- Federal Acquisition Regulation (FAR) 52.212-3, Offeror Representations and Certifications - Commercial Items (AUG 2009) that must be completed and submitted with the offer. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This procurement is being conducted under Simplified Acquisition procedures pursuant to the authority of FAR Subpart 13.5, Test Program for Certain Commercial Items (10 U.S.C. 2304(g) and 2305 and 41 U.S.C. 253(g) and 253a and 253b); FAR Part 12, Acquisition of Commercial Items (Title VIII of the Federal Acquisition Streamlining Act of 1994 (Public Law 103-355)); FAR 37.104, Personal Services Contracts (Public Law 103-332, Department of the Interior and Related Agencies Appropriation Act, Title II, September 30, 1994, 108 Stat. 2530 as implemented by 25 U.S.C. 1638c); and FAR Subpart 37.6, Performance-Based Contracting. This announcement constitutes the only solicitation; therefore, a written solicitation will not be issued. The Billings Area Indian Health Service (IHS) intends to award a fixed-price personal services commercial item contract in response to Request for Quotation (RFQ) 10-10-070-REL. This solicitation is restricted to 100% Small Business concerns. The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-44. The associated North American Industry Classification System code is 621399 and the small business size standard is $7.0 million. PRICE SCHEDULE - LICENSED PRACTICAL NURSE (LPN): 2080 HOURS @ $____________________ per hr = $_________________________. WORK SCHEDULE: Shifts will normally be 8 hours in length and will be worked between the hours of 8:00 a.m. to 4:30 p.m. The services will be performed in the Outpatient Department at the Crow Service Unit, PHS Indian Hospital, Crow Agency, Montana. The schedule shall be coordinated with the Director of Nursing. PURPOSE OF THE CONTRACT: The purpose of this acquisition is to contract for a Licensed Practical Nurse in the Outpatient Department at the Crow Service Unit, PHS Indian Hospital, Crow Agency, Montana. STATEMENT OF WORK: The Contractor will serve as a licensed practical nurse performing a variety of complex, advanced, and specialized nursing duties for critically ill and critically injured patients. MAJOR DUTIES: Prepares and administers prescribed medications within established scope of practice using knowledge of nursing principle, practices, and procedures; EKG monitoring functions; pharmacology; skill in recognizing deviations from the normal; and observing and identifying patient's physical and emotional problems. Using such knowledge and skill, employee prepares and administers medications via oral, sublingual, intramuscular, intradermal, "piggy-back" IVs, and subcutaneous routes; monitors patients for reactions to medication and takes appropriate action; calculates dosages and documents administration; maintains currency in pharmacology and drug therapy; uses identification precautions to ensure correct medications are administered to specified patients; participates in patient care planning; etcetera. (1)Monitors patients for desired action and adverse reactions to medications and takes appropriate action. (2) Calculates dosages and documents administration. (3) Participates in patient care planning. (4) Administers medication via oral, sublingual, intramuscular, intradermal, "piggy-back" IVs, and subcutaneous routes. (5) Maintains currency of pharmacology and current drug therapy. (6) Uses identification precautions to ensure correct medications are administered to specified patients. (7) Reports and records facts about patient's progress. (8) Reinforces instructions, previously given by nurse and/or doctor, which provide information for self care and follow-up. (A) Performs a variety of diagnostic support duties using knowledge of nursing principles, pharmacology, and insertion techniques; precautions, techniques, and principles of infection control; and skill in observing and recognizing the need for deviations. Using such knowledge and skill, employee prepares patients for and administers medications through several routes; prepares instruments and trays; drapes and positions patients; collects specimens; takes and records vital signs; draws blood; and assists in lumbar punctures, liver biopsies, and bone marrow examinations. Employee plans and carries out assignments independently in accordance with previous training, instructions, accepted nursing practices, and patient care plans. Reports completed work in the tour report for the on-coming tour. (1) Gives enemas and irrigates bladder. (2) Collects specimens. (3) Assists in diagnostic examinations such as lumbar punctures, ect. (4) Draws blood. (5) Prepares exam and treatment rooms, as required; prepares instruments and trays; and drapes and positions patients. (6) Takes and records vital signs. (7) Administers medications through several routes and observes for desired action and adverse reactions. (A) Assists physicians and/or performs a range of specialized and therapeutic procedures using knowledge of nursing principles, EKG monitoring functions, insertion techniques, aseptic techniques, infection control, and pharmacology; and skill in the use of monitors and related equipment. Using such knowledge and skill, employee applies hot and cold packs; gives enemas; administers intravenous fluids, monitors and regulates their flow; inserts gastric tubes; cares for patients in isolation; sets up and operates auxiliary equipment; changes dressing; performs