Description
DEPARTMENT OF THE NAVY NAVAL MEDICAL LOGISTICS COMMAND BRAND NAME ONLY JUSTIFICATION 1.) Identification of the agency and the contracting activity. This justification is executed by the Naval Medical Logistics Command, Fort Detrick, MD, on behalf of the Navy to meet Fleet requirements. 2.) Nature and/or description of the action Negotiations will be conducted on other than full and open competitive basis with Foremost Equipment, 320 North Washington Street STE 112, Rochester, NY 14625, (866)463-3522 or any authorized distributors of 326M, Suction Apparatus, Surgical Name Brand Only product. 3.) Description of the supplies/services required. The US Navy has a requirement for multiple 326M, Suction Apparatus, Surgical. 4.) Identification of the statutory exceptions permitting other than full and open competition. The proposed requirement is to acquire Suction Apparatus, Surgical. In accordance with FAR 13.106(b), this item is peculiar to one manufacturer. Elements which were considered: reliability, maintainability and maintenance (preventive, predictive and corrective) planning; spare part support while acknowledging the ship does not have an infinite amount of space to keep a wide range of spare parts to accommodate many different pieces of equipment; test equipment to support the equipment they have aboard; training and training support along with technical data and publications considering the ship has limited space to store literature and the ship’s crew limited training on certain pieces of equipment; limited facilities to store and/or work on equipment and proper operation of the equipment to fully function without modification and error while installed on a navy ship or in a wet environment. All elements are developed in coordination with the system engineering effort and with each other. Fit, form and function are also considered and sometimes required between other elements in order to acquire a system that is affordable, operable, supportable, sustainable, transportable, and environmentally sound. The use of Brand Name Only is essential to the Government's requirement, thereby precluding consideration of products manufactured by any other company. 5.)Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited. The US Navy has a requirement for multiple 326M, Suction Apparatus, Surgical in accordance with their Authorized Medical Allowance List (AMAL). The fleet needs a system which allows for continuous use without interruption when switching between AC/DC power, includes a rechargeable battery and an air worthiness release. Battery operation the unit must function at two hours minimum and the total battery recharge time must not exceed 16 hours. The vacuum range must be adjustable between 0-500 mmHg in continuous mode and between 0-200 mmHg in intermittent mode. The free air flow must be at a minimum of 25 LPM in continuous and 5-7 LPM in intermittent. The system also has the following additional functionality: The system provides a wide variety of components which can be used across many different specialties and procedures such as Oropharyngeal, tracheal, wound drainage and abdominal or thoracic decompression procedures-short or long term use. The pump mechanism consists of an ultra-lite diaphragm design. The unit must be able to operate in temperatures ranging between -5 °F and 120 °F. In compliance with the Navy’s initiative to enhance Integrated Logistic Support (ILS) for shipboard applications and the Navy’s 3-M Manual, OPNAVINST 4790.4E, the only technically acceptable item which has (ILS) support is the 326M, Suction Apparatus, Surgical. The ships already have a stockage level of consumables and durables which directly interface to an already existing stock of Impact 326M suction apparatus. It is essential that the human factors interface between these devices be identical and any variation inserts a probability of an operator error, which could easily result in unsuccessful outcomes. 6.) Description of efforts made to ensure that offers are solicited from as many potential sources as practicable. The Market Survey included a review of the ECRI Database and several search engines on the internet. 7.) Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. It is anticipated that the negotiated contract price will reflect a discount Foremost Equipment commercial price list and will be determined fair and reasonable. 8.) Description of the market survey conducted and the results, or a statement of the reasons a market survey was not conducted. A market survey was conducted using several sources including the ECRI Database. It also included a search of the Internet using Google, Yahoo, Lycos and Alta Vista. (Search words: 326M, Suction Apparatus, Surgical). Possible sources such as Aria Medical and Impact were identified. Each of these sources was investigated and only one device meets the requirements. 9.) Other facts supporting the use of other than full and open competition None 10.) Listing of Sources, if any, that expressed, in writing, an interest in the acquisition. None. 11.) Statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. None 12.) Statement of Delivery Requirements. Product should be delivered by the close of the fourth quarter fiscal year 2010. 13.) Reference to the approved Acquisition Plan (AP). This acquisition does not meet the criteria and thresholds established by DFARS 7.103 requiring an Acquisition Plan. 14.) Documentation for spare and repair parts acquisitions. Neither spare nor repair parts are part of this acquisition.
