Justification for Other Than Full and Open Competition (J&A) Authority: (10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1)    Project/Program Name: FINLOG Web Services for Supply and Financial Data. Component: USASOC G-4, Systems Management Division. Estimated Contract Cost (including options): Type J&A: (Individual 1 or Class 0) J&A No. 10-006 1. Agency and Contracting Activity: (FAR 6.303-2(a)(1)) Agency: USASOC G-4, Systems Management Division Contracting Activity: Deputy Chief of Staff, Acquisition and Contracting, United States Army Special Operations Command, Building E-2929, Fort Bragg, North Carolina 28310. 2. Description of Action: (FAR 6.303-2(a)(2)) Approval is requested for a new contract award. The action will be awarded as a firm fixed price award. The period of performance will be a base for 12 months from 01 May 2010 - 30 April 2011 with four 1-year options. This requirement will be funded with FY2010, MFP11 Funds. 3. Description of Supplies/Services: (FAR 6.303-2(a)(3)) The United States Special Operations Command (USASOC) G-4, Systems Management Division, has a requirement for FINLOG service which provides access to a database driven website developed to provide a centralized supply and financial database for the Army. The products shall include interfaces with resource management related systems, specifically an interface to SARSS that provides logistics cost data and information, and building web based services to meet the design requirements of the commands network to include all USASOC units regardless of geographical location. The estimated award amount for all years is 4. Authority Cited: (FAR 6.303-2(a)(4)) 1 10 U.S.C 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1. 5. Reason for Authority Cited: (FAR 6.303-2(a)(5)) With the fielding of the Standard Army Retail Supply System (SARSS) within the United States Army, many financial interface issues with the Command Commodity Supply System (CCSS), Standard Army Retail Supply System (SARSS), and Standard Army Financial System (STANFINS) have surfaced. FINLOG provides a centralized SUPPLY/FINANCIAL Web service with near real time (24 Hr) financial information tracking, tailored reports and queries, one stop research capability, and a means to validate financial input files. FINLOG is a proprietary computer product that is used by the United States Army. The product was originally created and developed by XOtech LLC. The personnel support for the FINLOG services included functional analysis, custom data inquiries, database management, help desk services, etc. In March 2006, the USASOC DCSAC issued a Request For Quotation (RFQ) on GSA e-BUY with a generic statement of work/specification for a web-based financial logistics system. Only one response was received and a task order H92239-06-F-0144 was awarded XOtech LLC against GSA Contract Number GS-10F-0469N. For a base year with four (4) one-year options. The period of performance for the base year was 01 May 2006 - 30 April 2007. In February 2009, prior to exercising the option year, XOtech requested a novation agreement against the task order. Effective December 31, 2008, XOtech transferred FINLOG to RapidFire Systems. The transfer included FINLOG and the people who provide the FINLOG services. Upon reviewing the document supporting the requested novation agreement, the contracting office found that GSA did not modify the GSA schedule to process a novation agreement to RapidFire. Additionally, GSA noted that FINLOG was not a scheduled item. Therefore, the DCSAC could not process the novation agreement or exercise the 3rd option year (01 May 2009 - 30 April 2010) of the existing task order. Because FINLOG is a critical service for USASOC and there was a contract in place, the Government posted a notice of intent to negotiate a sole source purchase order to RapidFire. Award number H92239-09-P-0062 was awarded on 29 April 2009 with a period of performance of 01 May 2009 through 30 April 2010. As indicated above, the FINLOG services are proprietary and all rights, titles, and interest in the software product have been transferred from XOtech to RapidFire Systems. The FINLOG services are not available from any other sources. Therefore, a notice of intent to negotiate a sole source award for FINLOG services to RapidFire Systems will be posted on the Federal Business Opportunities (FedBizOpps) website. The award will be issued to RapidFire Systems, 51 Market Square Road, Suite G, Newnan, GA 30265. The period of performance will be for a base (1-year) starting 01 May 2010 - 30 April 2011 and four (1-year) options. 6. Efforts/Actions to Increase Competition: (FAR 6.303-2(a)(6)) A notice of intent to negotiate a sole source award with RapidFire Systems will be publicized to the Federal Business Opportunities (FedBizOpps) website on 23 March 2010 as required by FAR 5.2. The notice will state that responsible sources capable of meeting the requirement may submit technical, delivery, pricing, and past performance data sufficient to determine capability to perform. Any responses received will be evaluated to determine if a competitive award can be made. 7. Market Research: (FAR 6.303-2(a)(8)) A general Internet search for "FINLOG" returns information on Xotech's and RapidFire's websites. A search of GSA Advantage reveals no schedule holders that can provide the FINLOG services. The Technical Industrial Liaison Office (TILO), Office of Small Business Programs (OSBP), and USSOCOM Directorate IDIQ databases were reviewed as part of the market research process. However, none of these tools identified potential sources for this requirement. The DCSAC and the requiring activity will continue to perform market research to identify potential products/services that will meet the Government's needs and sources that are capable of providing the necessary support. 8. Interested Sources: (FAR 6.303-2(a)(10)&(11)) To date, no sources have identified an interest in the requirement or the ability to provide the required services in response to the previously posted notice. As stated in paragraph 6 above, any responses received against the current notice of intent will be evaluated to determine if a competitive award can be made. 9.
