- Subject: Laboratory Equipment Solicitation Number: FDA1070865 PART 1 - Description THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN FAR SUBPART 12.6-STREAMLINED PROCEDURES FOR EVALUATION AND SOLICITATION FOR COMMERCIAL ITEMS-AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTATIONS ARE BEING REQUESTED, AND A WRITTEN SOLICITATION DOCUMENT WILL NOT BE ISSUED. THIS SOLICITATION IS BEING ISSUED USING SIMPLIFIED ACQUISITION PROCEDURES 13.5. This solicitation is a Request for Quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 05-41. The associated North American Industrial Classification System (NAICS) code for this procurement is 325413. This is an RFQ for laboratory equipment. The requirement is a 100% total small business set-aside. Brand name or equal as a result of this combined synopsis/solicitation that will include the terms and conditions that are set in PART 3. PART 2 - SUPPLIES OR SERVICES AND PRICES/COSTS 2. DESCRIPTION OF SUPPLIES & SERVICES The FDA has a requirement for an estimated twelve Salmonella Kits per year for the next five years. These kits will be used as a way of linking disease in humans to specific foods during foodborne disease outbreaks. 2.1. Contract Type 2.1.1. BACKGROUND AND OBJECTIVES The Division of Microbiology in the Office of Regulatory Science has a DSM PremiTest Salmonella serotyping system from DSM. The PremiTest for Salmonella is an automated PCR-based serotyping system for Salmonella. The genus Salmonella is divided into 2 species: Salmonella enterica and Salmonella bongori. These 2 species are further divided into 2500+ serotypes: approximately 2560 Salmonella serotypes within S. enterica and 22 within S. bongori. FDA uses serotype information as a way of linking disease in humans to specific foods during foodborne disease outbreaks. In cases where a culture has gone "rough", traditional serotyping is impossible. The PremiTest can serotype pure isolates in a few of hours, thus reducing costs and accelerating the epidemiological process significantly so that outbreak related foods can be quickly removed from the US food supply. Box#1 shall be stored at room temperature (20 to 25 degrees Celsius); contents shall include: 1) 10-003, Array Tubes, 6 bags of each 4 tubes (total 24). 2) 9-0007, Detection Buffer, 1 bottle 80 ml. 3) 9-0015, Lysis Buffer, 1 bottle 10 ml. 4) 9-0014, Staining Solution, 1 bottle 5 ml. 5) 9-0020, Colony Samplers, 1 vial sterile colony samplers. • Box#2 shall be stored at -/-20 Degrees Celsius; Contents shall include: 1) 9-0022, Blue tray, 24 x3 tubes, 2.5 ul reagent/tube. 2) 9-0021, Solution A, 1 tube (amber cap) 600 ul. 3) 9-0003, Solution B1, 1 tube (purple cap) 1600 ul. 4) 9-0004, Solution B2, 1 tube (blue cap) 120 ul. 5) 9-0005, Solution C1, 1 tube (yellow cap) 1600 ul. 6) 9-0006, Solution C2, 1 tube (red cap) 120 ul. 7) 9-0027, Conjugate, 1 tube (green cap) 100 ul. 3.1.1.2 Performance: • Kits shall be compatible with current FDA Array Tube reader already in use. The salient characteristics of the Array Tube Reader are described below. 3.2.1 Salient Characteristics of Compatible piece of Equipment: • The Array Tube Reader (ATR) is the camera/reader used to make a picture of the micro array tube at the end of the detection phase. It detects the presence/absence pattern of DNA spots to determine whether the isolates are Salmonella---and if yes, which serotype. PART 4 - PACKING, MARKING AND SHIPPING 4. All deliverables required under this contract shall be packaged, marked and shipped in accordance with Government specifications. At a minimum, all deliverables shall be marked with the contract number and contractor name. 4.1. The Contractor shall guarantee that all required materials shall be delivered in immediate usable and acceptable condition. PART 5 - INSPECTION AND ACCEPTANCE 5. The Contracting Officer's Technical Representative (COTR) will perform inspection and acceptance of materials and services to be provided. 5.1. For the purpose of this PART, (COTR - to be determined upon contract award) is the authorized representative of the Contracting Officer. 5.2. Inspection and acceptance will be performed at the locations identified in 6.1.3. Acceptance is communicated in writing unless otherwise indicated in writing by the Contracting Officer or COTR within 30 days of receipt. 