Description
Justification for Other Than Full and Open Competition (JOFOC) Document The following Justification for Other than Full and Open Competition is prepared in accordance with Federal Acquisition Regulation (FAR) Part 6.302-1 śOnly one responsible source and no other supplies or services will satisfy agency requirements ť and the Department of Veterans Affairs Acquisition Regulation (VAAR) 806.304. 1. Agency Identification Department of Veterans Affairs (678) Southern AZ VA Health Care System (SAVAHCS) 3601 S. 6th Avenue Tucson, AZ 85723 2. Description of Action Being Approved This Justification for Other than Full and Open Competition comes as a result of a request to purchase an upgrade to the existing patient care tracker system originally purchased from in 2005. The system is used by the Rehabilitation and Transition Care Line (RTCL) at the Southern AZ VA Health Care System (SAVAHCS), Tucson, AZ for long term care patients. Request to purchase sole source from Resource Systems, Inc. (parent company is Triplett & Adams), 140 S. Friendship Dr., New Concord, OH 43762-0129. The price is estimated to be $39,006.00 for the complete upgraded system. The original system was purchased from Resource Systems. 3. Description The patient care tracker system to be upgraded provides an automated ability to track a variety of patient quality indicators and measurements used in daily patient care and was specifically designed to meet long term health care demands. The system has proven to greatly increase accuracy and timeliness of patient record documentation and reduce duplication of same compared with the previous paper based system. This results in improved patient outcomes and workload capture. The upgrade to the existing system will further improve upon the automated patient tracking attributes as part of the upgrade will provide hand held devices allowing nursing staff to record patient care data immediately as required at the point of care. 4. Statutory Authority/Authority Cited The basis of this JOFOC is the criteria implemented in the Federal Acquisition Regulation (FAR) Part 6.302-1, śOnly one responsible source and no other supplies or services will satisfy agency requirements. ť (a) Authority. (1) Citations: 41 U.S.C. 253(c)(1). (2) When the supplies or services required by the agency are available from only one responsible source, or, for DOD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for. 5. Reason for Authority Cited The reason for citing FAR Part 6.302-1 as the statutory authority for this JOFOC is that it is appropriate in this situation where the agency ™s needs could only be satisfied by the unique supplies/services available through Resource Systems, Inc. Application. This authority shall be used, if appropriate, in preference to the authority in 6.302- 7; it shall not be used when any of the other circumstances is applicable. Use of this authority may be appropriate in situations such as the following (these examples are not intended to be all inclusive and do not constitute authority in and of themselves): (1) When there is a reasonable basis to conclude that the agency's minimum needs can only be satisfied by- (i) Unique supplies or services available from only one source or only one supplier with unique capabilities; 6. Demonstrate Proposed Contractor ™s Unique Qualifications. This equipment purchase is a logical follow on purchase to upgrade the existing system. The original system was a unique commercial off-the-shelf (COTS) product and no other vendors provided information demonstrating similar systems on the market at the time of purchase in 2005. This was borne out by a synopsis for the procurement in the Federal Business Opportunities system which did not bring forth any other interested parties. Additionally, there are no known third party vendors offering this specific patient care tracker system so the system upgrade can only be readily obtained from Resource Systems. Additionally, this vendor has proven to be a responsible company maintaining a current CCR and the D&B SQR indicates a 1 risk rating which is excellent. 7. Sources Sought Efforts. The agency has done a market survey using the FSS Schedule sources, general searches over the Internet, and CCR database for similar manufacturers. As noted above no other potential sources have been found for the system upgrade. Though there are numerous vendors listed in the SBA ™s resource database under the applicable NAICS code (511210) a review of a representative sample did not indicate any specific providers for this software. A review was also done using the VetBiz.gov database with similar results. A synopsis of the requirement utilizing the FBO database, IAW FAR Part 5, will be issued to allow time for other potential sources to be identified. 8. Determination of Fair/Reasonable Price. The pricing for this open market purchase price is expected to be fair and reasonable based on past cost experience with this vendor. Additionally, a substantial discount off of the vendor ™s current published price list is expected to be offered.
