance Portability and Accountability Act. In addition, EmeSec has prior experience developing and documenting enterprise-wide security policies and manuals. EmeSec currently serves as a support contractor for OCS on a three (3) year effort for similar support services and has proven its ability to meet the requirement, while demonstrating a familiarity with VA policies and customers. EmeSec's knowledge of VA policy development process, including policy modification and implementation, makes them an effective partner in support of OCS. EmeSec's prior experience will ensure that OCS receives the support necessary to revise and implement VA's information security program. 6.Efforts to Obtain Competition: Market research was conducted and the details are contained in the market research section below. Consistent with the guidelines of the Veterans First Contacting Program, the proposed action described herein will be synopsized on the Federal Business Opportunities Page in accordance with FAR Part 5. 7.Actions to Increase Competition: All future requirements will be handled on a case-by-case basis to determine future acquisition strategy. 8.Market Research: Market research was conducted by searching the VetBiz.gov database on July 21, 2010 to determine if EmeSec is a SDVOSB. This search concluded that EmeSec is registered and certified in the VetBiz.gov database and qualifies as a SDVOSB in accordance with federal small business size standards for the applicable North American Industry Classification System code 541690. Additionally, a search in the Central Contractor Registration (CCR) performed on July 21, 2010 showed that EmeSec is registered under CCR. Based on this market research, the Government's technical experts have determined that EmeSec is a SDVOSB and can meet the Government's requirements. 9.Other Facts: The Contracting Officer has determined that this procurement meets all the requirements of statute 38 U.S.C. 8127(c). The award price, inclusive of options, will not exceed $5,000,000, EmeSec is a responsible SDVOSB, and a fair and reasonable price will offer the best value to the Government. 10.Technical and Requirements Certification: I certify that the supporting data under my cognizance, which are included in this justification, are accurate and complete to the best of my knowledge and belief.
