- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: Department of Veterans Affairs, VISN 20, Portland VA Medical Center. 2.Description of Action: This is a request for other than full and open competition for the procurement of a painting, repairs and non recurring maintenance work IDIQ with one base year and four option years. This contract will be with KOLA Inc., a SDVOSB, HUBzone, 8a, SDB, Native American owned small business concern. 3.Description of Supplies or Services:. The work will include upgrades and repairs at the Portland VA Medical Center including the Vancouver, WA campus and related locations including Camp Rilea in Oregon. Work includes painting, window replacement, and non recurring maintenance. 4.Statutory Authority: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; ( ) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement (X) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5.Validity of Use of Statutory Authority: Authority found under Public Law 109-461, and VA Acquisition Circular 2008-01, 819.7007 Sole Source awards to service-disabled veteran-owned small business concerns. (a) A contracting officer may award contracts to SDVOSB concerns on a sole source basis provided: (1) The anticipated award price of the contract (including options) will not exceed $5 million; (2) The requirement is synopsized in accordance with FAR part 5; (3) The SDVOSB concern has been determined to be a responsible contractor with respect to performance; and (4) Award can be made at a fair and reasonable price. (b) The contracting officer's determination whether to make a sole source award is a business decision wholly within the discretion of the contracting officer "Award is will be on a not to exceed $4.9 million over a five year period. "This action will be posted 14 days after award in accordance with Defense Authorization Act dated 2008 "The SDVOSB contractor has been determined to be responsible "The price is fair and reasonable based on comparison to the IGE and pricing received from previous solicitations "The contracting officer has determined that it is in the best interest of the Government to award a sole source contract to KOLA Construction. There will be a cost savings and minimum disruption to patient care. 6.Actions to Promote Competition: This IDIQ will be used on a limited basis for individual task orders for non recurring maintenance. It will not be used for ARRA projects. It will not be used on minors or larger construction projects. Competition among SDVOSBs will still be used on the vast majority of construction projects for the Portland VA Medical Center. Option years will be exercised based on satisfactory performance. 7.Determination of Fair and Reasonable Price: The total value of the IDIQ over a five year period will not exceed $4.9 million. Price reasonableness per task order will be established via RS means and comparison with the market prices and independent government estimates. 8.Market Survey (FAR 10): Efforts were made to locate an SDVOSB in the Portland area capable of performing this work. KOLA Inc. is the only company in Vetbiz that is SDVOSB, 8a, SDB, and HUBzone certified. They have extensive experience working at the Portland VA Medical Center and are knowledgeable about the center, infection control and working in a hospital setting. Their Dun and Bradstreet Rating is low risk and they are a responsible company. KOLA employees and management have already completed their security background checks and have current badges to work in the hospital.
