- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Organization: Department of Veterans Affairs, VISN 20, Puget Sound Seattle VA Medical Center 2. Description of Action: This justification for other than full and open competition for Comprehensive BRACHanalysis testing to be performed by Myriad Genetics Laboratory. 3. Description of Supplies or Services: This requirement is for specialized genetic testing for BRACAnalysis - BRAC 1 and BRAC 2 gene analysis for susceptibility to breast and ovarian cancer. There is a history of breast cancer in the patient's family and testing is required for patient's treatment. 4. Statutory Authority: ( X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; (X) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5. Validity of Use of Statutory Authority: IAW FAR 6.302-1 (a)(2) this test is uniquely offered by only one vendor. IAW FAR 6.302-2(a)(2)(b)(2) delay in the award of this requirement will result in specimen decay and inability to perform the test. This delay could result in serious injury to the Government and its ability to service its Veterans. 6. Actions to Promote Competition: IAW FAR 5.202(a)(2) the proposed contract action is urgent and compelling. The requesting service will attempt to utilize mandatory sources of reference laboratories in future acquisitions. The referenced vendor is the only known source for this testing, there is no known secondary source. 7. Determination of Fair and Reasonable Price: The anticipated price to the Government is $ 3,400.00 IAW FAR 13.106-3(a)(2)(ii). Myraid is the only reference laboratory offering this test. Pricing is determined fair and reasonable based on vendor availability. Market Survey (FAR 7.102): Mandatory sources of supply were contacted and do not offer the testing done by Myriad. 9. Other Considerations: No other considerations. 10.
