- Specifica Tecnica TEC SPEC Specifica Tecnica TEC SPEC Specifica Tecnica TEC SPEC Specifica Tecnica TEC SPEC Specifica Tecnica TEC SPEC Specifica Tecnica TEC SPEC Specifica Tecnica TEC SPEC Specifica Tecnica TEC SPEC Specifica Tecnica TEC SPEC ATTACHMENT 1 Paving Prices/ALLEGATO 1 Prezzario Specifica Tecnica TEC SPEC BASIC ORDERING AGREEMENT TEMPLATE/ BOZZA ACCORDO The purpose of this solicitation is to competitively issue up to five (5) Basic Ordering Agreements (BOA) for the preparation and application of various types pavements, base and sub base work, at Aviano Air Base, Italy. A Basic Ordering Agreement is a written instrument of understanding, negotiated between an agency, contracting activity, or contracting office and a contractor, that contains: (1) terms and clauses applying to future contracts (orders) between the parties during its term, (2) a description, as specific as practicable, of supplies or services to be provided, and (3) methods for pricing, issuing, and delivering future orders under the basic ordering agreement. A basic ordering agreement is not a contract. Each order issued shall be subject to the contract clauses, provisions, certifications, terms, conditions and pricing of the BOA. There is no guaranteed minimum dollar amount or volume of work that will be ordered under the agreement. Government funds are obligated only to the extent that a duly issued orders creates such obligation. Firms issued a BOA may receive requests for technical and/or price proposals leading to award of orders. Issuance of Basic Ordering Agreements will be based on evaluation of qualifications in accordance with the criteria as set forth below. Award of specific orders as requirements arise will be based on price, and other factors as deemed desirable and set forth for each specific requirement. Specific firm fixed price orders will be competed among the successful firms. The Government, in its sole discretion, will determine which, and how many, of the firms holding Basic Ordering Agreements will be requested to submit price and technical proposals for requirements leading to firm fixed price orders. The approximate range in value of orders is expected to be $1,000.00 to $750,000.00 (Euro 773.00 to Euro 581,000.00). The foreseen average number of orders per year is 12 for an approximate aggregate value of $1,200,000.00 (Euro 860,453). Under this PAVEMENTS program, firms selected for a BOA will compete on task orders for requirements. If adequate competition cannot be obtained, the Government reserves the right to open the area of competition to include non BOA holders. The anticipated types of work may include but is not limited to the following: removing asphalt and concrete pavements, milling asphalt pavements, providing asphalt overlays of existing pavements, providing new asphalt pavements, concrete sidewalks and curbing. Pricing. In order to provide maximum flexibility for market conditions, economies of scale and quantity considerations and other price influencing factors which may vary from timer to time firms will be required to submit Not to Exceed unit prices for each of the anticipated 5 year duration of the BOA. Each order under the BOA shall be on a Firm Fixed Price basis. The order proposal cannot be based on prices that exceed the applicable work item ceiling price (Not to Exceed) for the applicable period. The Contracting Officer will open/advertise the BOA program through the Federal Business Opportunities website (http://www.fbo.gov) for new entrants once a year or at intervals that will guarantee adequate competition for this specific coating program. The BOA can only be changed by modification of the agreement itself and not by individual orders issued hereunder. Modification of the BOA shall not retroactively affect orders issued prior to the time of the modification. A BOA may be cancelled by either party by mailing or otherwise transmitting 30 days prior written notice to the other party. Any such cancellation shall have no effect on any orders issued prior to the effective date of the cancellation, which shall be 30 days from the date of mailing or otherwise transmitting the written notice of cancellation. Prior to the effective date of cancellation, the 31st Contracting squadron may continue to place orders under the BOA. Firms that demonstrate that they meet the following qualifications will be considered for issuance of a BOA. Up to five BOA's will be issued to the first five most qualified firms Upon submission of the following information, the Government will review the documents and the firm will be determined to be either eligible or ineligible. To qualify for receipt of a BOA, each firm must meet all the following minimum criteria: NOTE: For Items 1, 2, 3, and 4, European Common Market firms established outside of the Republic of Italy shall present their Government's corresponding documents with an English translation of each document 1. Copy of Chamber of commerce enrollment no later than 90 days old from closing date of this solicitation. 2. Compliance with DPR : DECRETO DEL PRESIDENTE DELLA REPUBBLICA (D.P.R.), JANUARY 25, 2000, NO. 34 Pursuant to the general requirements to be entitled to bid or submit an offer in accordance with art. 17 of D.P.R. n. 34 of 25 January 2000, each firm/offeror shall submit with its offer, in the self-certification format established by D.P.R. n.403/98, documents certifying they meet the general requirements contained therein. Pursuant to the special requirements to be entitled to bid or submit an offer in accordance with art. 18 of D.P.R. n. 34 of 25 January 2000, each firm/offeror shall submit with its offer, in the self-certification format established by D.P.R. n. 403/98, documents certifying that, with reference to the five-year period prior to the date of this solicitation, they meet the special requirements contained therein. FAILURE TO FURNISH THE SELF -CERTIFICATIONS FOR BOTH THE SPECIAL AND GENERAL REQUIREMENTS BY THE TIME SET FOR THE SOLICITATION'S CLOSING DATE, MAY BE CAUSE FOR ELIMINATION OF THE OFFEROR FROM THE COMPETITION IN NEGOTIATED PROCUREMENTS. 3. DURC document issued by Italian authorities or equivalent document issued by member nation of the European Community. The DURC document shall be submitted for direct hire employees as well as any self employed person and subcontractors. This document must not be older than 90 days from date of contractor proposal. 4. Copy of SOA for Category OG3 Classification I, as a minimum. The greater the number of categories and higher classification the higher the qualification consideration. 5. List of flexible and rigid pavement work including base and sub-base work over the last 3 years from date of closing of this solicitation. This list shall include a description of work performed, the client name, address and POC information, amount of the contract, date work initiated and date completed. Note: The greater the number of different types of coating work performed the higher the qualification consideration. 6. Satisfactory Past performance rating. Interested firms shall submit information references on the attached form for at least 3 different clients for work performed over the last 3 years. The Contracting Officer reserves the right to contact clients to obtained past performance information and rating as well as to obtained such information from other other commercial or U.S. Government sources such as PPIRS, CCASS and CPARS. The better the past performance rating the greater the qualification consideration. Required documentation to be submitted by the closing date: 25 May 2010, 17.00 hrs (5:00 PM) CEDST.
