Description
THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c)(1), set forth in Federal Acquisition Regulation 6.302-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." United States Central Command (USCENTCOM), 7115 S.Boundary Blvd., Tampa, FL 33621, requires one year renewal of Netex extended annual right to use (RTU) maintenance renewal for HyperIP to support the Netex HyperIP software/ appliance which accelerates data replication already deployed on the United States Central Command J6 (USCENTCOM CCJ6) SIPRNet. The 6th Contracting Squadron intends to make an award to Networtk Executive Software, Inc. 6420 Sycamore Lane, Suite 300, Maple Grove, MN 55369. Interested parties may e-mail laverne.astroth@macdill.af.mil or fax 813-828-5111, Attn: LaVerne Astroth, not later than Tuesday, August 31, 2010, 10:00 a.m. EST. Per FAR Part 5.207-13(e) Fed Biz Ops Numbered Note 22 applies and is modified to read: The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within five days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. DEMONSTRATION THAT THE CONTRACTORS UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) USCENTCOM CCJ6 currently operates the NetEx HyperIP appliances and software as part of its COOP solution. HyperIP reduces the amount of time and bandwidth it takes to replicate data from USCENTCOM Tampa, FL to its COOP site in Qatar. USCENTCOM has already purchased three pairs of appliances from NetEx to support its COOP requirements. NetEx is the designer, manufacturer and sole source provider of the HyperIP solution. NetEx products must be maintained by NetEx to prevent voiding the warranty. USCENTCOM currently utilizes EMC for its storage area network (SAN) solution. NetEx HyperIP has been qualified, and recommended, by EMC E-Lab for interoperability with the EMC SAN solutions. NetEx has all the required facilities, design schematics, technical expertise, and past experience to continue providing the US Government with an end to end data replication solution. It is compatible with existing government owned equipment and allows the mission to continue operating at maximum efficiency within the time parameters required. NetEx develops and maufactures proprietary software and equipment and is the only company who can provide the required supplies and services. NetEx's Distributors/Resellers do not sell the renewal licenses for the appliance HyperIP's that were installed at USCENTCOM in 2006. They have been renewed directly with NetEx in 2007, 2008, and 2009. These licenses were originally licensed from NetEx and this "Year 4" renewal is available only through NetEx. NetEx's distributor/reseller network sells new licenses, including renewals to new licenses they have sold, for the virtual HyperIP product (software only - not appliance based).
