Description
The National Institutes of Health intends to award a sole source contract to MW Design (MWD) to provide A/E services for Post Design, Bidding, Construction Administration Services and Optional A/E Services for the renovation of NIH Building No. 3 in accordance with the American Recovery and Reinvestment Act of 2009. The contract vehicle for this A/E service is a Firm Fixed Price contract for a three-year period. The total contract award value is anticipated not to exceed $3M. NIH anticipates soliciting and negotiating with only one source under the statutory authority of 41 U.S.C. 253(d)(1)(B) to provide this service to meet mission critical requirements for the following reasons: • MWD team members have recently created the construction documents, were part of the original 2001 documents, completed the LEED design phase submissions and blast analysis and have a unique understanding of the building's proposed systems and solutions. • MWD team members have the professional liability of these documents since they authored and stamped them. • No other group has the knowledge of the design intent that the MWD team developed during the preparation of the documents. The MWD team members, by virtue of being the author of these contract documents, has spent thousands of man hours in their preparation and is the group most familiar with them. • No other A/E is familiar enough with the documents to effectively assist the NIH in the required reprogramming and redesign of the floor plans. • No other architect or engineer could work to administer the construction of these documents and make interpretations of documents stamped by the MWD team without specific authority granted by the professional architects and engineers on the MWD team that stamped the documents. No other architect / engineer would be able to totally accept the liability of these documents. • It would raise legal considerations if the owner of the documents engaged the services of any party other than MW Design to provide A/E construction administration services for this project. • To recompete for these A/E services would require a significant amount of time that would delay the start of construction and the critical ARRA mission. Background The project includes the complete renovation of NIH Building No.3, which is part of the original National Institutes of Health Campus in Bethesda, Maryland. The site is located on the east side of the campus at the corner of Center Drive and South Drive. MWD team members where awarded a contract for the renovation of NIH Building No. 3, following the successful renovation of NIH Building No. 2. Utilizing the Building No. 2 experience, member of MWD completed the design of NIH Building No. 3 in 2001. In 2009, MWD completed the revalidation of the 2001 documents including upgrade to the current NIH requirements, codes, standadrds and executive orders. Various complex systems designed include variable flow, tertiary, chilled water; steam to hot water converters and variable flow pumping systems. The airside system design includes a custom built, central station, variable flow air handling unit and VAV terminals with hot water terminal reheat. The electrical design includes new medium voltage service, network transformers, network protectors, double-ended switchgear and feeder bus duct distribution panels and branch circuitry coordinated with systems furniture. The project also included the design of telephone and LAN distribution systems in accordance with The NIH requirements. The project will have LEED Silver certification and comply with the latest federal security requirements. Scope The scope of services to be performed by MWD for this project includes the following: 1. MWD will provide A/E services for Post Design, Bidding, Construction Administration Services and Optional A/E Services to assist the NIH Project Officer in the oversight of the performance of the project. In accordance with the requirements of the American Recovery and Reinvestment Act (ARRA) MWD will ensure compliance with the ARRA's requirement for Energy Efficient Buildings and Sustainable Design and Construction that Optimize Energy Performance, employ integrated design principles and controls. 2. As may be required, provide reprogram and redesign services to accommodate NIH changes in some user assignments. 3. Advisory Services may be provided in the following areas: Activation/occupancy phase; planning, scoping, scheduling, and specifying, support for the fit out of new FFE as well as relocation of existing personnel and equipment. This notice of intent is not request for proposal. A determination to compete this procurement based on a response to this notice is solely within the discretion of the Government. The NAICS Code for this requirement is 541330. Interested parties who believe they possess the capability to satisfy this requirement should submit a capability statement demonstrating their ability to meet this requirement and a letter from their insurance company stated that any liability for the designs of MWD will be covered. All responses must be sent in writing to Beverly Johnson, Senior Contract Specialist, no later than 2:00 p.m. Eastern Time, Monday, September 13, 2010.