and monitors EKGs, suctioning, bladder catheterization; etcetera. (1) Sets up and operates auxiliary equipment. (2)Performs EKGs, bladder catheterizations, and endotracheal suctioning, etcetera. (3) Assists in insertion of Swan-ganz catheters. (4) Monitors the patient's EKG and notifies physician of arrhythmia. (5) Changes aseptic dressing. (6) Initiates, monitors, and discontinues intravenous fluids. (7) Initiates IV therapy. (8) Draws blood specimens to include venous punctures. (9) Charts results. (10) Changes bandages and dressings and reports drainage to nurse. (11) Positions and stabilizes patients and changes positions of patients as needed during examination/procedure. (12) Inserts nasal gastric tubes. (A) Performs emergency procedures in the care of critically ill patients using knowledge of nursing principles, EKG monitor functions, pharmacology, and insertion techniques; skill in using monitors and related equipment for intensive care and observation; observing and recognizing the need for deviations; and observing and identifying patient's physical and emotional problems. Using such knowledge and skill, employee recognizes emergencies and functions calmly and efficiently in accordance with emergency protocols; supplies nurses and doctors with crash cart; recognizes life-threatening situations; takes appropriate action or assists professional health care providers in taking emergency action; updates patient's charts; etcetera. (1) Follows emergency protocols, e.g., natural disasters and security threats. (2) Attends "emergency procedures" training as required. (3) Demonstrates uses of emergency equipment. (4) Obtains crash carts when needed. (5) Recognizes life-threatening conditions and performs or assists in resuscitation procedures in cardiac or respiratory arrest. (6) Observes and keeps alert to information displayed on cardiac monitors. (7) When needed, takes emergency action, e.g., hooking up defibrillator or oxygen mask and calls the nurse or physician. (8) Closely observes respiration; maintains and facilities ventilation. (9) Observes and reports to the nurse signs of dyspnea, cyanosis, anxiety, bleeding through or around the tubes, ect. (10) Administers prescribed medications and observes patient for desired action and adverse reaction. (A) Conducts patient assessment including observation, documentation, interpretation of changes, etcetera, using knowledge of nursing principles, EKG functions, and pharmacology; skill in use of monitors and related equipment; recognizing deviations from normal; and observing and identifying physical and emotional problems. Using such knowledge and skill, employee recognizes subtle changes in conditions, interprets those changes, and unusual conditions and informs professional staff of any irregularities; updates patient care plans in accordance with nursing care protocols; observes and documents all pertinent data regarding the physical and emotional status of patients; documents and modifies the patient's chart based on observed subtle changes in the patient's conditions; closely observes monitors and related equipment; etcetera. (1) Observes patients and documents all pertinent data regarding the physical and emotional status of patients. (2) Recognizes subtle changes in conditions, interprets those changes, and determines the appropriate course of action. (3) Observes and interprets cardiac monitor patterns. (4) Observes patients post procedures for complications, e.g., hemorrhage and excessive nausea. (5) Updates patient's care plan in accordance with nursing care protocols. (6) Documents and modifies the patient's chart based on observed subtle changes in the patient's condition. (7) Reports unusual conditions and informs professional staff of any irregularities. (8) Administers prescribed medications, observe for desired action and adverse reactions, and responds appropriately. (9) Closely observes monitors and related equipment to ensure provision of complete observation to patients. (10) Monitors EKG equipment for signs of arryhythmia. (A) Trains and assists with teaching and training as needed using knowledge of nursing principles, pharmacology, EKG functions, insertion techniques, universal precautions, principles of infection control, and human behavior; skill in use of monitors and equipment; recognizing deviations from normal; and observing and identifying the patient's physical and emotional problems. Using such knowledge and skill, employee provides teaching and training to newly assigned personnel; teaches and notifies patients of necessary preparation and medication to be administered prior to treatment; participates in development and implementation of nursing care plans; documents instructions provided and patient's responses; participates in patient/family education, individualized patient teaching; etcetera. (1) Assists in skills upgrade training. (2) Identifies and explains use of specialized equipment and supplies. (3) Provides and receives in-service training. (4) May instruct patient/family on home care, medication, and treatment prescribed by the physician. (5) Participates in the development and implementation of a nursing care plan. (6) Utilizes visual aids and demonstration techniques to facilitate learning. (7) Documents instruction provided and patient's response. KNOWLEDGE AND EXPERIENCE REQUIRED: Comprehensive knowledge of and skill sufficient to understand practical nursing principles, practices, and procedures; patient