Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Organization: Department of Veterans Affairs, VISN 20, VAPSHCS. 2. Description of Action: This is a request for other than full and open competition for the procurement of Versant HCV Genotype 2.0 Assay kits. 3. Description of Supplies or Services: The Siemens Versant HCV Genotype 2.0 Assay Kits are used to identify the HCV genotype and subtype data specifically for patient therapy. 4. Statutory Authority: (x) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; ( ) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5. Validity of Use of Statutory Authority: Currently, the kit is FDA approved, CE-marked, and meets U.S. NIH treatment recommendations. In effort to meeting the highest standard of patient care, this specific kit has been determined by the technical expert to be used only on the equipment on station. In addition, the equipment manufacturer has verified compatibility with the specific kit and no other is known to be compatible. The contractor is uniquely qualified in being the sole manufacture of the required product. 6. Actions to Promote Competition: It may be possible to identify future authorized distributors, but no information has been located at this time. 7. Determination of Fair and Reasonable Price: Previous awards have been made and verified for the identical requirement. 8. Market Survey (FAR 7.102): No other vendors have been located to provide the identical requirement. 9. Other Considerations: The equipment is not designed to properly process other kits and if the option is considered, it could potentially risk patient care and waste funding originally appropriated for the required kits.
