DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. CONTRACTING ORGANIZATION: Department of Veterans Affairs, Puget Sound Healthcare System (VAPSHCS), VISN 20 Contracting Office, American Lake Division 1600 Veterans Drive, Tacoma, WA. 2.DESCRIPTION OF ACTION BEING APPROVED: This document sets the justification and approval for award of a purchase order to Datacom Wireall, a Service Disabled Veteran Owned Small Business (SDVOSB) concern, using other than full and open competition in accordance with the Department of Veterans Affairs IL 049-07-08. The Department of Veterans Affairs IL 049-07-08 changes the priorities for contracting preferences within VA, placing SDVOSB and VOSB first and second, respectively in satisfying VAs acquisitions requirements. 3. DESCRIPTION OF SERVICES REQUIRED TO MEET AGENCYS NEEDS: This request is for the procurement of moves, adds, and changes of data lines, telephones, and telecom projects. Also the contractor will be responsible for trouble-shooting of data, telephone, and miscellaneous telecom equipment at the American Lake and Seattle facility. The work to be performed by the contractor will support the IT telecom section with mission essential telecom projects at our major campuses. Awarding the purchase order to Datacom Wireall will enable the VA to have a contract in place with a firm that has the technical knowledge and experience working with various special systems and wiring structures at both sites. A purchase order for this service was issued to Datacom Wireall on 1 December 2009, purchase order # VA663-C00174. Short before the expiration of the contract the requesting activity realized that many projects needed to be completed. At this point, it was too late to put a requirements package together and solicit a new contract. Using noncompetitive procedures at this time is the most advantageous method of acquisition for the Governments requirements based on the following factors: Datacom Wireall has performed in a satisfactory manner, has all the equipment and manpower available to perform the required service. Datacom Wireall prices reflect the contractors original bid prices. Awarding a contract to Datacom using noncompetitive procedures will reduce the disruption of services that could occur during a transition of contractors. The time and effort involved in preparing a new solicitation and awarding a contract involves a minimum of 45 days, re-soliciting the services would create a break in continuity of services. 4. AN IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION: The statutory authority allowing use of other than full and open competition for this requirement is FAR Part 6-302-5, Authorized or Required by Statute, under the authority of 38 U.S.C. 8127 & 8128 and the Department of Veterans Affairs IL 049-07-08. 5. ACTIONS TO PROMOTE COMPETITION: No actions are taken at this time to seek sources outside of statutory requirements. Market research was not conducted due to time constraints and urgency of the services. 6. DETERMINATION OF FAIR AND REASONABLE PRICE: The proposed price, when compared with previous acquisition for the same services, it appears to be fair and reasonable. 7. LISTING OF SOURCES THAT EXPRESSED, IN WRITING, AN INTEREST IN THE ACQUISITION: No sources have expressed an interest in this acquisition. 8. STATEMENT OF ACTIONS TO OVERCOME BARRIERS TO COMPETITION: For future requirements for same or similar services, this office will, as appropriate, seek opportunities to increase competition through use of competitive procedures best suited to the circumstances of the contract action. 9.
