- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: VA PUGET SOUND HEALTH CARE SYSTEM/SEATTLE DIVISON, 1660 South Columbian Way, Seattle WA 98108 2.Description of Action: This is a request for other than full and open competition for the procurement, fabrication, alteration, exchange of appliances and moving of existing kitchen and dining room fixtures in the new American Lake Nursing Home (CLC). 3.Description of Supplies or Services: Alteration of new equipment in the Nursing Home Kitchen/Dining Area and moving existing equipment from building 3 and set-up in the Nursing Home Kitchen. This work is a follow on to work awarded in support of the CLC. 4.Statutory Authority: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; ( ) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5.Validity of Use of Statutory Authority: IAW FAR 6.302-1 (a)(2)(C)(ii) The supplies and services provided by the vendor are a logical follow on to previously awarded contract for the development of the CLC Kitchen. IAW FAR 6.302-1 (a)(2)(C)(ii)(A) and (B) competing this action would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. Market research of previous acquisitions associated with the CLC indicate other vendors are not willing to provide adequate credit and exchange terms to the Government for the kitchen equipment associated with this procurement. The requirement must be completed by 15 June 2010, it has been determined that competing these requirements would result in an unacceptable delay in completion. ? 6.Actions to Promote Competition: Market research based on previous competed acquisitions in support of the CLC Kitchen have indicated there is not sufficient competition available willing to offer credits and exchange equal to the offeror in order to complete renovations, modifications and changes needed for the CLC kitchen project. 7.Determination of Fair and Reasonable Price: The anticipated price to the Government is $42,981.00. Price is determined fair and reasonable IAW FAR 13.106-3(a)(2)(ii) based on previous acquisitions made recently where the vendor has exchanged kitchen equipment offering a credit for equipment already purchased to be used on current acquisitions, competition has proven that other vendors have not been willing to make the same concessions for the Governments business. 13.106-3(a)(2)(vii) prices offered by the vendor include relocation of previously installed counter tops, fixtures and equipment which were satisfactorily installed but require relocation due to changing requirements at no cost to the Government. It is the determination of the Contracting Officer that the prices listed on this acquisition are fair and reasonable and represent the best value to the Government. 8.Market Survey (FAR 10): Recent purchases for similar work have indicated the current vendor is the only local vendor willing to offer credit and exchange of equipment. Market Research indicates there is not a reasonable expectation to find another vendor willing to perform this requirement offering terms favorable to the Government. Because of the tight time constrains, the Kitchen/Dining facilities are to open 6/14/10. According to Market Research, this company is the only vendor in our area who can meet our schedule. The use of another vendor not familiar with this equipment would delay the opening. 9.Other Considerations: IAW FAR 6.303-2(9)(ii) it is estimated the costs to the Government would be increased by $10,000-$15,000 if concessions were not offered by the vendor. 10.
