JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1.CONTRACTING ACTIVITY The contracting activity will be the VA Heartland Network 15 Contracting Activity (10N15/90). Leavenworth KS. 2.NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED The water booster pump system has become inoperable with only one of the three pumps minimally working. This is request for an emergency procurement to replace a failed booster pump in the water supply system at the St Louis, MO John Cochran Division Medical Center. Currently, medical center maintenance personnel are monitoring/operating the only working pump on a 24/7 day/week basis to ensure operation and maintain water supply to the in- patient clinics. This monitoring/operation will have to be maintained on an continual basis if a replacement pump is not installed. This acquisition will enable the medical center to provide interim water pressure and water supply to the inpatient clinics while a plan is developed to upgrade the pump system. 3.DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED T O MEET THE AGENCY'S NEEDS Purchase and install an auxiliary water booster pump with 25 hp, 5" suction, 4" discharge, 3550 rpm, 468 gal/min, 3-phase 208v. Service work to begin 5-21-2010 when pump arrives at station and work to be completed by end of weekend 5-23-2010. From: Feit Plumbing 50 Weldon Pkwy Maryland Heights, MO 63043 314-567-1200 Not to exceed price of $36,940. 4.STATUARY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION ( ) 41 U.S.C. 253 (c) (1) Only One Responsible Source ( x) 41 U.S.C. 253 (c) (2) Unusual and Compelling Urgency ( ) 41 U.S.C. 253 (c) (3) Industrial, Mobilization, Engineering, Developmental, or Research Capability or Expert Services ( ) 41 U.S.C. 253 (c) (4) International Agreement ( ) 41 U.S.C. 253 (c) (5) Authorized or Required by Statute ( ) 41 U.S.C. 253 (c) (6) National Security( ) 41 U.S.C. 253 (c) (7) Public Interest FAR 6.302 (FAR 6.302-1) One responsible source and no other supplies will satisfy needs 5.DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) This vendor (Feit Plumbing) has intimate knowledge of the John Cochran campus water system and was called in to help troubleshoot the current situation. They have a positive history in performing work at this medical center and their knowledge of the existing infrastructure will allow the fastest and smoothest installation possible. 6.DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE Only one source was sought due to the emergency nature of this requirement. 7.DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE The contracting officer has determined the price to be fair and reasonable. 8.DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED This vendor was sought for this emergency because they have successfully completed other related work for John Cochran Barracks and are familiar with the station infustructure. 9.ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION None 10.LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION None 11.A STATEMENT OF THE ACTION, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO THE COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED Recommend that the station put into place a service contract for maintainance of pumping systems 12.CONTRACTING OFFICER'S CERTIFICATION In accordance with (FAR 6.303-2(a)(12)), I hereby certify the information contained herein I complete and accurate to the best of my knowledge and belief. //es// Hans Lorenzini5/20/2010 ________________________(Not Exceeding $500K) Date__________________ Contracting Officer ________________________(Exceeding $500K) Date__________________ One Level above Contracting Officer Concurred By: ________________________(Over $500K not exceeding $10 Mil) Date_________ Head of Contracting Activity
