- The Government intends negotiate a commercial (FAR Part 12) Sole Source contract with Roche Diagnostics, under the authority of FAR 6.302-1, for Roche Diagnostics Magna Pure Reagents and Consumables. Agency and Contracting Activity Identification: The VA Long Beach Network 22 Logistics Office, 5901 E. 7th Street, Long Beach, California, as directed by the Participating Facilities: a.VA Greater Los Angeles Healthcare System (VAGLAHS) 11301 Wilshire Blvd. Los Angeles CA. 90073 ATTN: Pathology & Laboratory b.VA Long Beach Healthcare System (VALBHC) 5901 E 7th street Long Beach CA. 90822 ATTN: Diagnostic & Molecular Medicine HCG Nature of Acquisition: Purchase of Roche Diagnostic's Magna Pure Reagents and Consumables. Description of Requirement: The Contractor is to provide Roche Diagnostic's Magna Pure Reagents and consumables for the VALBHS and VAGLAHCS. Reagent and Consumable help assist the automation of patient samples, such as those used by Hepatitis Testing. Statutory Authority Permitting Other Than Full and Open Competition: The requirements are being procured under the authority of 41 U.S.C. (c) (1), FAR Part 6.302-1(a). The proposed contractor is the only company that can fulfill the requirements set forth by the VALBHS and VAGLAHCS. VALBHS and VAGLAHCS currently utilize Roche Diagnostic's Magna Pure system. There are no other brands that can supplement Roche Diagnostic's Magna Pure Reagents. The Nature of the Acquisition Requires Use of the Authority Cited: Consumable supplies and reagents must be purchased through Roche in order for the two VA Facilities to automate the preparation of patient samples using the Government owned Roche Magna Pure System. The Samples preparation system and Magna Pure Reagents are proprietary to Roche Diagnostics as are the consumable supplies for the sample processing. A Description of Efforts Made to Ensure That Offers From as Many Potential Sources As Practicable and Whether a Notice Will Be Publicized. A notice will be publicized/synopsized for this procurement in accordance with FAR Part 5. Anticipated Cost: The anticipated cost is fair and reasonable to the government based on the using service estimate and past prices paid for similar services. Results of Market Survey: Market research was conducted. Roche Diagnostic has a General Services Administration (GSA) Federal Supply Schedule (FSS) contract. However, the reagent and consumables for this solicitation are not covered under Roche Diagnostic's GSA FSS Contract. Market research was also conducted to identify specific factors of this type of procurement utilizing the internet and phone conversations with FSS contractors and technical experts. There are several FSS contract holders with the ability to provide VAGLAHCS and VALBHCS with Patient Sampling. However, the cost to obtain new equipment for patient sampling will bring unnecessary cost to the Government. Due to the Proprietary nature of this acquisition, VALBHCS and VAGLAHCS encompasses only one specific vendor with the capabilities of providing the Government's needs.