disease entities; patient care plans; and medical materials and supplies for the purpose of carrying out the nursing care for a selected patient load of critically ill patients. Position requires successful completion of a state-approved written examination and a current license to practice in a State or Territory of the United States or the District of Columbia. Knowledge of EKG monitors functions to observe monitor for signs of arrhythmia and to assess monitor patterns and, if needed, to immediately start resuscitation measures. Knowledge of and skill sufficient to recognize deviations from normal and to warrant immediate modification of the patient care plans with delayed notification of the nurse for concurrence in the modification of the plan. Practical knowledge of pharmacology and skill sufficient to administer prescribed medication and observe for the desired action. Dosage and adverse reactions of the medications, and to respond to any ensuing complications. Practical knowledge of and skill to observe and identify the patient's physical and emotional problems relative to nursing care, medications, and equipment assisted care, to assess and develop patient care plans which meet the patient's needs. Knowledge of insertion techniques and protective measures necessary for arterial lines to ensure sage utilization of these lines. Knowledge of universal precautions, aseptic techniques, and principles of infection control to prevent cross-contamination and protect self, staff, and patients from unnecessary exposure to infectious agents. Knowledge of and skill in the sue of monitors and equipment necessary for intensive care to provide complete observation and care to patients in all critical stages of recovery. Knowledge of human behavior and skill sufficient to understand motivations and reactions stress for the purpose of promoting interpersonal relations with patients and family members. SUPERVISION: The Contractor works under the supervision of the Director of Nursing, Crow/Northern Cheyenne Indian Hospital, Crow Service Unit, Crow Agency, Montana. The Director of Nursing or supervisory clinical nurse in charge provides general instructions regarding assignment of duties. Specific instructions are given only in unusual or unfamiliar situations. The Contractor uses initiative in completing nursing care assignments independently in accordance with previous training, instructions, policies, accepted nursing practices, and the patient care plans. Finished work is subject to review for procedural accuracy, technical competence, appropriateness, and conformity to policy and nursing requirements. Unusual developments are referred to the nurse in charge or the nurse supervisor. SUPERVISOR: Ella Richards, Director of Nursing. GUIDELINES: Guidelines are available in the form of written instructions, procedures, manuals, and hospital regulations. Reference to written guidelines is rarely necessary. Other guidelines are the change of shift reports, patient care plans, and the patient's medical history. The Contractor varies the order and sequence of assigned procedures based on the patient's condition and uses judgment in selecting the most appropriate application. COMPLEXITY: The nursing care assignments involve an understanding of systemic review and analysis of the patient/nursing history and the patient care plan, so that nursing care is tailored to the patient's needs. Close concentration during the shift is required to recognize and respond to deviations from the norm so that appropriate care may be given immediately. SCOPE AND EFFECT: The scope of the nursing provided by the Contractor involves an understanding of the patient care plan and medical history, the nature of illnesses or diseases, and the standards established by the nursing care program. The work affects the attitude of patients and the accuracy and acceptability of further nursing services. PERSONAL CONTACTS: Contacts are with patients, nurses, doctors, support personnel in the medical facility, and family members. PURPOSE OF CONTACTS: Contacts are to provide necessary and appropriate nursing care and to motivate patients to accept the care and to learn self care to facilitate timely discharge. Contacts with nurses and Medical Officers to obtain timely information to plan, coordinate, and carry out a patient care plan, to receive instructions concerning diagnostic procedures, or to report emergency modifications to the patient care plan that were found to be necessary under the circumstances. Contacts with family members are to motivate them to accept the patient's illness. PHYSICAL DEMANDS: Work requires long periods of regular and recurring standing walking with regular and recurring bending, stooping, lifting, and positioning patients. WORK ENVIRONMENT: Work involves risks of regular and recurring exposure to infection and contagious diseases. May be required to use protective clothing of gear. GOVERNMENT FURNISHED PROPERTY: The Indian Health Service shall provide all necessary equipment and supplies. The Crow Service Unit will be responsible for getting the Contractor access and clearance to all computer services necessary to carry out his/her duties. COMPUTER SECURITY: Pursuant to the Federal Information Security Management Act of 2002 (FISMA), the contractor will be required to complete a course in Computer Security Awareness Training (CSAT). This training must be completed annually by all employees including all