- RECOVERY: "THIS NOTICE IS PROVIDED FOR INFORMATION PURPOSES ONLY. THIS OPPORTUNITY IS AVAILABLE ONLY TO THE PRIME CONTRACTOR UNDER THE RECOVERY, TOWER CHEMICAL SITE CONTRACT NO. EP-R4-10-01 The U.S. Environmental Protection Agency (EPA), Region 4 issued this Contract for soil remediation at the Tower Chemical Company Site, located in Lake County, Florida. This requirement is under the American Recovery and Reinvestment Act (ARRA). EPA Region 4 requires additional option quantities of soil remediation. This optional quantity of soil remediation is beyond the 49,850 CY in CLIN 0001 and the 5,000 CY in CLIN 0003. A new CLIN 0005 will be added for the additional soil remediation services. The dollar value of this new option quantity is $814,200, if exercised. The additional quantity is necessary because the rate of utilization of option quantity increments has been higher than originally estimated. The scope of the soil remediation services (Tasks 1, 2, 3, 4, 5, 6, 7, and 9) remains unchanged. Additional soil excavation, transportation and off-site disposal of the soil triggered by confirmation sampling is necessary as the excavation proceeds and before backfilling with clean soil can occur. The option quantities, if exercised, will be ordered in 100 CY increments. The maximum not-to-exceed quantity is 100 - 100 CY increments (10,000 CY). The statutory authority permitting other than full and open competition relative to this request is 41 U.S.C. 253 (c) (1), Only One Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by paragraph 6.302-1 of the Federal Acquisition Regulation (FAR). The additional option quantities are inextricably intertwined with the work under the current contract. It is likely that award to any other source would result in (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition and (B) Unacceptable delays in fulfilling the agency requirements. In addition, site safety hazards such as personnel, trespassers or vehicles falling into open excavations are created by leaving an excavation open any longer than necessary. There is also an urgent need due to the continuing imminent and substantial threat to human health and the environment until the site is properly remediated. The justification for other than full and open competition document will be posted after issuance of this modification in accordance with FAR 6.305.
