Description
Synopsis: Insurers, agencies, and attorneys have significant responsibilities under the Medicare Secondary Payer (MSP) provisions of the Social Security Act Section 1862(b) [42 U.S.C. 1395y] to protect Medicare's interests. Medicare does not pay for an individual's Workers Compensation-related medical services and/or prescription drugs when the individual receives a Workers Compensation(WC) settlement that includes funds for future medical and/or prescription drug expenses. Therefore, it is highly critical that the individual consider Medicare's interests at the time of settlement. For this reason, CMS recommends that parties to a WC settlement set aside funds, known as a Workers' Compensation Medicare Set-Aside Arrangement or "WCMSA," for all future medical and/or prescription drug expenses related to the WC injury or illness/disease that would otherwise be reimbursable by Medicare. The Centers for Medicare & Medicaid Services Office of Financial services Group (FSG) is seeking a qualified 8(a) contractor to perform Medicare Set-Aside Arrangement work, acting in the role of the Workers Compensation Review Contractor (WCRC). The WCRC shall, IAW CMS guidelines, and acting as an impartial entity, evaluate WCMSA proposals, and independently project the future medical costs, including prescription drugs, related to the WC injury, illness, or disease, that would be otherwise reimbursable by Medicare. The WCRC shall utilize and work within, the CMS-developed and owned Workers Comp Case Control System (WCCCS), an electronic distributed case and correspondence database system, on a distributed basis from the New York host server; as well as the Redbook prescription pricing tool. The WCRC shall, upon reviewing each complete WCMSA proposal (case), recommend the WCMSA dollar amount for each proposal, and which is subsequently reviewed and approved/rejected by CMS final determination. In addition, the WCRC shall be required to perform outreach, and educational activities, and contribute technical input, and workers compensation technical information to CMS. The WCRC shall track, capture, and report metrics each month. For staffing and other resource considerations, the contractor shall anticipate receiving and completing 1750 to 2500 WCMSA proposals per month. All contractor personnel are subject to background investigation, and must pass a criminal background check. There will be four (4) key positions, for which CMS has right of personnel approval. The contract shall have a 2-3 month transition period. A twelve month base period of performance, and four each twelve-month option periods, each option to be exercised individually at the discretion of the Government. This announcement is not a request for proposal (RFP). CMS anticipates release of the Request for Proposal by August 1, 2010. The solicitation will be available on the Federal Business Opportunities (FedBizOps) website. It is anticipated that this contract will be awarded in early March 2011.
