- Modification to pre-solicitation announcement VA-248-10-RP-0478 posted on FBO on 5/28/2010. The Miami VA Health Care System located in Miami, Florida intends to award a bridge sole source Durable Medical Equipment Contract to Bayshore Dura Medical, 7835 NW 148 ST. Miami lakes, Fl 33016. This is Minority Owned Small Business. The NAICS code is 621610. The contract is for a period of six months or until a new contract is awarded. This is just a temporary contract while a 5 year contract is being pursuit in accordance with the pre-solicitation notice listed above. The estimated value of this IDIQ contract is $132,000.00 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval FOR Other Than Full and Open Competition FOR MIAMI VA DME 6 MONTHS IDIQ CONTRACT 1.Contracting Organization: Department of Veterans Affairs, VISN 08, Miami VA Health Care System, Contracting SAO East 8. Contract will be administered by contracting office located in West Palm Beach VA Medical Center. 2.Description of Action: This is a request for other than full and open competition for the procurement Services for delivery, pick up, clean, install, repair, and provide storage for Durable Medical Equipment in support of eligible VA beneficiaries as required by the Miami VA Prosthetics Department. The contract shall be an Indefinite Quantity, Indefinite Service contract (IDIQ). 3.Description of Supplies or Services: VA Medical Center in Miami has the need to acquire the service to provide DME services for delivery, pick up, provide, install, repair, and provide storage for Durable Medical Equipment to eligible VA beneficiaries as required by the Miami VA Prosthetics Department. 4.Statutory Authority: FAR 6.302-2 only one responsible Source and no other supplies or service will satisfy agency requirements. ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; (x) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, a.or Expert Services; ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute; FAR 6.302-5 ( ) (6) National Security; or ( ) (7) Public Interest 5.Validity of Use of Statutory Authority: Substantial duplication of costs to the Government that is not expected to be recovered through competition and unacceptable delays in fulfilling the agency's requirements. Presently the services have being provided by Bayshore Dura Medical Inc. This is a Small Minority Owned small Business that has an established and proven procedure to store, receive, clean and deliver the VA owned DME equipment in their facility to eligible veterans. They have the trained staff, support vehicles, space and knowledge of all functions as required by the Statement of Work and Miami VA Prosthetics Department. To establish a new Vendor, move all the VA property to another location will represent unacceptable delays and unrecoverable costs to the Government. 6.Actions to Promote Competition: A new contract will be sought by advertising it through FBO, requesting that Vendors who wish to compete and participate in fair competition submit their proposal as required by the solicitation for a new 5 year contract. 7.Determination of Fair and Reasonable Price: The anticipated price for this acquisition will be same price as agreed on the previous contract. 8.Market Survey (FAR 10): In accordance with FAR 10.001, market research was conducted by the undersigned Contracting Officer and revealed this type of service is not available under GSA or FSS contract. The Vetbiz and CCR websites were research to see if other Vendors can supply the same services on a competitive basis. A search of Vetbiz website yielded no SDVOSB or VOSB that matched a search of the NAICS 621610 and key word DME. 9.Other Considerations: This contracting requirement is intended to be effective for six months only while a 5 year contract is pursuit and formalized. 10.Listing of Sources that expressed, in writing, an interest in the acquisition: BAYSHORE DURA MEDICAL INC. is a Minority Owned Small Business that would like to continue to supply the VA with this service until a new contract is awarded. 11.Statement of Actions to Overcome Barriers to Competition: A new contract will be sought by advertising it through FBO, requesting that Vendors who wish to compete and participate in fair competition submit their proposal as required by the solicitation for a new 5 year contract. 12.Requirements Certification: I certify that the requirement outlined in this justification is a bonafide need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
