Description
DEPARTMENT OF VETERANS AFFAIRS NETWORK 22 LOGISTICS OFFICE JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-1, 41 U.S.C. 253 (c) (1) "MAINTENANCE AND REPAIR OF GOVERNMENT OWNED DA VINCI ROBOTIC SURGICAL SYSTEM" 1. Agency and Contracting Activity Identification: The Network 22 Logistics Office, 5901 E. 7th Street, Long Beach, California, as requested by the VA Long Beach Healthcare System (VALBHS), will enter into a service contract that requires justification for other than full and open competition. 2. Nature of Acquisition Being Approved: Sole source contractor shall provide maintenance and repair of Government owned Da Vinci Robotic Surgical System to the VALBHS under the terms and conditions of a service contract. 3. Description of Requirement: VASDHS is requesting a sole source service contract from Intuitive Surgical Inc. The period of performance is July 1, 2010 through June 30, 2011 with the Government's option to exercise four (4) additional option years. The estimated for cost for five years is $725,000. 4. Statutory Authority Permitting Other Than Full and Open Competition: The service is being procured under the authority of 41 U.S.C. 253 (c) (1), FAR Part 6.302-1 (c) (1). 5. The Nature of the Acquisition Requires Use of the Authority Cited: The Da Vinci Robotic Surgical System was purchased on March 30, 2009 with a one year warranty from Intuitive Surgical and procured through Federal Acquisition Regulations (FAR) Part 12 Acquisition of Commercial Items and Far Part 13.5, Test Program. Intuitive Surgical Inc. is the manufacturer of the Da Vinci Robotic Surgical System and is able to provide software upgrades, and maintenance and repair of the equipment. This equipment cannot be properly maintained without access to the company's proprietary software and licensed information which cannot be acquired through any third party source. This Government owned equipment costs $1.2 million and is vital to the surgeries. Additionally, if this contract is not procured, and if one of the robotic arms breaks, it could cost the Government $45,000 to replace it. Furthermore, any mistake in maintenance and repair of the equipment would have a negative impact on the health and welfare of the veteran patient and could lead to death. 6. A Description of Efforts Made to Ensure That Offers From as Many Potential Sources As Practicable and Whether a Notice Will Be Publicized. See item Number 5 above. A notice will be transmitted to the GPE (FedBizOpps) from April 12, 2010 through April 23, 2010. This procurement has been solicited for the VA San Diego, Albuquerque and Tucson in September of 2009 and there were no responses. 7. Anticipated Cost: The anticipated cost should be fair and reasonable to the government based on the using service estimate and past prices paid for similar services. VA San Diego, Albuquerque and Tucson are currently procuring the same maintenance and repair service contract for the Da Vinci Robotic Surgical System with the same price for a base plus four option years. There is no fluctuation in prices as this is the flat maintenance and repair rate. 8. Results of Market Survey: Market research information was also obtained through the GSA website. Intuitive Surgical is not on the Federal Supply Schedule and is currently in the process of DEPARTMENT OF VETERANS AFFAIRS NETWORK 22 LOGISTICS OFFICE JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-1, 41 U.S.C. 253 (c) (1) "MAINTENANCE AND REPAIR OF GOVERNMENT OWNED DA VINCI ROBOTIC SURGICAL SYSTEM" obtaining a contract through the National Acquisition Center. See Item Number 5 above. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: None. See Item Number 6 above. 10. Any Other Interested Sources? There are no other sources that expressed in writing an interest in the service. See Item Number 6. 11. A Statement of the Actions, if any, the Agency May Take To Remove of Overcome Any Barriers to Competition Before Any Subsequent Acquisition is required: The anticipated life of the Government Equipment is estimated to be twenty (20) years. The Government plans to maintain this equipment for the next twenty years to maximize usage of the system. In order to overcome barriers to competition, the Government shall research other surgical equipment before the procurement of a new system. Since the software is proprietary, overcoming the barriers for competition cannot be realized at this time. 12.