contractors, volunteers, students, and summer externs. The Contractor will be required to comply with the Federal Information Processing Standards Publication (FIPS PUB) Number 201, "Personal Identity Verification of Federal Employees and Contractors" and the associated Office of Management and Budget (OMB) implementation guidance for personal identity verification for all affected contractor and subcontractor personnel. SPECIAL CONTRACT REQUIREMENTS: Contractors cannot serve as expert witnesses in any suit against the Federal Government. Many of the IHS patients receiving services may only speak a native language and/or reside on a Native American Reservation, therefore, the Contractor must demonstrate sensitivity to cross-cultural and language differences. The Privacy Act of 1974 mandates that the Contractor maintain complete confidentiality of all administrative, medical and personnel records, and all other pertinent information that comes to his/her attention or knowledge. The Privacy Act carries both civil and criminal penalties for unlawful disclosure of records. Violation of such confidentiality shall be cause for adverse action. The IHS shall provide training on the Freedom of Information Act and the Privacy Act. All IHS regulations and policies applicable to these Acts shall be enforced. The Contractor shall comply with IHS facility infection control and safety procedures, practices, and standards. Federal Tort Claims Act coverage for medical related claims is extended to the individual providing LPN nursing services. However, the services must have been performed within the scope of the personal services contract. REPORTING REQUIREMENTS: The Contractor shall provide the Contracting Officer with evidence that payment of employment taxes has been made 15 days after each quarter. PRO-CHILDREN ACT OF 1994: The Contractor certifies that it will comply with the provisions of Public Law 103-227, Pro-Children Act of 1994, which imposes restrictions on smoking where federally funded children's services are provided. CHILD CARE NATIONAL AGENCY CHECK AND INVESTIGATION (CNACI). A CNACI must be completed for all Indian Health Service (IHS) contractor personnel within the Billings Area. Public Law (P.L.) 101-630, Indian Child Protection and Family Violence Prevention Act and P.L. 101-647, Crime Control Act of 1990, require the IHS to conduct a character and criminal history background investigation on all contractors performing services in IHS facilities. The character and background investigations will be conducted by the Crow Service Unit. PERIOD OF PERFORMANCE: October 1, 2010 through September 30, 2011. CONTRACTING OFFICER AUTHORITY: Authority to negotiate changes in the terms, conditions or amounts cited in this contract is reserved for the Contracting Officer. PROJECT OFFICER: The project officer shall be responsible for: (1) Monitoring the Contractors technical progress, including surveillance and assessment of performance and recommending technical changes; (2) Interpreting the Statement of Work; (3) Technical evaluation as required; (4) Technical inspections and acceptance; and (5) Assisting the Contractor in the resolution of technical problems encountered during performance of this contract. INVOICE SUBMISSION AND PAYMENT: The Contractor shall submit its invoice to the Supervisor at the Crow Service Unit, PHS Indian Hospital, P.O. Box 9, Crow Agency, Montana. The Contractor agrees to include the following information on each invoice: (1) Contractor's name, address and telephone number; (2) Contract Number; (3) Invoice number and date; (4) Cost or price; (5) Dates of Service including the number of hours worked; and (6) Remit to address. The Billings Area Financial Management Branch, P.O. Box 36600, Billings, Montana 59107, shall make payment. PROVISIONS AND CLAUSES: The following provisions and clauses apply to this acquisition. The FAR provision "52.212-1 Instructions to Offerors Commercial Items", and "52.212-3 Offeror Representations and Certifications - Commercial Items" are incorporated by reference. The provision at 52.212-2 applies to this acquisition and is provided in full text. FAR 52.212-2 EVALUATION - COMMERCIAL ITEMS (JAN 1999): (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. THE CONTRACTOR SHALL PROVIDE EVIDENCE OF, OR SUBMIT A WRITTEN RESPONSE TO, THE FOLLOWING TECHNICAL EVALUATION FACTORS: The following factors shall be used to evaluate offers: (1) Professional Licensure. 40 Points. Offerors must provide evidence of current unrestricted State licenses for each registered nurse; (2) Resume. 30 Points. Resumes must include information relating to: (a) Professional Education; (b) Certifications; and (c) Previous jobs; and (3) Past Performance. 30 POINTS. The offeror must demonstrate its record of successful performance in past contracts and/or jobs, Government and/or commercial. Each offeror will be evaluated on its performance under existing and prior contracts/jobs. The offeror must list at least three contracts/jobs and include the following information. (1) Name of Government agency/Company; (2) Contract number, if applicable; (3) Dates of Service/Employment; (4) Total contract value/Hourly wage; (5) Description of contract work/Job duties; (6) Contracting Officer/Company Manager and telephone number; (7) Program Manager and telephone number, if applicable. Technical and past performance, when combined, are considered approximately equal. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
