- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: Department of Veterans Affairs, VISN 18, Southern Arizona VA Healthcare System 2.Description of Action: This is a request for other than full and open competition for the procurement of a construction project to construct an 8,200 SF MRI Suite, Bldg 81 on the Southern Arizona VA Healthcare System campus, project number 678-CSI-102. 3.Description of Supplies or Services: Completely prepare site for building operations, including demolition and removal or existing structures, and furnish labor and materials and perform work for construction of new MRI facility, approximately 8,200 SF as required by specifications and drawing 4.Statutory Authority: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; ( ) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement (X) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5.Validity of Use of Statutory Authority: IAW VAAR 819.7007(a) the contracting officer may award contracts to SDVOSB concerns on a sole source basis provided the anticipated award price will not exceed $5 million; the requirement is synopsized in accordance with FAR part 5 and the SDVOSB has been determined to be a responsible contractor with respect to performance and award can be made at a fair and reasonable price. IAW VAAR 819.7007(b) the contracting officer s determination whether to make a sole source award is a business decision wholly within the discretion of the contracting officer. A determination that only one SDVOSB concern is available to meet the requirement is not required. 6.Actions to Promote Competition: There will be no action taken to increase competition for this acquisition. Upon approval of this J&A, a formal solicitation (Solicitation Number VA-258-10-RP-0094) will be issued in April 2010. 7.Determination of Fair and Reasonable Price: The magnitude of this project is between $2-5 million. The contractor will be required to break down his proposal into line item detail and that will be compared against the independent government furnished cost estimate provided by the Architect and Engineer (A & E). 8.Market Survey (FAR 10): The proposed contractor (Sygnos, Inc of out San Diego, CA) is on the list of SDVOSB potential contractors in CCR. Sygnos, Inc is a SDVOSB construction firm who is technically capable/acceptable for performing general construction projects for SAVAHCS. Sygnos, Inc has presented itself at a capability presentation at this facility, the most recent being April 23, 2009. An inquiry to the Past Performance Information Retrieval System (PPIRS) revealed three previous projects that were all favorable rated. The company has also performed several contracts at other VA facilities. Additionally, the Contracting Officer checked for the contractor s registration on VETBIZ. Additional market research consisted of searching the following various databases: Dun & Bradstreet, CCR.gov, PPIRS, ORCA, and EPLS as well as other debarred web sites. It is in the government s best interest to utilize VAAR 819.7007(a) and pursue a sole-source award to Sygnos, Inc for this requirement. 9.Other Considerations: The selected SDVOSB contractor has been looking for opportunities to develop a better working history with the Southern Arizona VA Healthcare System. They have performed successfully at other locations within VISN 18 as well other VA facilities. A project such as this would be a good opportunity for the VA to expand its contractor base, and potentially test out a new SDVOSB for future projects. 10.Listing of Sources that expressed, in writing, an interest in the acquisition: N/A 11.Statement of Actions to Overcome Barriers to Competition: Not applicable.
