- The IDAWY Acquisition Service Center intends to issue a modification (#04) to Northwest Technologies for contract number AG-02NV-C-09-0007 based on the following single source justification. This notice of intent is not a request for competitive quotes or proposals. However, the Government will consider all capability statements received by 3:00pm, July 1, 2010. TELEPHONE INQUIRIES WILL NOT BE ACCEPTED. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements. A determination by the Government not to compete this additional work based upon responses to this notice is solely within the discretion of the Government. SINGLE SOURCE JUSTIFICATION The following document is prepared in accordance with FAR 13 1. A description of supplies of services required to meet the agency's needs (including the estimated value): MODIFICATION TO EXISTING CONTRACT FOR ADDITIONAL EXCAVATION AND SAMPLING/ANLAYSIS DUE TO THE DISCOVERY OF DIOXIN CONTAMINATION IN ORIGNALLY EXCAVATED WASTE PILES. The existing contract is for the remediation of a post & pole treatment site that had undergone a previous contaminated soil removal project in the early 1990's. To obtain liability insurance, the site now requires additional excavation work to remove dioxin contaminated soils in order to meet cleanup standards protective of human health and the environment. The modification is necessary for additional excavation and sampling/analysis due to the discovery of dioxin contamination when the original pile of waste soil was being characterized for disposal. A positive result for dioxin contamination at the previously excavated area now requires that the extent of the contamination be determined for the final soil removal phase. Estimated (quote) $34,000 2. An identification of the statutory authority: FAR 13.106-1(b) Soliciting from a Single Source. 3. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires the use of the authority cited: The current contractor is experienced with conducting environmental remediation activities using the required Independent Cleanup Process (ICP) under the State of Wyoming Voluntary Remediation Program (VRP). This contractor is involved with specific requirements including coordination with the State of Wyoming Department of Environmental Quality (DEQ), submission of workplans for State assurance for the site. The contractor has recently received State approval of a workplan for the Phase II Investigation plan to continue with excavation for specific sampling and analysis necessary to determine the horizontal and vertical extent of the dioxin contamination. The current contractor has reviewed and is familiar with all previous reports from the earlier remediation activities and current data in order to determine the location for the proposed excavation. Previously excavated soils have tested positive for dioxins contamination and are awaiting disposal. The stockpiled soils will be included with the soils from the final excavation for off-site disposal by incineration at a permitted hazardous waste disposal facility. The current contractor has applied for and acquired approval for disposal of these soils through a coordinated process between the federal Environmental Protection Agency (EPA) and a permitted hazardous waste disposal facility. Any change in contractors for this project would require the preparation and approval of new workplans by the Wyoming DEQ to continue the site investigation and soil removal under the ICP program and the coordination/approval by EPA to secure transportation and disposal by incineration of the additional dioxin contaminated soils that will be excavated. 4. A description of the efforts made to ensure that offers are solicited from as many sources as is practical, including whether a CBD notice was or will be publicized as required in Subpart 5.2 and, if not, which exception under 5.202 applies: The sole source notice for the contract modification will be advertised on the Federal Business Opportunity website. 5.
