- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Organization: Department of Veterans Affairs, Acquisition Service Area Office (ASAO) East - 8, VA Caribbean Healthcare System, San Juan, Puerto Rico. 2. Description of Action: This is a request for other than full and open competition for the procurement of design-build services to renovate an existing leased building in order to establish the new VA Comerio Rural Clinic at Coined, PuertoRico. VA intents to negotiate and award a firm-fixed price, sole source, contract with MTC Taller 34, a VIP database registered Service-Disabled Veteran-Owned Small Business (SDVOSB) Company. Government estimate is $ 277,000.00. Requirement will be synopsized in accordance with FAR Part 5. 3. Description of Supplies or Services: Contractor will develop as-built drawings, develop design, construction documents, construction cost estimate, and construction for the project at the VA Comerio Rural Clinic in accordance with the approved VA conceptual plan; all to be designed according to latest Federal standards and regulation and the Community Based Outpatient Clinic VA Design Guide, Life Safety Code Standards, Handicapped Accessibility Standards and all other federal government standards and regulations. This project will renovate approximately 1,260 gross square feet on the first floor of an existing building (annexed to the Major Office) located in Cuba Libre Street intersection Munoz Rivera Street, Comerio, Puerto Rico. 4. Statutory Authority: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 (X) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5. Validity of Use of Statutory Authority: The timeframe for the renovation of an existing building for the opening of the new VA Comerio Rural Clinic at Comerio, Puerto Rico is under a tight schedule. VA is required to complete the renovation and open the clinic by May 2010. There is not enough time to request competitive proposals under a set aside for Service-Disabled Veteran-Owned Small Business concerns, comply with the time frames set by regulations, and be able to have the work completed by May 2010 as required. The only viable way to be able to accomplish this is to use the authority under the Veterans First Contracting Program to award sole source contracts to registered SDVOSB concerns under certain conditions. MTC Taller 34, a VIP database registered SDVOSB, has been determined to be a responsible contractor with the experience and capability to complete the work in the allotted time. Contractor is registered in the CCR. 6. Actions to Promote Competition: This is a one time action. 7. Determination of Fair and Reasonable Price: The anticipated price to the Government is $ 277.000.00. Contractor's proposal will be evaluated against the estimated cost. Negotiations will be held, if required, in order to reach a fair and reasonable price. 8. Market Survey (FAR 10): MTC Taller 34 was selected since the company has the personnel that recently completed the build-out for a similar VA rural clinic at Utuado, Puerto Rico. Company was contracted by the Lessor of this4acility. Performance was excellent and project was completed on time, allowing the Government to open the clinic as scheduled. Contractor is very knowledgeable of VA procedures and requirements as demonstrated in previous work. 9. Other Considerations: None 10. Listing of Sources that expressed, in writing, an interest in the acquisition: Refer to paragraph 5. 11. Statement of Actions to Overcome Barriers to Competition: None. This is a one time action. 12.
