DEPARTMENT OF VETERANS AFFAIRS VISN 19 Rocky Mountain Network Consolidated Contracting Center 4100 E. Mississippi Avenue, Suite 610 Glendale, CO 90256 JUSTIFICATION AND APPROVAL TO PROCURE USING OTHER THAN FULL AND OPEN COMPETITION Upon the basis of the following justification, the use of other than full and open competition for the proposed contractual action is hereby approved pursuant to the authority of 41 U.S.C. 253(c)(1), 10 U.S.C. 2304(c)(1) and FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. JUSTIFICATION 1. Identification of Agency and Contracting Activity. The VISN 19 Rocky Mountain Network Consolidated Contracting Center, 4100 E. Mississippi Avenue, Suite 1110, Glendale, CO 80246. 2. Nature/description of action. This activity proposes to solicit sole source with Synthes to provide a stainless steel surgical implant hand set. 3. Description of Supplies/Services. This requirement is for a stainless steel surgical implant hand set. 4. Identification of Statutory Authority. The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c)(1), 10 U.S.C. 2304(c)(1) and FAR 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. 5. Demonstration of Contractor's Unique Qualifications. Market research has revealed that Synthes is the only provider of stainless steel surgical instruments, plates and screws used in the fixation of fractures to hands and feet to include metacarpal fractures, carpal bone injury, proximal phalangeal and middle phalangeal fractures. The surgery department at the Denver VA Hospital currently use stainless steel implants. The use of other metallic, i.e. titanium, implants is not acceptable at this time. A sources sought notice was published in the Federal Business Opportunities (FBO) web site for 15 days resulting in one response from Depuy. The CO inquired of the respondent if the Depuy hand set was stainless steel or titanium and the Depuy representative stated that the hand set they offered was made from titanium. By procuring the product from Synthes, the VA is assured of maintaining continuity of services. 6. Government Point of Entry (GPE) Announcement/Potential Sources. This acquisition will be announced in the GPE on August 18, 2010. It is expected that Synthes will be the only offeror responding to the solicitation. 7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined that the anticipated cost to the Government will be fair and reasonable based on the price list currently used to procure similar products. 8. Description of Market Survey. A market survey was conducted and revealed two other manufactures that produced surgical implant sets. Depuy and Ostheomed. Both firms offered surgical hand sets made of titanium and did not offer stainless steel surgical hand sets. 9. Any Other Supporting Data. There are no other factors supporting the use of other than full and open competition. 10. Listing of Interested Sources. Eastern Colorado Health Care System 1055 Clermont Street Denver, CO 80220 11. Actions Taken to Remove Barriers to Competition. As this is not a recurring acquisition, there are no actions that may be taken to overcome barriers to acquisition. Certifications.