5.2.1. System installation by authorized service engineer at FDA site. The installer of the laboratory instrument shall test the equipment to ensure that it is fully functional before FDA accepts the delivery. 5.3. This contract incorporates the following clause, 52.246-2 Inspection of Supplies-Fixed Price (Aug 1996) by reference, with the same force and effect as if it was given in full text. Upon request, the Contracting Officer will make its full text available. PART 6 - DELIVERIES OR PERFORMANCE 6. DELIVERIES 6.1.1. Satisfactory performance of this contract shall be deemed to occur upon performance of the work described in the Statement of Work in PART 3 of this contract and upon delivery and acceptance by the Contracting Officer, or the COTR, of the services, plans and reports required at the dates specified within PART 3 of this contract. 6.1.2. Deliveries required by the contractor shall be made F.O.B. destination to the address/addressee listed below: 6.1.3. DELIVERY POINT: FDA 5100 Paint Branch Pkwy College Park, Maryland 20740 6.1.4. Unless otherwise specified, deliveries shall be made to the Delivery Point specified above, Monday through Friday (excluding Federal Holidays, see PART 8) between the hours of 8:30 a.m. and 5:30 p.m. EASTERN TIME only. Supplies or services scheduled for delivery on a Federal holiday shall be made the next business day. PART 7 - CONTRACT ADMINISTRATION DATA 7. CONTRACTING OFFICERS TECHNICAL REPRESENTATIVE (COTR) 7.1. The following COTR will represent the Government for the purpose of this contract: (To Be Determined Upon Contract Award) 7.1.1. The COTR is responsible for: (1) monitoring the Contractor's technical progress, including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements; (2) interpreting the Statement of Work and any other technical performance requirements; (3) performing technical evaluation as required; (4) performing technical inspections and acceptances required by this contract; and (5) assisting in the resolution of technical problems encountered during performance. 7.1.2. The Contracting Officer is the only person with authority to act as agent of the Government under this contract. Only the Contracting Officer has authority to: (1) direct or negotiate any changes in the RFQ; (2) modify or extend the period of performance; (3) change the delivery schedule; (4) authorize reimbursement to the Contractor any costs incurred during the performance of this contract; or (5) otherwise change any terms and conditions of this contract. 7.1.3. INVOICE SUBMISSION 7.2.1. FAR CLAUSES BY FULL TEXT 52.216-18, Ordering (Oct 1995) (a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from 8/1/10 through 7/31/15. (b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control. (c) If mailed, a delivery order or task order is considered "issued" when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule. 52.216-19, Order Limitations (Oct 1995) (a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than 3 Kits, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract. (b) Maximum order. The Contractor is not obligated to honor- (1) Any order for a single item in excess of 12 each per year; (2) Any order for a combination of items in excess of 12 each per year; or (3) A series of orders from the same ordering office within 10 days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section. (c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section. (d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 5 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source. 52.216-22, Indefinite Quantity (Oct 1995) (a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract. (b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum." (c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations. (d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after _7/31/15. 52.217-9, Option to Extend the Term of the Contract (Mar 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 (years). 52.212-3 Offeror Representations and Certifications-Commercial Items. In addition, this evaluation will include an assessment of the Offeror's proposal for completeness, realism, reasonableness and risk. 11.3.2. EVALUATION AWARD CRITERIA: Award will be made to the party whose quote offers the best value to the Government, technical, past performance and price. The Government may award this contract to other than the lowest price technically acceptable quote.
