- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition Contracting Organization: Department of Veterans Affairs, VISN 20 Portland VA Medical Center Description of Action: A firm-fixed price Indefinite Delivery Indefinite Quantity contract with economic price adjustments for a Base citing FY 10 funds and three option years. Description of Supplies or Services: a. The services required are to provide trained Neuro-Surgeon specialized physicians to provide the full realm of diagnostic services in support of the PVAMC. Services are per procedure in the Operating Room, Clinic and Resident Supervision with call. 1.Statutory Authority: This requirement was procured under VA Directive 1663 and was sole sourced to an affiliate base on the need to train medical residents. A portion of this workload is covered by a resident clinic requiring academic Neuro-Surgeon oversight. This Directive is based on Public Law 104-262, the Veterans Health Care Eligibility Reform Act of 1996, which expands VA's health care resources sharing authority in Title 38 USC Sections 8151 through 8153 (sharing authority. ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 (X) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 2.Validity of Use of Statutory Authority: This 4-year contract is proposed to be awarded to an affiliated university in accordance with the Enhanced Medical Sharing Agreement, under authority of Veteran Healthcare Reform Act of 1996, Enhance Health Care Resources Sharing Act, Public Law 104-262 (Title 38 U.S.C. 8153) Health Care Resources Contracting - Buying. 3.Actions to Promote Competition: Competition was not promoted. 4.Determination of Fair and Reasonable Price: The price to the Government is estimated to be $98,744.00 for the base period of this contract with an estimated workload of $41,000 for per procedures based on Medicare CPT codes. This price is determined to be fair and reasonable based on salary surveys, Medicare rates, market research of other contracts, and affiliates private pricing. 5.Market Survey (FAR 10): Market research was not performed as competition was ruled out. Competition was ruled out based on the need for academic Neuro-Surgeon to support training of medical residents. 6.Other Considerations: If this requirement was awarded to anyone other than the affiliate, the Medical Center would be unable to support the training of medical residents. Supporting the training of medical residents is a goal of the Department of Veterans Affairs. In accordance with VA Directive 1663, this is justification for sole sourcing this requirement. 7.Listing of Sources that expressed, in writing, an interest in the acquisition: No sources expressed an interest in this acquisition other than the affiliate. 8.Statement of Actions to Overcome Barriers to Competition: The Medical Center would be unable to support the medical training program unless we sole source this requirement to our academic affiliate. 9.Requirements Certification: I certify that the requirement outlined in this justification is a bonafide need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
